WHEREAS, there are currently pending in the Circuit
Court for Collier County, Florida two lawsuits concerning
, double taxation, one filed by an individual representing the
taxpayers of the City of Naples, and the other filed by the City 0
of Naples pursuant to Chapter 125, Florida Statutes, and
WHEREAS, in an effort to resolve the differences between the City and the County over this matter the County has engaged the
services of Frank Spence & Associates, Inc. , local government
•
consultants, to recommend various means by which these differences
` i might be resolved, and
•
WHEREAS, the Board has received the report of Frank Spence &
• I Associates, Inc. dated August 5, 1980 and has carefully considered . •
the name,
NOW THEREFORE BE IT RESOLVED by the Board of County Commis-
. sioners of Collier County, Florida that:
1. The Board hereby declares its intention to resolve the
double tax dispute with the City and taxpayers on the basis of
the recommendations of Frank Spence & Associates Report dated
August 5, 1980 by establishing municipal service taxing units in •
• the unincorporated as described therein, including the funding of
• the road and bridge municipal service taxing unit in accordance
•
with alternate #2 as described.
2. In order to effectuate this settlement the Board shall ?• consider the adoption of the necessary ordinances and budgets but this shall not be construed as a pre-commitment by the Board to
• adopt said ordinances or budgets.
3. This settlement is also conditioned on the dismissal of'those actions currently pending concerning double taxation by
appropriate pleadings as the respective counsel may agree upon and this Board may approve.
