" RESOLUTION CONFIRMING THE CRE"TION OF THE
NORTH N"PLES ROADW"Y MSTU r..ND "SSESSMENT
DISTRICT r..ND PROVIDING THAT THE ASSESSMENT
PROCEDURES SHALL BE LEVIED r..ND IMPOSED
PURSUANT TO COLLIER COUNTY ORDINr..NCE NO. 88-23
FOR THE NORTH NAPLES ROADWAY MSTU r..ND
ASSESSMENT DISTRICT.
WHEREAS, the Board of County Commissioners of Collier
County, Florida, adopted Ordinance No. 85-13 on March 19, 1985
creating the North Naples Roadway Municipal Services Taxing and
Benefit Unit; and
WHERE"S, the Board of County Commissioners on August 5, 1986
adopted Ordinance No. 86-40 which supplemented and amended
Ordinance No. 85-13 by providing for the construction of
assessable improvements, establishing assesslnents against
benefitted properties, providing for the issuance of assessment
bon~s and establishing a method of collection of the special
assessments; and
WHEREAS, on August 5, 1986, the Board of County
Commissioners adopted Resolution No. 86-125 which initiated a
program for the purpose of providing for the construction of road
and waterline improvements in the North Naples Road MSTU and the
cost of said improvements to be paid by a special assessment
against the benefitted properties; and
WHEREAS, the Board of County Commissioners on August 5, 1986
adopted Resolution No. 86-126 which approved the plans and
specifications and the estimate of cost for the roadway and
waterline improvements within the North Naples Roadway MSTU and
ordered the construction of the improvements; and
WHEREAS, on October 7, 1986 the Board of County
Commissioners adopted Resolution No. 86-190 which confirmed the
tentative apportionment of estimated costl and
WHERE"S, the Board of County Commissioners on February 23,
1988 adopted Ordinance No. 88-23 which established the procedure
for the creation of municipal service benefit units and provides
for the levy and collection of special assessments.

NOW, THEREFORE, BE IT RESOLVED BY THE BO.\RD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that.
1. The North Naples Roadway MSTU and Special "ssessment
District shall levy and impose the special assessments pursuant
to the assessment procedure contained in Collier County Ordinance
No. 88-23.
2. The assessment procedures contained in Ordinance No.
86-40 and Resolutions No. 86-125, 86-126 and 86-190 are hereby
superseded by the procedures provided in ordlnance No. 88-23.
3. ordinance No. 85-13 which created the North Naples
Roadway Municipal Service Taxing and Benefit Unit is hereby
superseded as to the procedures for municipal service taxing and
benefit units contained in Ordinance No. 88-43.
4. The Board ratifies the creation and establishment of the
North Naples Roadway Municipal service Taxing and Benefit Unit
and Assessment District.
5. The staff is hereby authorized to proceed with the
construction or reconstruction of assessable improvements in
accordance with the procedures outlined in Ordinance No. 88-23.
