Resolution 1989-039 FEBRUARY 21, 1989 RESOLUTION NO. 89-~ A RESOLUTION AUTHORIZING THE ACQUISITION OF LANDS BY GIFT, PURCHASE OR CONDEMNATION, NECESSARY FOR A DRAINAGE EASEMENTS TO PROVIDE DRAINAGE OUTFALL FOR POINCIANA VILLAGE. WHEREAS, on November 24, 1987 the Board of County Commissioners authorized the acquisition of drainage easements at the west end of Coach House Lane to provide drainage outfall for poinciana village. NOW, THEREFORE, BE IT RESOLVED BY THE BOA~ OF CO'JNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it is the judgment of said Board that drainage easements at the west end of Coach House Lane are necessary and in the best interests of Collier County. AND IT IS FURTHER DETERMINED AND RESOLVED that to implement said construction of the drainage outfall it is necessary for the Board to acquire by gift, purchase or condemnation perpetual nonexclusive drainage easement interests in the property described herein. AND IT IS FURTHER RESOLVED that the County staff ill authorized to immediately acquire by gift, purchase, or condemnation in accordance w+th the provisions of Chapters 73, 74 and 127, Florida Statutes, perpetual nonexclusive drainage easements more particularly described as follows: The West 30 feet of the West 1/2 of the Southwest 1/4 of the Southeast 1/4 of the Southwest 1/4 of Section 23, Township 49 Squth, Range 25 East, Collier County, Florida, less the North 30 feet thereof reserved for road right-of-way, said parcel also known as Lot 13, Colonial Acres, an unrecorded subdivision, AND The North 15 feet and the West 30 feet of the West 1/2 of the Northwest 1/4 of the Southeast 1/4 of the Southwest 1/4 of Section 23, Township 49 South, Range 25 East, Collier county, Florida, also known as Lot 12, Colonial Acres, an unrecorded subdivision. AND IT IS FURTHER RESOLVED that no mobile homes are located on the property sought to be acquired and therefore it will not be necessary to remove any mobile homes from the property to be acquired. t9~ 1-11' ' I~ ,...'
