RESOLUTION NO. 08- 04
A RESOLUTION OF THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA, AMENDING
RESOLUTION NO. 07-247, RELATING TO PARKING
EXEMPTION PETITION PE.2006-AR.I0551, IN ORDER TO
CORRECT A SCRIVENER'S ERROR IN THE
CONDITIONS OF APPROVAL.
WHEREAS, on September 11, 2007, the Collier County Board of Zoning Appeals
adopted Resolution No. 07-247; and
WHEREAS, following said action adopting Resolution No. 07-247, it was determined
that one of the Conditions of Approval (Condition #6), attached to the Resolution as Exhibit "C",
was incorrect and not as was otherwise intended and made part of the public hearing and
therefore constitutes a scrivener's error.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA, that:
1. Condition #6 of Exhibit "c" to Resolution 07-247, "Conditions of Approval," is hereby
amended to correct a scri vener' s error and shall read as follows:
6. The petitioner shall revise the site plan as part of any development order
submittal to show a s* four-foot high barrier wall along the southern
boundary of the property.
2. Except as modified above, all other Conditions of Approval, as contained in Exhibit "c"
to Resolution No.247, shall remain in full force and effect.
BE IT FURTHER RESOLVED that this Resolution relating to Petition No. SE-2007-AR-
12491 be recorded in the minutes of this Board.
THIS RESOLUTION ADOPTED after motion, second, and majority vote favoring same,
