RESOLUTION NO. 2007.~
A RESOLUTION TO APPROVE THE ISSUANCE OF A PERMIT BY THE
DIRECTOR OF THE COLLIER COUNTY PARKS AND RECREATION
DEPARTMENT TO ALLOW THE SALE OF ALCOHOLIC BEVERAGES
AT CLAM PASS BEACH PARK.
WHEREAS, On October 23, 2007, the Board of County Commissioners of Collier County,
Florida adopted Ordinance No. 2007-66, amending Ordinance No. 76-48, as amended, also known
as Chapter 98, Article III, Section 98-58; and,
WHEREAS, Ordinance No. 2007-66 allows an exception to the prohibition against the
carrying, possession or drinking of any alcoholic beverage in any public park; and,
WHEREAS, on October 23, 2007, the Board of County Commissioners approved a Lease
Agreement with LeHill Partners LLC d/b/a Naples Grande Resort and Club to provide food,
beverage, beach equipment rentals and water recreational rentals at Clam Pass Beach Park; and,
WHEREAS, the aforesaid Lease Agreement allows for the sale of alcoholic beverages by
the Lessee in a limited area of Clam Pass Beach Park.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that;
The Director of Parks and Recreation is authorized to issue a permit to LeHill Partners LLC
(Naples Grande Resort & Club) for the sale of alcoholic beverages at Clam Pass Beach Park in
those designated locations described in a certain Lease dated October 23, 2007 between the Board
of County Commissioners and LeHill Partners LLC and in accordance with Article 4(D)(l) and (2)
of said Lease.
This Resolution adopted after motion, second and majority vote favoring same this 23'd day
of October, 2007.
