RESOLUTION NO. 91-~3AHUARY 8. liil
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, AUTHORIZING THE ACQUISITION OF EASEMENTS
REQUIRED FOR THE CONSTRUCTION OF ROAD, UTILITY, AND DRAINAGE
IMPROVEMENTS TO WESTCLOX STREET, FROM SR-29 TO CARSON ROAD, AND
TO CARSON ROAD, FROM WESTCLOX STREET TO IMMOKALEE DRIVE.
WHEREAS, the Board ot County Commissioners on June 8, 1990,
adopted the Flve Year Secondary Road Program covering
FY 89/90 through FY 94/95, ot which improvements to Westclox
Street and Carson Road are component parts listed as CIE Project
Numbers 026 and 035, respectively; and
WHEREAS, construction ot the above-described improvements may
require the acquisition ot various perpetual and non-exclusive
easements, as appropriate, across those lands as identitied in
Exhibit "A".
NOW , THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1 . It is hereby determined that the acquisition by CoUier
County of perpetual, non-exclusive easements for the construction
of roadway, utility and drainage improvements is necessary and in
the best interests ot the citizens ot Collier County.
2. Negotiations tor the acquisition of perpetual, non-exclusive
easements across those lands as identitied in Exhibit "A",
attached hereto and incorporated herein, and which may be
required tor the construction ot the above-described
improvements, are hereby authorized.
3. The Chairman ot the Board ot County Commissioners ot Collier
County, Florida is hereby authorized to execute, on behalt ot the
Board, all Easement Agreements which do not exceed the appraised
value of said easementa; and to execute, on behalf of the Board,
all other agreements and instruments pertinent to the acquisition
ot said easements which have been reviewed and approved tor torm
and legal sutticienc)' by the Ottice ot the County Attorney.
4. All perpetual, non-exclusive easements acquired pursuant to
the provisions ot this Resolution are hereby accepted by the
Board ot County Commissioners ot Collier County, Florida.
