RESOLUTION 07- 348
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
PURSUANT TO SECTION 10.02.13.D. OF THE COLLIER
COUNTY LAND DEVELOPMENT CODE, AFFECTING
ORDINANCE 04-75, KNOWN AS THE HIW ASSE CPUD, BY
EXTENDING THE CURRENT PUD APPROVAL TO
NOVEMBER 16, 2009; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Hiwasse CPUD, Ordinance 04-75, adopted on November 16, 2004, is
subject to the provisions of Section 10.02.13.0. of the Land Development Code (LDC), Time
limits for approved PUDs; and
WHEREAS, the Hiwasse CPUD was adopted consistent with and under the provisions of
the Collier County Growth Management Plan; and
WHEREAS, the Board of County Commissioners has reviewed the CPUD extension
request submitted by Robert L. Duane, AICP, of Hole Montes, Inc., on behalf of Livingston
Professional Center, LLC, Petition No. PUDEX-2007-AR-12l49, and has determined to extend
the current CPUD Zoning to November 16, 2009.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The above recitals are adopted herein by reference as if fully set forth herein.
2. This Resolution shall constitute evidence of compliance with the review
requirements of Section 10.02.13.0. of the LDC.
3. Pursuant to Section 10.02.13.0. of the LDC, the current CPUD approval is hereby
extended to November 16,2009.
4. This Resolution shall become effective immediately upon its approval.
BE IT FURTHER RESOLVED that this Resolution be recorded in the minutes of this
Board and in the records of the Petition for which the extension is granted.
