Backup Documents 03/01/2021 PUD doc Revised One Naples [19-CPS-01951/1594735/1] 313 One Naples / PL20190000697 2/5/21 Page 1 of 2 ORDINANCE NO. 2021-_____ AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA AMENDING ORDINANCE NUMBER 2004-41, AS AMENDED, THE COLLIER COUNTY LAND DEVELOPMENT CODE, WHICH ESTABLISHED THE COMPREHENSIVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA OF COLLIER COUNTY, FLORIDA, BY AMENDING THE APPROPRIATE ZONING ATLAS MAP OR MAPS BY CHANGING THE ZONING CLASSIFICATION OF THE HEREIN DESCRIBED REAL PROPERTY FROM A COMMERCIAL INTERMEDIATE DISTRICT (C-3) ZONING DISTRICT TO A MIXED USE PLANNED UNIT DEVELOPMENT (MPUD) ZONING DISTRICT FOR THE PROJECT TO BE KNOWN AS ONE NAPLES MPUD, TO ALLOW CONSTRUCTION OF UP TO 172 MULTI-FAMILY DWELLING UNITS, BUT NO LESS THAN 40 RESIDENTIAL UNITS, UP TO 186 FEET IN ACTUAL HEIGHT INCLUDING A PARKING DECK, AND 10,000 SQUARE FEET OF C-3, COMMERCIAL INTERMEDIATE COMMERCIAL USES, AND A MARINA AND A SHIP STORE. THE SUBJECT PROPERTY IS LOCATED AT THE NORTHEAST CORNER OF THE INTERSECTION OF GULF SHORE DRIVE AND VANDERBILT BEACH ROAD IN SECTION 32, TOWNSHIP 48 SOUTH, RANGE 25 EAST, CONSISTING OF 5.42± ACRES; PROVIDING FOR REPEAL OF RESOLUTION RELATING TO P.U. 77-7-C FOR PROVISIONAL USE; AND BY PROVIDING AN EFFECTIVE DATE. [PL20190000697] WHEREAS, Vanderbilt Holdings, LLC, represented by Robert J. Mulhere, FAICP of Hole Montes, Inc. and Richard D. Yovanovich, Esq. of Coleman, Yovanovich & Koester, P.A., petitioned the Board of County Commissioners to change the zoning classification of the herein described real property. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: The zoning classification of the herein described real property located in Section 32, Township 48 South, Range 25 East, Collier County, Florida, is changed from a Commercial [19-CPS-01951/1594735/1] 313 One Naples / PL20190000697 2/5/21 Page 2 of 2 Intermediate (C-3) Zoning District to a Mixed Use Planned Unit Development (MPUD) Zoning District for a 5.42+/- acre parcel to be known as One Naples MPUD, in accordance with Exhibits A through G attached hereto and incorporated by reference herein. The appropriate zoning atlas map or maps, as described in Ordinance Number 2004-41, as amended, the Collier County Land Development Code, is/are hereby amended accordingly. SECTION TWO: Resolution Relating to Petition No. P.U. 77-7-C for Provisional Use dated May 31, 1977 is hereby repealed. SECTION THREE: This Ordinance shall become effective upon filing with the Department of State and on the date that the Growth Management Plan Amendment in Ordinance No. 21 -____ becomes effective.
