RESOLUTION NO. 91 -434
RESOLUTION AUTHORIZING PHEI,IMINARY ACCEPTANCE OF THESE
ROADWAY, DRAINAGE, WATER & SEWER IMPROVEHENTS IN
EVENINGSTAR CAY AT PORT OF THE ISLANDS AND ACCEPTING THE
CERTIFICATE OF DEPOSIT AND CORPORATE BOND FROM THE
DEVELOPER FOR MAINTENANCE OF' THE ROADWAY, DRAINAGE, WATER
& SEWER IMPROVEMENTS FOR 1\ IUNIMUM OF ONE YEAR.
WHEREAS, the Board of County Commis6ioners of Collier county,
Florida, on April 10, 1990, approved the plat of Eveningstar Cay
at Port of the Islands for recording; and
WHEREAS, the developer han constructed the roadway, drainage,
water & sewer improvemente in accordance with the approved plans
and specifications and as required by the Subdivision Regulations
(Collier County Ordinance Ho. 76-06, as amended); and the
Utilities standards and Procedures Ordinance (Collier County
Ordinance No. 88-76, as amended), and
WHEREAS, the developer
acceptance of the roadway and

has now requested preliminary
other improvements and release ot
an acceptable maintenance security
WHEREAS, the Compliance services Section of the Development
services Department has inspected the roadway and other
improvements and is recommend:lng preliminary acceptance of said
facilities;
NOW, THEREFORE, BE IT RESOLVEI' BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that preliminary
acceptance be granted for these roadway and other improvements in
Eveningstar Cay at Port of the Islands.
BE IT FURTHER RESOLVED AND ORDERED that the County accept the
maintenance security in the form of a Certificate of Deposit, and a
Corporate Bond in the amount of $15,100.00 and that the developer
is responsible for the maintenance of the roadway and other
improvements for a minimum period of one year as required by the
subdivision Regulations (Ordinance No. 76-06, as amended) at which
time the developer must petition the Bo'rd for final acceptance.
This Resolution adopted
