Ordinance 2022-47 ORDINANCE NO. 22 - 47 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA AMENDING ORDINANCE NO. 2001-61, AS AMENDED, THE MEDITERRA PLANNED UNIT DEVELOPMENT TO ALLOW DEVELOPMENT OF UP TO 120,000 SQUARE FEET OF PERMITTED USES IN THE VILLAGE CENTER INSTEAD OF UP TO 60,000 SQUARE FEET OF NON-COMMERCIAL USES AND 20,000 SQUARE FEET OF COMMERCIAL USES; AND PROVIDING AN EFFECTIVE DATE. THE SUBJECT PROPERTY, CONSISTING OF 25.8+/- ACRES OF THE 1167.8± ACRE PUD, IS LOCATED ON THE WEST AND EAST SIDES OF LIVINGSTON ROAD, APPROXIMATELY ONE MILE WEST OF I-75 IN SECTIONS 11 AND 12, TOWNSHIP 48 SOUTH, RANGE 25 EAST, COLLIER COUNTY, FLORIDA. [PL202100013681 WHEREAS, on November 13, 2001, the Board of County Commissioners approved Ordinance No. 2001-61, which established the Mediterra Planned Unit Development (PUD); and WHEREAS, the PUD was amended by Collier County Planning Commission Resolution No. 04-11 and administrative minor master plan change in PL20210000159; and WHEREAS, Margaret Emblidge, AICP of Agnoli, Barber & Brundage, Inc. representing The New Club at Mediterra, Inc., petitioned the Board of County Commissioners of Collier County, Florida, to amend Ordinance 2001-61, the Mediterra PUD, as amended. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: SECTION ONE: Amendment to Section 4.2, Maximum Square Footage, of the Planned Unit Development Document, attached to Ordinance No. 01-61, as amended, Mediterra PUD. Section 4.2, Maximum Square Footage, attached to Ordinance No. 01-61, as amended, is hereby amended to read as follows: 4.2 MAXIMUM SQUARE FOOTAGE 57 Mediterra/PL20210001368 Page 1 of 2 Text added is underlined text deleted is atw6iE- 10/4/22 A maximum floor area of 120,000 square feet of 60,000 square feet floor area of non uses as listed below, and 20,000 square feet floor area of commercial uses as listed below, may be constructed on lands designated "Village Center." SECTION TWO: Addition of Section 7.8, Miscellaneous to the Planned Unit Development Document, attached to Ordinance No. 01-61, as amended, Mediterra PUD. Section 7.8, Miscellaneous, is hereby added to the PUD document attached to Ordinance No. 01-61, as follows: 7.8 MISCELLANEOUS "Pursuant to Section 125.022(5) F.S., issuance of a development permit by a county does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the county for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. All other applicable state or federal permits must be obtained before commencement of the development." SECTION THREE: Effective Date. This Ordinance shall become effective upon filing with the Department of State.
