Resolution 1995-476 . .- "_lkII l\ur; 2 2 1995 RESOLUTION NO. 95.- 476 RESOLUTION CREATING THE NAPLES PARK AREA DRAINAGE IMPROVEMENTS MlJNICIP~.L SERVICE BENEFIT UNIT; DESCRIBING THE ~REA INCLUDED WITHIN THE UNIT; PROVIDING TllAT THE NATURE OF TllE PROPOSED PROJECT IS TllE DESIGN AND CONSTRUCTION OF STORMWA~rER DRAINAGE IMPROVEMENTS FOR THE DrrCH ENCLOSURES IN TllE VICINITY OF 91ST/92ND AVENUE ~.ND 8TH STREET ~ND PROVIDING THAT THE COSTS OF THE IMPROVEMENTS SHALL BE P~ID FROM SPECIAL ~SSESBMENTS AGAINST THE BENEFITED PROPERTIES WITHIN THE UNIT 1\.8 A NON-AD VALOREM 1\BSESSMENT. WHEREAS, the Board of County Commissioners on May 16, 1995 conceptually approved the design and co~struction of stormwater drainage improvements for the ditch E~nc]osurcs in the vicinity of 91stj92nd Avenue North and 8th street within the Naples Park Area; and WHEREAS, the Board of County Commissioners approved this project to be funded by special assessments against the benefited properties within the Unit based on a per acre assessm~nt method; and ~';HEREAS, the Board authorized the County Staff to do all thinqs necessary to have this project: completed as soon as possible; and WHEREAS, the Board has determinEld and found that the creation of the Naples Park Area Drainage Improvements Municipnl Service Benefit Unit is needed for health, silfety and to enhance the general area. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLOHID1" that: SECTION ONE. This Resolution is adc~lted pursuant to the provisions of Collier County Ordinance He. 86-r/, as amendad by Ordinance No. 95-44, and other applicable provisions of law. SECTION TWO. It is hereby found and determined as follows: A. The municipal service benefit unit created shall be officially known as the Naples Park Jlrea Drainage Improvements Municipal Service Benefit Unit (herej.naftcr referred to as 1 !OO~ noD p,r[ 29 AUG 2 2 1995 "Unit") . r B. It 1s necessary for the continued preservation of the health, welfare, convenience and safety of the citizens and inhabitants of the Naples Park Area to provide for the construction of the stormwater drainage improvements in the vicinity of 91stj92nd Avenue North and 8th street (the "Project") described in Exhibit "A" attached hereto and incorporated herein. SECTION THllf'.&..t. The Naples Park Area Drainage Improvements Municipal Service Benefit Unit shall ~Omf)rise all those lands located in Collier County, Florida, as d(~picited on Exhibit I'B" attached hureto and being more particularly described as follows: All those certain lands lying within portions of Sections 28 and 3:1, Township 48 South, Range 25 East, Collier County, Floridn, and being further describnd as follows, ~ll of: Unit NO.1, Naples Park as rl=corded in Plat Book 1, Page 106, and; Suhdivision of Block 1, Unit No.1, Naples Park, as recorded in Plat Book 4, Page 5, and; Replat of Blocks 4 and 5, Unit NO.1, Naples Park, recorded in Plat Book 4, Page 6, and; Unit No.2, Naples Park as recorded in Plat Book 2, Page 107, and; Unit NO.3, Naples Park as recorded in Plat Book 3, Page 5, and; Unit No. 4, Naples Park as rE~corc1ed in Plat Book J, Page 7, and; Unit No. 5, Naples Park as r€~corc1ed in Plat Book J, Page 14, and; Unit No. 6, Naples Park as recorded in Plat Book J, Page 15, and; Coventry Square as recorded in Plat Book 23, Pages 65-66; together with all those certain lands lying within Section 33, Township 48 South, Range 25 East, being bounded on the: North by the South right-of-way line of 9lst Avenue; South by the North right-at-way line of Vanderbilt Beach Roact; East by the West right-Of-way line of U.S. 41, N. Tarniarni Trail; and 2 lOOK 000 Plr,[ 30 AUG 2 2 1995 West by the East right-of-way fine of Vanderbilt Drive. SECTION FOORL All objections, if any, to the adoption of this Resolution creating the Naples Parks Area Drainage Improvements Municipal Service Benefit Unit shall be made in writing and filed with the Clerk at or before the time or adjourned time of the public hearing. The adoption of this ResCllution shall be the final adjudication ot the issues presented thereby unless proper steps shall be initiated in a court of competent jurisdiction to secure relisf within twenty (20) days from the date of the Board action of this Resolution. SECTION FIV~. The Clerk is hereby ordered and directed to spread this Resolution in full among the minutes of this meeting for permanent record in his Office.
