Resolution 1989-018 JANUARY 24, 1989 RESOLUTION NO. 89- 18 . . ..""- A RESOtU~ON IN SUPPORT OF AN INTERCHANGE AT THE JUNCTIO*' OF I-75/S.R. 29 AND IN SUPPORT OF LAND USE PROCEDURES FOR PROTECTION OF THE PANTHER AND PANTHER HABITAT ALONG S.R. 29. WHEREAS, the Florida Department of Transportation (FDOT) has undertaken transportation studies which confirm the need of an interchange at 1-75 and S.R. 29; and WHEREAS, the Board of County Commissionprs (BCC) of Collier County support and would like to expedite the process of roadway design, permitting, right-of-way acquisition, and construction of the needed interchange at 1-75 and S.R. 29; and WHEREAS, the BCC recognizes the panther habitat area in Eastern Collier County which includes the S.R. 29 corridor from U.S. 41 to a point six (6) miles north of 1-75; and WHEREAS, the BCC would like to assure that any and all proposed land use changes within the panther habitat area and specifically along the S.R. 29 corridor between U.S. 41 and a point six (6) miles north of 1-75 take into consid3ration the panther habitat area, the potential interaction which possibly would result with a change in land use, and the appropriate mitigation measures applicable to protection of the panther and the panther habitat area. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the following agencies will be immediately advised upon receipt by the County of petitions for changes in land use within the panther habitat area as defined on Attachment I and along the above-specified S.R. 29 corridor. 1. Florida State Game and Fresh Water Fish Commission 2. Florida State Department of .Natural Resources 3. united states Fish and wildlife Services 4. National Park Service, Big Cypress National Preserve 5. United States Army Co~p of Engineers ........... " , ~ , JANUARY 24, 1989 ~~" '\' BE IT FURTHER RESOLVED that that the agencies outlined above will be requested by the Board of County Commissioners to provide, within sixty (60) days after receipt of a petition, their review, , comments, and recommendations for appropriate mi.tigation measures in protection of the panther and panther habitat area. The resulting comments and recommendations will be conside~'ed by the Board of County Commissioners prior to any final decision on proposed land use changes. For implementation of the above procedure, a land use change shall be defined as a petition fa., rezone, for zoning variance, for provisional use, for property vacation, for site development, and for subdivision Master Plan. BE IT FURTHER RESOLVED that a copy of this Resolution will be provided to each of the above-listed agencies. This Resolution adopted after motion, second and roll call.
