Joo:;IIZl ~ ClII::: 11III ~_....... <11...::1...... 0:= u__ RESOLUTION NO. 08--05- A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, RELATING TO PETITION AVROW-2006-AR-10761 , DISCLAIMING, RENOUNCING AND VACATING THE COUNTY'S AND THE PUBLIC'S INTEREST IN TWO 20' BY 30' RIGHT-OF-WAY AREAS ALONG ALACHUA STREET, BEING ORIGINALLY A PART OF MONROE AVENUE RIGHT-OF.WAY AS SHOWN ON THE PLAT KNOWN AS "NEWMARKET SUBDIVISION", AS RECORDED IN PLAT BOOK 1, PAGES 104 & 105 OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA BEING LOCATED WITHIN SECTION 34, TOWNSHIP 46 SOUTH, RANGE 29 EAST, COLLIER COUNTY FLORIDA, BEING MORE SPECIFICALLY SHOWN AND DESCRIBED IN EXHIBIT A. WHEREAS, pursuant to Section 177.101, Florida Statutes, Petitioners, Schwab Ready-Mix, Inc., and Mr. Richard Johnson, have requested the vacation of the northerly portion of a 20' by 30' right-of-way area, and the southerly portion of a 20' by 30' right- of-way area along Alachua Street being originally a part of Monroe Avenue right-of-way as shown on the Plat known as "Newmarket Subdivision" , as recorded in Plat Book 1, Pages 1 04 & 1 05 of the Public Records Collier County, Florida being located within section 34, Township 46 South, Range 29 East, Collier County Florida being more specifically shown in Exhibit A; and WHEREAS, the Board has this day held a public hearing to consider the aforementioned vacation request, and notice of said public hearing to was given as required by law; and WHEREAS, the granting of the vacation request will not adversely affect the ownership or right of convenient access of the property owners. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest in the rights-of-way as specifically described in Exhibit 'A' is hereby vacated, extinguished, renounced and disclaimed, and this action is declared to be in the Public's interest and for the Public's benefit. BE IT FURTHER RESOLVED AND ORDERED that the entire right-of-way as described in Exhibit 'A' is retained as a utility easement. BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby directed to record a certified copy of this Resolution in the Official Records of Collier County, Florida, and to make proper notation of this vacation on the recorded plat as referenced above.
