ORDINANCE NO. 07-~
AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, FOR A
SMALL SCALE AMENDMENT TO THE COLLIER COUNTY
GROWTH MANAGEMENT PLAN, ORDINANCE NO. 89-05, AS
AMENDED SPECIFICALLY: AMENDING THE FUTURE LAND
USE MAP 'AND FUTURE LAND USE MAP SERIES (MAP OF
ACTIVITY CENTER NUMBER 13) OF THE FUTURE LAND USE
ELEMENT, TO CHANGE THE DESIGNATION OF 9.95 :t
ACRES, FROM AN URBAN INDUSTRIAL DISTRICT TO AN
URBAN COMMERCIAL DISTRICT, MIXED USE ACTIVITY
CENTER SUBDISTRICT (#13); LOCATED IN SECTION 11,
TOWNSHIP 49 SOUTH, RANGE 25 EAST; PROVIDING FOR
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the Collier County Board of County Commissioners adopted the ccrl,tfer
County Growth Management Plan (GMP) on January 10,1989; and

WHEREAS, the Collier County Board of County Commissioners adopted:the Future
Land Use Map and Map Series on January 10, 1989 and the Future Land Use MapSerje's of
the GMP depicting site specific boundaries for Activity Centers, on May 9, 2000, and
WHEREAS, the request is for an amendment to the Future Land Use Element, Future
Land Use Map and Map Series, which includes the Activity Center Number 13 Map, involving
less than 10 acres of land; and
WHEREAS, Timothy Hancock of Davidson Engineering, Inc., representing Jonathan
Myers and Thomas Myers, of Myers Enterprises of Naples, LLC and Naples Dodge, Inc., the
applicant, has submitted a request to amend the boundaries of the Activity Center Number 13
Map, as depicted on the Maps that are a part of the Future Land Use Map and Map Series of
the Collier County GMP, to expand the Activity Center by 9.95:t acres, and correspondingly to
amend the boundaries of the Urban Industrial District, as depicted on the Future Land Use Map,
to contract the Urban Industrial District by 9.95:t acres; and
WHEREAS, the amendment does not involve a revision to the text of any of the Goals,
Objectives, or Policies of the GMP; and
WHEREAS, pursuant to Subsection 163.3187(1 )(c), Florida Statutes, this amendment is
considered a Small Scale Amendment; and
WHEREAS, all applicable substantive and procedural requirements of law have been
met.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE:
ADOPTION OF SMALL SCALE AMENDMENT TO THE FUTURE LAND
USE ELEMENT, FUTURE LAND USE MAP AND MAP SERIES.
This Ordinance as described herein shall be known as the CPSS-2007-1, Small Scale
Amendment to the Future Land Use Map and Map Series of the Collier County Growth
Management Plan. The boundaries of Activity Center Number 13, as depicted on the Future
Land Use Map and Map Series of the Future Land Use Element, are hereby amended as
depicted on Exhibit A, attached hereto and incorporated by reference herein, and the
boundaries of the Urban Industrial District, as depicted on the Future Land Use Map, are hereby
amended as depicted on Exhibit A, attached hereto and incorporated by reference herein.
SECTION TWO:
SEVERABILITY.
If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court
of competent jurisdiction, such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the remaining portion.
SECTION THREE: EFFECTIVE DATE.
This Ordinance (Small Scale Amendment) shall not become effective until 31 days after
its adoption. If challenged within 30 days after adoption, this Ordinance shall not become
effective until the Department of Community Affairs or the Administration Commission,
respectively, issues a final order determining the adopted Small Scale Amendment to be in
compliance.
