DISCLAIM, RENOUNCE AND VACATE THE COUNTY

PUBLIC ROAD RIGHT-OF-WAY EASEMENTS, AS

APPROXIMATELY 1050 FEET EAST OF LOGAN
BOULEVARD AND LYING SOUTH OF IMMOKALEE
ROAD (CR-846) IN SECTION 28, TOWNSHIP 48 SOUTH,
RANGE 26 EAST, COLLIER COUNTY, FLORIDA.

WHEREAS, pursuant to Resolution 2021-243. Petitioner, Michael J. Delate, P.E., of Q.
Grady Minor& Associates, P.A., on behalf of the property owner, has requested the vacation of
the County and the Public interest in three 30-foot-wide public road right-of-way easements, as
described in Official Record Book 70, Page 504, Official Record Book 90, Page 487, Official
Record Book 111, Page 129, and Official Record Book 172, Page 596, of the Public Records of
Collier County, located in Section 28, Township 48 South, Range 26 East, Collier County,
Florida. being more specifically shown in Exhibit "A", attached hereto and by reference
incorporated herein; and
WHEREAS, at its March 26, 2024, regular meeting. the Board of Commissioners, via
Resolution No. 2024- 43 , approved the scheduling of a public hearing on April 9, 2024,
pursuant to Resolution 2021-243: and
WHEREAS, the Board of County Commissioners, on this day. held a public hearing to
consider the petitioner's request and notice of said public hearing was given as required by law:
and
WHEREAS,the granting of the petitioner's request will not affect the ownership or right
of convenient access of property owners nor invade or violate individual property rights.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA. that the County and public
interest in four 30-foot-wide public road right-of-way easements, as described in Official Record
Book 70, Page 504, Official Record Book 90. Page 487, Official Record Book 111, Page 129
and Official Record Book 172, Page 596, of the Public Records of Collier County. located in
Section 28, Township 48 South. Range 26 East, Collier County, Florida, being more specifically
shown in Exhibit "A", attached hereto, is hereby vacated, extinguished, renounced and
disclaimed, and this action is declared to be in the public interest and for the public benefit.

BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby
directed to record a certified copy of the Resolution in the Public Records of Collier County,
Florida.
