Ordinance 2023-40 ORDINANCE NO. 2023 - 40 AN ORDINANCE AMENDING ORDINANCE NO. 93-76, AS AMENDED, CREATING THE COLLIER COUNTY DEVELOPMENT SERVICES ADVISORY COMMITTEE, BY AMENDING SECTION TWO, APPOINTMENT AND COMPOSITION, TO ADD A NON-VOTING MEMBER FROM THE AFFORDABLE HOUSING ADVISORY COMMITTEE; PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND ORDINANCES; PROVIDING FOR CONFLICT AND SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Collier County ("Board") seeks to allow a member of the Affordable Housing Advisory Committee to be appointed as a non-voting member of the Development Services Advisory Committee to better facilitate dialogue amongst the development community and advocates for affordable housing to address the affordable housing crisis in Collier County and improve cross-communication between the committees; and WHEREAS, the Development Services Advisory Committee was established by Ordinance No. 93-76 and amended by Ordinance No. 95-60. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: Amending Section Two of Ordinance No. 93-76, as amended, Appointment and Composition [of the Development Services Advisory Committee]. (a) The development services advisory committee shall be composed of 4-5- 16 members. (b) Members shall represent the various aspects of the development industry with one or more members from each of the following classifications: architect, general contractor, residential or builder contractor, environmentalist, land planner, land developer, landscape architect, professional engineer, utility contractor, plumbing contractor, electrical contractor, structural engineer, a non-voting member of the Affordable Housing Advisory Committee, and attorney. In the event that members cannot be secured filling all the classifications listed above, other individuals may be considered. The provisions of this Ordinance shall become and be made a part of the Code of Ordinances of Collier County, Florida. The sections of this Ordinance may be renumbered or relettered to accomplish such, and that the word "ordinance" maybe changed to "section," "article," or other appropriate word or phrase necessary to accomplish such intentions. SECTION THREE: Conflict and Severability. In the event this Ordinance conflicts with any other Ordinance of Collier County or other applicable law, the more restrictive shall apply. If any court of competent jurisdiction holds any phrase or portion of this Ordinance invalid or unconstitutional, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FOUR: Effective Date. This Ordinance shall become effective upon filing with the Department of State.
