Ordinance 2022-01 ORDINANCE NO. 2022 - 01 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AMENDING ORDINANCE NO. 93-81, AS AMENDED, THE PARKS AND RECREATION ADVISORY BOARD ORDINANCE, BY ADDING AN ALTERNATE MEMBER TO THE BOARD; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Collier County Ordinance No. 93-81, as amended by Ordinance 99-24, established the Parks and Recreation Advisory Board, which is composed of seven (7) members; and WHEREAS, the Board of County Commissioners wishes to increase the membership of the Advisory Board by creating an alternate member. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,FLORIDA,that: SECTION ONE: Amendment to Paragraph A of Section Two of Ordinance 93-81, as amended Paragraph A of Section Two of Ordinance 93-81 is hereby amended to read as follows: SECTION TWO. Appointment and composition. "A. The parks and recreation advisory board shall be composed of seven eight members consisting of one member from the Immokalee Community Park District, six members from the Naples and Urban Area Community Park District, and one at-large alternate member. SECTION TWO: Amendment to Paragraph B of Section Five of Ordinance 93-81 SECTION FIVE. Officers; quorum; rules of procedure. (a) Annually the membership of the parks and recreation advisory board shall elect a chairman and vice-chairman from among the members. Page 1 of 2 (b) The presence of four or more members shall constitute a quorum of the board necessary to take action and transact business. In addition, an affirmative vote of three or more members shall be necessary in order to take official action, regardless of whether four or more members of the board are present at the meeting. The alternate member shall vote only in the absence, disqualification or abstention of a regular Committee member. SECTION THREE: CONFLICT AND SEVERABILITY. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FOUR: INCLUSION IN THE CODE OF LAWS AND ORDINANCES. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinances may be renumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION FIVE: EFFECTIVE DATE. This Ordinance shall become effective upon filing with the Secretary of State. ADOPTED upon majority vote this I I ilt day of j )1,iu la,r_ , 2022.
