Ordinance 2022-49 ORDINANCE NO. 2022 - 49 AN ORDINANCE AMENDING ORDINANCE NO. 86-72 THE SABAL PALM ROAD EXTENSION MUNICIPAL SERVICE TAXING AND BENEFIT UNIT, BY AMENDING SECTION 1: CREATION, BOUNDARIES AND PURPOSES TO MODIFY THE BOUNDARIES OF THE DISTRICT TO REMOVE THOSE PROPERTIES NO LONGER BENEFITTING FROM THIS MSTU-BU; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 28, 1986. the Board of County Commissioners approved Ordinance No. 86-72, establishing the Sabal Palm Road Extension Municipal Service Taxing and Benefit Unit(the "MSTU-BU"): and WHEREAS, the Board of County Commissioners approved Ordinance No. 2001-51, amending the District purpose to provide for on-going maintenance activities of Sabal Palm Road Extension; and WHEREAS,the development along Sabal Palm Road Extension has changed over time whereby some property access is no longer required via Sabal Palm Road Extension warranting a modification of the geographical boundaries of the MSTU-BU to remove those property owners that no longer have access to nor otherwise derive any benefit from the MSTU-BU's stated purpose. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: SECTION 1: AMENDMENT TO SECTION ONE OF ORDINANCE NO 86-72. Section 1: Creation, Boundaries, Purposes. The Sabal Palm Road Extension Municipal Service Taxing and Benefit Unit(the"Unit")is hereby created, with boundaries described as follows ALL LANDS IN SECTIONS 24-LESS THE NW 1/4,25, AND 36 OF TOWNSHIP 50 SOUTH RANGE 26 EAST, COLLIER COUNTY, FLORIDA. and ALL LANDS IN SECTIONS 15, 16, 17, 18, 19, 20, 21, 22, 23, 26, 27, 28, 29, 30, 31, 32, 33, 34, AND 35 TOWNSHIP 50 SOUTH, RANGE 27 EAST, COLLIER COUNTY FLORIDA Underlined words are added; Struck Through words are deleted. • O 4 G The unit hereby created and established is for the purpose of providing a preliminary engineering study for the design, construction. and financing of roadway improvements within the Unit and to provide for maintenance of the existing Sabal Palm Road Extension and to do all things reasonably necessary in connection therewith and for the purpose of exercising those powers authorized by Florida Statues, Chapter 125, and other applicable laws. SECTION TWO: INCLUSION IN THE CODE OF LAWS AND ORDINANCES. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinance of Collier County, Florida. The sections of the Ordinances may be renumbered or re- lettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION TREE: CONFLICT AND SEVERABILITY. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FOUR: EFFECTIVE DATE This Ordinance shall become effective upon filing with the Florida Department of State.
