' day ofakte 20 21 , by and between L. J. Power, Inc. authorized to do business in the State of Florida, whose business address is 1181 Sawgrass Corp Pkwy, Sunrise, FL 33323 , (the "Contractor") and Collier County, a political subdivision of the State of Florida, (the "County"): WITNESSETH: 1. AGREEMENT TERM. Nothing herein contained shall create or be construed as creating a partnership between the County and the Contractor or to constitute the Contractor as an agent of the County. 8. PERMITS: LICENSES: TAXES. In compliance with Section 218.80, F.S., all permits necessary for the prosecution of the Work shall be obtained by the Contractor. The County will not be obligated to pay for any permits obtained by Subcontractors. Payment for all such permits issued by the County shall be processed internally by the County. All non-County permits necessary for the prosecution of the Work shall be procured and paid for by the Contractor. The Contractor shall also be solely responsible for payment of any and all taxes levied on the Contractor. In addition, the Contractor shall comply with all rules, regulations and laws of Collier County, the State of Florida, or the U. S. Government now in force or hereafter adopted. The Contractor agrees to comply with all laws governing the responsibility of an employer with respect to persons employed by the Contractor. 9. NO IMPROPER USE. The Contractor will not use, nor suffer or permit any person to use in any manner whatsoever, County facilities for any improper, immoral or offensive purpose, or for any purpose in violation of any federal, state, county or municipal ordinance, rule, order or regulation, or of any governmental rule or regulation now in effect or hereafter enacted or adopted. In the event of such violation by the Contractor or if the County or its authorized representative shall deem any conduct on the part of the Contractor to be objectionable or improper, the County shall have the right to suspend the Agreement of the Contractor. Should the Contractor fail to correct any such violation, conduct, or practice to the satisfaction of the County within twenty-four (24) hours after receiving notice of such violation, conduct, or practice, such suspension to continue until the violation is cured. The Contractor further agrees not to commence operation during Page 4 of 17 Fixed Term Service Agreement 2021_Ver.I 11A the suspension period until the violation has been corrected to the satisfaction of the County. 10. TERMINATION. Should the Contractor be found to have failed to perform his services in a manner satisfactory to the County as per this Agreement, the County may terminate said Agreement for cause; further the County may terminate this Agreement for convenience with a thirty (30) day written notice. The County shall be sole judge of the non-performance. In the event that the County terminates this Agreement, Contractor's recovery against the County shall be limited to that portion of the Agreement Amount earned through the date of termination. The Contractor shall not be entitled to any other or further recovery against the County, including, but not limited to, any damages or any anticipated profit on portions of the services not performed. 11. NO DISCRIMINATION. The Contractor agrees that there shall be no discrimination as to race, sex, color, creed or national origin. 12. INSURANCE. The Contractor shall provide insurance as follows: A. n Commercial General Liability: Coverage shall have minimum limits of $ 1,000,000 Per Occurrence, $2,000,000 aggregate for Bodily Injury Liability and Property Damage Liability. This shall include Premises and Operations; Independent Contractors; Products and Completed Operations and Contractual Liability. B. I■I Business Auto Liability: Coverage shall have minimum limits of $ 1,000,000 Per Occurrence, Combined Single Limit for Bodily Injury Liability and Property Damage Liability. This shall include: Owned Vehicles, Hired and Non-Owned Vehicles and Employee Non-Ownership. C. n Workers' Compensation: Insurance covering all employees meeting Statutory Limits in compliance with the applicable state and federal laws. The coverage must include Employers' Liability with a minimum limit of $ 1,000,000 for each accident. fl • &n - per claim.- ve Bats of$ poi- Page 5 of 17 Fixed Term Service Agreement 2021_Ver.1 11 Special Requirements: Collier County Board of County Commissioners, OR, Board of County Commissioners in Collier County, OR, Collier County Government shall be listed as the Certificate Holder and included as an "Additional Insured" on the Insurance Certificate for Commercial General Liability where required. This insurance shall be primary and non-contributory with respect to any other insurance maintained by, or available for the benefit of, the Additional Insured and the Contractor's policy shall be endorsed accordingly. Current, valid insurance policies meeting the requirement herein identified shall be maintained by Contractor during the duration of this Agreement. The Contractor shall provide County with certificates of insurance meeting the required insurance provisions. Renewal certificates shall be sent to the County thirty (30) days prior to any expiration date. Coverage afforded under the policies will not be canceled or allowed to expire until the greater of: thirty (30) days prior written notice, or in accordance with policy provisions. Contractor shall also notify County, in a like manner, within twenty-four (24) hours after receipt, of any notices of expiration, cancellation, non-renewal or material change in coverage or limits received by Contractor from its insurer, and nothing contained herein shall relieve Contractor of this requirement to provide notice. Contractor shall ensure that all subcontractors comply with the same insurance requirements that the Contractor is required to meet. 13. INDEMNIFICATION. To the maximum extent permitted by Florida law, the Contractor shall defend, indemnify and hold harmless Collier County, its officers and employees from any and all liabilities, damages, losses and costs, including, but not limited to, reasonable attorneys' fees and paralegals' fees, whether resulting from any claimed breach of this Agreement by Contractor, any statutory or regulatory violations, or from personal injury, property damage, direct or consequential damages, or economic loss, to the extent caused by the negligence, recklessness, or intentionally wrongful conduct of the Contractor or anyone employed or utilized by the Contractor in the performance of this Agreement. This indemnification obligation shall not be construed to negate, abridge or reduce any other rights or remedies which otherwise may be available to an indemnified party or person described in this paragraph. This section does not pertain to any incident arising from the sole negligence of Collier County. 13.1 The duty to defend under this Article 13 is independent and separate from the duty to indemnify, and the duty to defend exists regardless of any ultimate liability of the Contractor, County and any indemnified party. The duty to defend arises immediately upon presentation of a claim by any party and written notice of such claim being provided to Contractor. Contractor's obligation to indemnify and defend under this Article 13 will survive the expiration or earlier termination of this Agreement until it is determined by final judgment that an action against the County or an indemnified party for the matter indemnified hereunder is fully and finally barred by the applicable statute of limitations. This Agreement shall be administered on behalf of the County by the Capital Project Planning, Impact Fee and Program Management . 15. CONFLICT OF INTEREST. Contractor represents that it presently has no interest and shall acquire no interest, either direct or indirect, which would conflict in any manner with the performance of services required hereunder. Contractor further represents that no persons having any such interest shall be employed to perform those services. 16. COMPONENT PARTS OF THIS AGREEMENT. This Agreement consists of the following component parts, all of which are as fully a part of the Agreement as if herein set out verbatim: Contractor's Proposal, Insurance Certificate(s), ■ Exhibit A Scope of Services, Exhibit B Fee Schedule, RFP/ • ITB/1 I Other #21-7886 , including Exhibits, Attachments and Addenda/Addendum, n subseefuent quotes, and 1.1 Other Exhibit/Attachment: Federal Contract Provisions and Certifications. 17. APPLICABILITY. Sections corresponding to any checked box ( ■ ) expressly apply to the terms of this Agreement. 18. SUBJECT TO APPROPRIATION. It is further understood and agreed by and between the parties herein that this Agreement is subject to appropriation by the Board of County Commissioners. 19. PROHIBITION OF GIFTS TO COUNTY EMPLOYEES. No organization or individual shall offer or give, either directly or indirectly, any favor, gift, loan, fee, service or other item of value to any County employee, as set forth in Chapter 112, Part III, Florida Statutes, Collier County Ethics Ordinance No. 2004-05, as amended, and County Administrative Procedure 5311. Violation of this provision may result in one or more of the following consequences: a. Prohibition by the individual, firm, and/or any employee of the firm from contact with County staff for a specified period of time; b. Prohibition by the individual and/or firm from doing business with the County for a specified period of time, including but not limited to: submitting bids, RFP, and/or quotes; and, c. immediate termination of any Agreement held by the individual and/or firm for cause. 20. COMPLIANCE WITH LAWS. By executing and entering into this Agreement, the Contractor is formally acknowledging without exception or stipulation that it agrees to comply, at its own expense, with all federal, state and local laws, codes, statutes, ordinances, rules, regulations and requirements applicable to this Agreement, including but not limited to those dealing with the Immigration Reform and Control Act of 1986 as located at 8 U.S.C. 1324, et seq. and regulations relating thereto, as either may be amended; taxation, workers' compensation, equal employment and safety including, but not limited to, the Trench Safety Act, Chapter 553, Florida Statutes, and the Florida Public Records Law Chapter 119, if applicable, including specifically those contractual requirements at F.S. § 119.0701(2)(a)-(b) as stated as follows: Page 7 of 17 Fixed Term Service Agreement 2021_Ver.1 1 1 A IF THE CONTRACTOR HAS QUESTIONS REGARDING THE APPLICATION OF CHAPTER 119, FLORIDA STATUTES, TO THE CONTRACTOR'S DUTY TO PROVIDE PUBLIC RECORDS RELATING TO THIS CONTRACT, CONTACT THE CUSTODIAN OF PUBLIC RECORDS AT: Division of Communications, Governement & Public Affairs 3299 Tamiami Trail East, Suite 102 Naples, FL 34112-5746 Telephone: (239) 252-8999 Email: PublicRecordRequest(c colliercount fl.qov The Contractor must specifically comply with the Florida Public Records Law to: 1. Keep and maintain public records required by the public agency to perform the service. 2. Upon request from the public agency's custodian of public records, provide the public agency with a copy of the requested records or allow the records to be inspected or copied within a reasonable time at a cost that does not exceed the cost provided in this chapter or as otherwise provided by law. 3. Ensure that public records that are exempt or confidential and exempt from public records disclosure requirements are not disclosed except as authorized by law for the duration of the contract term and following completion of the contract if the Contractor does not transfer the records to the public agency. 4. Upon completion of the contract, transfer, at no cost, to the public agency all public records in possession of the Contractor or keep and maintain public records required by the public agency to perform the service. If the Contractor transfers all public records to the public agency upon completion of the contract, the Contractor shall destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. If the Contractor keeps and maintains public records upon completion of the contract, the Contractor shall meet all applicable requirements for retaining public records. All records stored electronically must be provided to the public agency, upon request from the public agency's custodian of public records, in a format that is compatible with the information technology systems of the public agency. If Contractor observes that the Contract Documents are at variance therewith, it shall promptly notify the County in writing. Failure by the Contractor to comply with the laws referenced herein shall constitute a breach of this Agreement and the County shall have the discretion to unilaterally terminate this Agreement immediately. 21. OFFER EXTENDED TO OTHER GOVERNMENTAL ENTITIES. Collier County encourages and agrees to the successful Contractor extending the pricing, terms and conditions of this solicitation or resultant Agreement to other governmental entities at the discretion of the successful Contractor. Page 8 of 17 Fixed Term Service Agreement 2021_Ver.1 1 22. PAYMENTS WITHHELD. The County may decline to approve any application for payment, or portions thereof, because of defective or incomplete work, subsequently discovered evidence or subsequent inspections. The County may nullify the whole or any part of any approval for payment previously issued and the County may withhold any payments otherwise due to Contractor under this Agreement or any other Agreement between the County and Contractor, to such extent as may be necessary in the County's opinion to protect it from loss because of: (a) defective Work not remedied; (b) third party claims failed or reasonable evidence indicating probable fling of such claims; (c) failure of Contractor to make payment properly to subcontractors or for labor, materials or equipment; (d) reasonable doubt that the Work can be completed for the unpaid balance of the Contract Amount; (e) reasonable indication that the Work will not be completed within the Contract Time; (f) unsatisfactory prosecution of the Work by the Contractor; or (g) any other material breach of the Contract Documents. If any conditions described above are not remedied or removed, the County may, after three (3) days written notice, rectify the same at Contractor's expense. The County also may offset against any sums due Contractor the amount of any liquidated or unliquidated obligations of Contractor to the County, whether relating to or arising out of this Agreement or any other Agreement between Contractor and the County. 23. n CLEAN UP. Contractor agrees to keep the Project site clean at all times of debris, rubbish and waste materials arising out of the Work. At the completion of the Work, Contractor shall remove all debris, rubbish and waste materials from and about the Project site, as well as all tools, appliances, construction equipment and machinery and surplus materials, and shall leave the Project site clean. 24. STANDARDS OF CONDUCT: PROJECT MANAGER, SUPERVISOR, EMPLOYEES. The Contractor shall employ people to work on County projects who are neat, clean, well-groomed and courteous. Subject to the American with Disabilities Act, Contractor shall supply competent employees who are physically capable of performing their employment duties. The County may require the Contractor to remove an employee it deems careless, incompetent, insubordinate or otherwise objectionable and whose continued employment on Collier County projects is not in the best interest of the County. 25. n WARRANTY. Contractor expressly warrants that the goods, materials and/or equipment covered by this Agreement will conform to the requirements as specified, and will be of satisfactory material and quality production, free from defects, and sufficient for the purpose intended. Goods shall be delivered free from any security interest or other lien, encumbrance or claim of any third party. Any services provided under this Agreement shall be provided in accordance with generally accepted professional standards for the particular service. These warranties shall survive inspection, acceptance, passage of title and payment by the County. Contractor further warrants to the County that all materials and equipment furnished under the Contract Documents shall be applied, installed, connected, erected, used, cleaned and conditioned in accordance with the instructions of the applicable manufacturers, Page 9 of 17 Fixed Term Service Agreement 2021_Ver.I CAO ' IA fabricators, suppliers or processors except as otherwise provided for in the Contract Documents. If, within one (1) year after final completion, any Work is found to be defective or not in conformance with the Contract Documents, Contractor shall correct it promptly after receipt of written notice from the County. Contractor shall also be responsible for and pay for replacement or repair of adjacent materials or Work which may be damaged as a result of such replacement or repair. These warranties are in addition to those implied warranties to which the County is entitled as a matter of law. 26. n , 27. A. Contractor shall fully protect the Work from loss or damage and shall b ar the cost of any such lose or damage until final payment has been made. SUBMITTALS AND SUBSTITUTIONS. Any substitution of products/materials from specifications shall be approved in writing by the County in advance. 29. CHANGES IN THE WORK. The County shall have the right at any time during the progress of the Work to increase or decrease the Work. Promptly after being notified of a change, Contractor shall submit an estimate of any cost or time increases or savings it foresees as a result of the change. Except in an emergency endangering life or property, or as expressly set forth herein, no addition or changes to the Work shall be made except upon modification of the Purchase Order by the County, and the County shall not be liable to the Contractor for any increased compensation without such modification. No officer, employee or agent of the County is authorized to direct any extra or changed work orally. Any modifications to this Agreement shall be in compliance with the County Procurement Ordinance and Procedures in effect at the time such modifications are authorized. If any portion of this Agreement is held to be void, invalid, or otherwise unenforceable, in whole or in part, the remaining portion of this Agreement shall remain in effect. 31. ADDITIONAL ITEMS/SERVICES. Additional items and/or services may be added to this Agreement in compliance with the Procurement Ordinance, as amended, and Procurement Procedures. 32. DISPUTE RESOLUTION. Prior to the initiation of any action or proceeding permitted by this Agreement to resolve disputes between the parties, the parties shall make a good faith effort to resolve any such disputes by negotiation. The negotiation shall be attended by representatives of Contractor with full decision-making authority and by County's staff person who would make the presentation of any settlement reached during negotiations to County for approval. Failing resolution, and prior to the commencement of depositions in any litigation between the parties arising out of this Agreement, the parties shall attempt to resolve the dispute through Mediation before an agreed-upon Circuit Court Mediator certified by the State of Florida. The mediation shall be attended by representatives of Contractor with full decision-making authority and by County's staff person who would make the presentation of any settlement reached at mediation to County's board for approval. Should either party fail to submit to mediation as required hereunder, the other party may obtain a court order requiring mediation under section 44.102, Fla. Stat. 33. VENUE. Any suit or action brought by either party to this Agreement against the other party relating to or arising out of this Agreement must be brought in the appropriate federal or state courts in Collier County, Florida, which courts have sole and exclusive jurisdiction on all such matters. 34. ❑ KEY PERSON . met: (1) Proposed replacements have substantially the same or better qualifications The Contractor shall make commercially reasonable efforts to notify Collier County within per-seRneb- E AGREEMENT STAFFING. The County reserves the right to perform investigations as may be deemed necessary to ensure that competent persons will be utilized in the performance of the Agreement. The Contractor shall assign as many people as necessary to complete required services on a timely basis, and each person assigned shall be available for an amount of time adequate to meet required services. In the event of any conflict between or among the terms of any of the Contract Documents and/or the County's Board approved Executive Summary, the terms of the Agreement shall take precedence over the terms of all other Contract Documents, except the terms of any Supplemental Conditions shall take precedence over the Agreement. To the extent any conflict in the terms of the Contract Documents cannot be resolved by application of the Supplemental Conditions, if any, or the Agreement, the conflict shall be resolved by imposing the more strict or costly obligation under the Contract Documents upon the Contractor at County's discretion. 36. ASSIGNMENT. Contractor shall not assign this Agreement or any part thereof, without the prior consent in writing of the County. Any attempt to assign or otherwise transfer this Agreement, or any part herein, without the County's consent, shall be void. If Contractor does, with approval, assign this Agreement or any part thereof, it shall require that its assignee be bound to it and to assume toward Contractor all of the obligations and responsibilities that Contractor has assumed toward the County. 37. SECURITY. The Contractor is required to comply with County Ordinance 2004-52, as amended. Background checks are valid for five (5) years and the Contractor shall be responsible for all associated costs. If required, Contractor shall be responsible for the costs of providing background checks by the Collier County Facilities Management Division for all employees that shall provide services to the County under this Agreement. This may include, but not be limited to, checking federal, state and local law enforcement records, including a state and FBI fingerprint check, credit reports, education, residence and employment verifications and other related records. Contractor shall be required to maintain records on each employee and make them available to the County for at least four(4) years. All of Contractor's employees and subcontractors must wear Collier County Government Identification badges at all times while performing services on County facilities and properties. Contractor ID badges are valid for one (1) year from the date of issuance and can be renewed each year at no cost to the Contractor during the time period in which their background check is valid, as discussed below. All technicians shall have on their shirts the name of the contractor's business. The Contractor shall immediately notify the Collier County Facilities Management Division via e-mail (DL-FMOPS@colliergov.net) whenever an employee assigned to Collier County separates from their employment. This notification is critical to ensure the continued security of Collier County facilities and systems. All Contractors and subcontractors performing service for Collier County are required and shall comply with all Occupational Safety and Health Administration (OSHA), State and County Safety and Occupational Health Standards and any other applicable rules and regulations. Also, all Contractors and subcontractors shall be responsible for the safety of their employees and any unsafe acts or conditions that may cause injury or damage to any persons or property within and around the work site. Collier County Government has authorized the Occupational Safety and Health Administration (OSHA) to enter any Collier County Facility, property and/or right-of-way for the purpose of inspection of any Contractor's work operations. This provision is non- negotiable by any division/department and/or Contractor. All applicable OSHA inspection criteria apply as well as all Contractor rights, with one exception. Contractors do not have the right to refuse to allow OSHA onto a project that is being performed on Collier County Property. Collier County, as the owner of the property where the project is taking place shall be the only entity allowed to refuse access to the project. However, this decision shall only be made by Collier County's Risk Management Division Safety Manager and/or Safety Engineer. BACKGROUND The purpose of this grant-funded project is to provide emergency auxiliary power to wastewater pump stations. During hurricane type conditions, when commercial power outage is likely, these generators will provide emergency power to 53 critical wastewater pump stations throughout the County.This system resiliency and redundancy would protect public health and the environment by minimizing the chances for spillages. DETAILED SCOPE OF WORK SPECIFICATIONS FOR DIESEL ENGINE-DRIVEN MOBILE GENERATOR SETS PART 1 --GENERAL 1.1 THE SUMMARY A. The SUPPLIER shall provide diesel engine-driven mobile electrical generating systems,complete and operable, for the fifty-three(53)lift stations listed in the Generator Load Step Table attached to these specifications. B. Engine-generator sets shall be delivered to Collier County Fleet Management at the following address: 2901 County Barn Road Naples,Florida 34112 C. The SUPPLIER shall deliver all generators within 365 days of the County's issuance of a valid Purchase Order (P.O.)and Notice to Proceed(NTP).The OWNER shall be responsible for transporting each engine generator set to the designated lift station for testing,and then to storage after acceptance. D. Minimum nominal standby rating of each engine-generator set shall be as indicated in the Generator Load Step Table. Each engine-generator set shall be capable of starting and running the assigned loads as detailed in the Generator Load Step Table and shall meet all additional requirements specified, herein. The SUPPLIER shall furnish the engine-generator sets with an oversized ac alternator or, if required, a unit with a higher nominal kW rating as required to meet the requirements of the specification. Accepted nominal standby ratings are 40kW, 60kW, 100kW and 150kW. All generators furnished with the same nominal rating shall be completely identical. 1.2 DEFINITIONS A. "OWNER"shall mean the Collier County Public Utilities Department of Collier County, Florida. B. "SUPPLIER"shall mean the vendor of the engine generator set. 1.3 REFERENCE SPECIFICATIONS,CODES,AND STANDARDS A. Materials shall conform with applicable requirements of the National Electrical Code (NEC), and any other State or Municipal codes which apply. The generator set shall fully comply with all current Environmental Protection Agency (EPA) emissions regulations including but not limited to,the New Source Performance Standards(NSPS)for stationary and non- road generator sets, the engine generator set must meet the EPA new source performance requirements set at the time of purchase. 1.4 SUPPLIER SUBMITTALS A. Shop Drawings, as further detailed below, and as submitted by the SUPPLIER, attached as Schedule 1 to this scope of services: 1. Current brochures for engine generator set,generator controller, ac alternator,and for the diesel engine,as downloadable from manufacturers' website. 2. Engine generator sizing calculations based on information provided in the Generator Load Step Table. 3. Detailed, dimensioned Shop Drawings and data demonstrating adherence to the requirements of these specifications. Include the manufacturer's certification that engine atmospheric emissions will comply with the limitations. B. Custom drawings/diagrams and additional documentation, as further detailed below,shall be submitted within 60 days of the issuance of a P.O. and NTP. The OWNER shall review the additional documentation within 14 days of receipt, and either approve or disapprove while providing reasons and documentation where appropriate.: 1. Certified custom drawings and custom wiring diagrams of each component in the system and a master wiring diagram showing the entire system on one sheet. This diagram shall include all AC and DC power control connections between the generator,engine,fuel tank system,batteries,and circuit breakers and shall be a custom drawing for this specific installation. A master drawing of the engine/generator set shall also be provided, showing general dimensions, bill of materials, location and size of all connections for fuel, cooling, exhaust, direct current connections, conduit locations, and connections for control and power wiring. Include wire and terminal numbers for all diagrams. Furnish KW output curves,fuel consumption curves,and certified air emission data sheets. 2. Outline drawings and connection diagrams shall be complete, and connection diagrams shall give both internal and external connections. 3. Wind load calculations for the engine generator set. 4. Startup testing plan. 5. Documentation from the manufacturer indicating the maximum recommended turbo boost pressure. 6. Certified factory test results shall be submitted for acceptance prior to shipment of equipment. 7. Complete and detailed instructions for the operation, lubrication, and maintenance of equipment in the system. The manuals shall be furnished after final approval of Shop and working drawings but prior to shipment of equipment. Manuals shall be complete with wiring diagrams, lubrication schedules and recommended lubricants,drawings,cuts,parts lists,and other necessary data. All parts shall be numbered or otherwise clearly identified to facilitate ordering of replacements. Descriptions of all operational control devices and their functions shall also be included. C. Certified startup-testing results,shall be submitted within 30 days of completion of field testing. D. Delivery Schedule: 1. Upon receipt of the Notice to Proceed,coordinate with OWNER as required to prepare a staggered delivery schedule. Schedule shall include dates and times for startup testing and training. 1.5 WARRANTY A. The SUPPLIER shall be responsible for all aspects of the engine-generator set including parts, service and warranty. B. In addition to the standard manufacturer warranty, SUPPLIER shall provide an extended warranty for each engine generator set beginning upon the completion of startup testing and final onsite adjustments,and expiring five(5)years from that date,or after the generator has reached 6,000 run hours,whichever is sooner. Warranty services shall include repair labor,travel expenses and all expendables used to complete repairs.Warranty shall cover all equipment included in the scope of supply.Warranty documentation shall be submitted by SUPPLIER to OWNER after issuance of the P.O. and NTP, and prior to shipment of equipment. PART 2 -- PRODUCTS THE FOLLOWING SPECIFICATIONS APPLY TO EACH GENERATOR SET: 2.1 SYSTEM COMPONENTS A. Provide one new diesel engine-driven mobile electric generator set, in an outdoor, weatherproof, non-walk-in sound attenuated enclosure. The engine generator set shall have the minimum nominal standby rating specified, shall be capable of supplying rated load at 0.8 power factor, a 60 Hertz nominal operating frequency, and an alternator with reconnectable leads as required for the output voltages specified. The equipment package shall include in general, and as applicable, engine and ac alternator on a common vibration isolating base, with auxiliaries, accessories, and controls, including intake filters, radiator discharge silencer, turbocharger, heat exchangers,foundation bolts, isolators,piping,flexible couplings,supports,complete exhaust piping,ring,and silencer, exhaust aftertreatment system, insulation, control panels, lubrication system, water jacket heaters, cooling system, sub-base fuel tank,mobile trailer, batteries and battery rack, battery charger, spare parts, and all materials necessary to permit installation,testing and placing the system in successful operation. B. Provide one main circuit breaker located in the generator enclosure. C. Provide one integral sub-base fuel storage tank with double wall steel construction. D. The generator-set, enclosure, base-mounted fuel tank, mobile trailer, and accessories shall be assembled and shipped to the OWNER as a complete, coordinated package, ready for operation. The engine generator base, cooling system,etc., shall be factory painted before installation in the enclosure. 2.2 SYSTEM OPERATION A. The system shall operate as follows: 1. A maintained remote contact closure shall cause the generator-set to start and run. b. When the remote startup contact opens, the engine shall continue to operate for an adjustable cool- down time(up to 30 minutes,minimum).After the cool down period has elapsed,the engine shall shut down. 2. Local Control: The generator-set shall be capable of manual starting and stopping from the locally mounted generator control panel. 3. Emergency Stop Control: An emergency stop pushbutton shall be provided at the generator control panel that shall cause the unit to stop without any delay. 2.3 ENGINE A. The SUPPLIER shall provide a complete diesel engine-driven standby electrical generating system of the type and capacity indicated. Engine to be manufactured by John Deere, Perkins, Doosan, Cummins, or Caterpillar. Manufacturer's names are used in these specifications for the purpose of establishing minimum requirements of level of quality, standards of performance and/or design required, and is in no way intended to prohibit the use of other manufacturer's items that meet or exceed the specifications stated herein. An equivalent product may be used, provided that the product is found by the County to be equal or greater in quality, standard of performance, design, etc. as specified. The County shall be the sole judge of equality or similarity, and its decision shall be final in the best interest. B. The diesel engine shall be mounted on a common base with the ac alternator and the direct connected radiator and shall be rated for standby service, continuously for the duration of the electric power interruption, with engine jacket water cooled by means of a direct mounted water-to-air radiator. C. The diesel engine shall be four-cycle, turbocharged, intercooled, 1800 rpm, with engine-driven fuel pump(s) and high-pressure common rail direct injection fuel system. D. The engine shall have a dry-type air cleaner with service indicator, spin-on fuel oil filter, full pressure positive pump lubrication with full-flow spin-on oil filters, thermostatic regulated oil cooling system, and crankcase drain line extension routed through enclosure wall via a stainless steel bulkhead fitting with stainless steel cap. Provide brass shutoff ball valve. E. The engine shall be equipped with a 120-volt,thermostatically controlled jacket water heater wired to an input receptacle at the connection box specified hereinafter.Provide brass isolation valves to facilitate removal of the jacket water heater without draining the coolant.Jacket water heater shall be interlocked to operate only when the engine is stopped. F. The diesel engine shall perform as specified when operating on ASTM D-975 Grade no.2D S15 ultra low sulfur diesel fuel. G. The engine shall be equipped with an electric 12-volt do starting system of sufficient capacity to crank at a speed which will start the engine under conditions indicated.Include an engine-driven charging alternator. The starting pinion shall disengage automatically when the engine starts. H. Engine speeds shall be governed by an electronic isochronous governor that will sense generator speed and provide accurate load transient correction capability at less than 0.5 percent regulation from no load to rated load conditions. I. Only engine manufacturer's standard ratings will be accepted. Engines modified for higher turbo boost than standard, or equipped with turbochargers larger than standard, or otherwise modified from the manufacturer's standard offering to meet the specified performance requirements will not be accepted. The engine shall minimize discharge of gaseous pollutants and shall comply with the discharge limitations of the Air Quality Management Division, Florida Department of Environmental Protection.The SUPPLIER shall furnish certification from the manufacturer that the proposed generator set will comply with the limitations. 2.4 BATTERIES AND BATTERY CHARGER A. Provide a lead-acid storage battery with sufficient capacity for three 30 second cranking cycles, allowing 10 seconds between cycles. Submit calculations verifying adequate capacity. The battery shall be installed in plastic box equipped with a vented, nonmetallic protective cover to protect against accidental short circuits. Metallic boxes and covers are not acceptable. B. A waterproof unit-mounted battery charger suitable for 120V, single phase, 60 Hz supply shall be provided. Power supply leads for the battery charger shall be wired to an input receptacle at the connection box specified hereinafter. The battery charger shall be voltage regulated, with separate float and equalize charge voltage adjustment having a 6-amp rating. The battery charger shall include alarm relays to sense high and low do voltage, zero current, and loss of AC supply with individual output contacts wired to terminal strips for connection generator control panel. C. Furnish with a 140-watt roof-mounted solar panel and automatic controller wired to operate in conjunction with the unit-mounted battery charger for maintaining the starting battery state of charge even without 120-volt ac battery charger supply.Controller shall provide visual readouts for system voltage,amperage,and temperature. Mounting brackets for solar panel shall be aluminum,painted to match the finish of the enclosure. D. Furnish with battery disconnect switch installed near the battery box to facilitate safe battery removal and replacement. 2.5 EXHAUST SYSTEM A. The engine shall be provided with an exhaust system consisting of flexible connection, exhaust silencer, catalyst, steel piping, fittings, stainless steel hardware and supports, brackets,and rain collar. B. The flexible connection shall be of the stainless-steel bellows type with flanged ends. Flexible elements shall be stainless steel suitable for exhaust temperatures recommended by the engine manufacturer. The flexible connection shall be suitable for vibration isolation and for relieving stress caused by thermal expansion. C. The exhaust silencer shall be critical grade,manufactured from stainless steel.Exhaust piping and rain cap shall also be stainless steel. Exhaust silencer and aftertreatment catalyst shall be installed inside of the enclosure, with the exhaust discharge piping routed through the cooling air discharge silencer plenum.Penetration through the roof of the enclosure for exhaust discharge piping is not accepted. D. Exhaust piping shall be pitched downward from the engine and be provided with sufficient drains to eliminate condensation and rain-water. Provide suitable insulation on exhaust piping routed within the enclosure. The weight of the exhaust and silencer shall not be supported by the engine. E. Furnish with exhaust aftertreatment system as required to meet EPA Tier 4 final requirements.Diesel Emissions Fluid (DEF)used in the aftertreatment system shall be stored in tank affixed to trailer enclosure or fuel tank, per manufacturer standard offering. Provide DEF level monitoring and alarm system wired to the generator control panel for level readout and alarm notification. 2.6 COOLING SYSTEM A. The engine shall be equipped with a cooling system having sufficient capacity to effectively cool the engine when delivering rated horsepower in 120 degrees F ambient air at an elevation of 1000 foot above sea level. B. The radiator shall be sized in accordance with the engine manufacturer's recommendation for use with 50 percent aqueous ethylene glycol.Provide drain line with extension routed through enclosure wall via a stainless- steel bulkhead fitting with stainless steel cap. Provide brass shutoff ball valve. C. The engine shall have an engine-driven, gear driven centrifugal type water circulating pump for circulating water through the cooling system. 2.7 AC ALTERNATOR A. The ac alternator shall be a UL listed synchronous, 12-lead,brushless,salient pole design with 2/3 winding pole pitch and solid-state permanent magnet generator(PMG) exciter. Other excitation methods are not accepted. AC alternator shall be manufactured by Marathon, Stamford, Cummins, Caterpillar, Kohler, or Baldor. Manufacturer's names are used in these specifications for the purpose of establishing minimum requirements of level of quality, standards of performance and/or design required, and is in no way intended to prohibit the use of other manufacturer's items that meet or exceed the specifications stated herein. An equivalent product may be used, provided that the product is found by the County to be equal or greater in quality, standard of performance, design, etc. as specified. The County shall be the sole judge of equality or similarity, and its decision shall be final in the best interest. B. Rated voltage shall be 277/480V three-phase, 120/208V three-phase, 120/240V three-phase (hi-leg on Phase B), and 120/240V single phase, selectable via a single change-over switch located at the generator connection box.Output frequency shall be 60Hz. C. Size AC alternator as required to ensure voltage dip does not exceed 20 percent when the following loads are applied in a single step: Nominal Standby Rating Applied Load 40 kW 93 kVA 60 kW 132 kVA 100 kW 315 kVA 150 kW 360 kVA Site conditions for these requirements shall be 104 degrees F ambient at an elevation of 1000 feet above sea level. D. Stator windings shall consist of random wound copper wire with tropicalized Class H insulation, vacuum- impregnated with fungus-resistant epoxy. Temperature rise rating shall be 125 degrees C in accordance with NEMA standards. E. Provide integral radio-interference suppression meeting NEMA and IEEE standards. F. The ac alternator shall be capable of supporting 300 percent rated current to a single or three-phase bolted fault for 10 seconds without externally mounted devices. G. The voltage regulator shall be solid state, three-phase RMS (root mean square) sensing, volts/hertz type, adjustable from minus 10 percent to plus 10 percent of rated voltage.Voltage regulation shall be within plus or minus 0.25 percent of any preset voltage setting from no load to rated load. I. Telephone interference factor shall be less than 50. J. Bearing: Double sealed ball bearing, lubricated for life. 2.8 MAIN CIRCUIT BREAKER A. Furnish engine generator set with two main circuit breakers,each equipped with shunt-trip function for remote trip initiated via generator control panel. One circuit breaker shall supply the portable cord and the other shall supply the output connections at the connection box.Connection box circuit breaker shall be set to supply rated current at the lowest selectable output voltage.Portable cord circuit breaker trip setting shall be 200 amps. 2.9 CONNECTION BOX A. Furnish engine generator set with a key-lockable, weatherproof while-in-use connection box attached to the rear of the enclosure.Provide rodent retardant mesh through which field cables must be routed.Connection box cover shall be interlocked with engine control panel to lock out the engine upon opening.Main circuit breakers shall be shunted upon opening of the connection box cover. B. Main circuit breaker load side terminals shall be wired to the connection box.Connection box shall be equipped with color-coded female cam-lock connectors with snap safety covers for terminating portable cords. Connectors for phase, neutral and ground connections shall be furnished. C. Furnish connection box with one compression connector or terminal lug to accompany each female cam-lock connector, allowing direct termination of portable cord when compatible male cam-lock connectors are not available. D. Provide 120VAC input receptacle for supplying the battery charger. E. Provide 120VAC input receptacle for supplying jacket water heater. F. The engine and generator shall be mounted on a common system base and shall be provided with vibration isolators of number and size as recommended by the engine supplier to support the engine,generator,radiator, and base. The isolation mountings shall consist of steel or cast-iron top and bottom housings incorporating steel springs or "donut" style isolators, located between the genset and the base, and shall be provided with built-in leveling bolts and built-in resilient chocks to control isolation and withstand lateral forces in all directions. 2.11 LUBRICATION AND COOLING FLUIDS A. The SUPPLIER shall furnish the engine fully charged with lubricating oil and grease as specified by the manufacturer for continuous service. The cooling system shall be furnished with a full charge of 50 percent ethylene glycol. 2.12 GENERATOR SYSTEM CONTROL PANEL A. The engine generator set shall be provided with an integrally mounted instrument and control panel located at the rear of the enclosure. Provide cover with window for an unobstructed view of the control panel and instruments with the cover closed. B. The engine-generator set controller shall be microprocessor-based and non-proprietary as furnished by Basler, Deep Sea Electronics or CoMap. Manufacturer's names are used in these specifications for the purpose of establishing minimum requirements of level of quality, standards of performance and/or design required, and is in no way intended to prohibit the use of other manufacturer's items that meet or exceed the specifications stated herein.An equivalent product may be used,provided that the product is found by the County to be equal or greater in quality, standard of performance, design, etc. as specified.The County shall be the sole judge of equality or similarity, and its decision shall be final in the best interest. Signal wiring shall be segregated from power wiring and be arranged neatly to facilitate tracing of circuits. 2. Plastic wiring wraps shall be used to bundle wires, except within wiring ducts. The bundles shall be securely fastened to the steel structure at suitable intervals not exceeding 12-inches in length. No open space hanging of wires will be permitted. Flexible stranded copper wiring shall be used throughout. No solid conductor wire shall be permitted. 3. Terminal blocks shall be provided for interconnections between remote devices and local control panel wiring. The terminal blocks shall be factory assembled on a mounting channel, and the channel shall be bolted to the inside of the panel. The terminals shall have a continuous marking strip using the nomenclature on the schematic diagrams. No more than 2 wires shall be terminated at any one terminal. Wire terminals shall have sleeve wire markers properly marked to match the schematic diagrams. 2.13 GENERATOR ENCLOSURE A. A weatherproof, sound attenuated, non-walk-in type enclosure shall be provided to house the engine, ac alternator and accessories. B. Enclosure shall be manufactured from 1/8-inch marine grade aluminum,sized as required to meet dimensional, sound attenuation,and code requirements for the actual generator provided.Wind load rating shall be 175MPH, minimum,in accordance with Florida Building Code requirements. C. The system shall include cooling and combustion air inlets designed to eliminate water intrusion while operating under maximum air demand conditions, an equipment enclosure section, and a cooling air vertical discharge silencer section. Enclosure shall be designed to reduce source noise to no more than 75 dBA measured at 21 feet from the enclosure.The enclosure shall be bird-and rodent-proof with all openings screened. D. Insulation in walls and roof shall be semi-rigid, moisture resistant, thermo acoustic, thickness as required to meet the noise criteria. Lining shall be perforated mill finish aluminum. Self-adhesive foam and loose or batt- type insulating materials will not be accepted. E. A minimum of 4 single personnel access doors shall be provided to allow easy access to oil,air,and fuel filters, jacket water heater, batteries and other maintenance items. Doors shall consist of an extruded frame with skin material matching enclosure. Doors shall be fully gasketed to form a weathertight perimeter seal and be key- lockable. Hinges shall be stainless steel and detachable. Handles shall be recessed and key-lockable. F. Enclosure shall be designed to not exceed 0.5-inch water gauge total external static pressure to ensure adequate airflow for cooling and combustion under maximum air demand conditions. G. A bolt-in-place removable end wall panel shall be provided for maintenance and/or equipment installation. Screws shall be hex-head type. H. All hardware shall be stainless steel. I. Furnish with 125 percent environmental containment basin for coolant and lube oil. J. Any areas likely to collect moisture shall be provided with a functional drain system. K. Provide LED luminaires for interior illumination on both sides of the enclosure,and LED luminaires with semi cut-off optics on front,rear,and either side of the enclosure for exterior illumination.Exterior luminaire housing finish shall match that of the enclosure. Interior and exterior lighting shall be controlled via timers installed in the generator control panel. Furnish with a Truck Lite#97960 document holder,or similar,on the front of the enclosure. 2.14 SUB-BASE FUEL TANK A. An integral UL 142 listed under-frame double-walled diesel fuel storage tank shall be provided.Rupture basin capacity shall be 110 percent of the main tank storage capacity. The tank shall have all required venting and a 2" lockable fill nozzle equipped with a brass connection collar mounted inside the enclosure. Provide a mechanical fuel level gauge and low-level alarm contacts, high-level alarm contacts, and a level transducer wired to the control panel for fuel level readout and alarm. The rupture basin shall include leak detection to provide tank rupture alarm annunciated at the generator control panel. B. Fuel capacity shall provide a 28-hour minimum run time at rated load. The DEF tank must be sized to match the run time of the fuel storage tank at rated load. C. Flexible connections shall be provided between fuel lines and the engine. D. Sub-base tank shall be painted black using baked powdered lacquer or enamel finish. 2.15 MOBILE TRAILER A. The engine generator set shall be securely fastened atop a mobile trailer to facilitate easy transportation between sites as determined by the OWNER. The mobile trailer shall be furnished with Department of Transportation (DOT) reflective tape, all required running lights, and shall satisfy all applicable DOT requirements. Furnish with 7-way trailer electrical connector and break away cable. B. Gross Vehicle Weight Rating(GVWR)shall be equal to or greater than the sum of the weight of the generator set, the mobile trailer itself, all onboard accessories, and all fluids required for operation, fully charged. Minimum accepted mobile trailer GVWR shall be 5000 pounds. Trailer shall be equipped with tandem axles and shall be suitable for 55 MPH towing speed,minimum. C. Furnish trailer with electric brakes, heavy duty full coverage fenders, safety chains fitted with spring-loaded safety hooks, and adjustable channel 4-position, 3" diameter lunette tow coupler. Provide two retractable stabilizer jacks in the rear and one at the front of the trailer,each fitted with integral tongue crank actuator. D. Provide spare wheel complete with tire,mounted to trailer driver's side. E. Furnish with two sets of rear wheel chocks, one chain-tethered to either side of the trailer. Provide mounting means on trailer to securely stow wheel chocks when not in use. F. Furnish with safety cone holder and two 36-inch-tall safety cones. G. Furnish with weatherproof aluminum storage box for storing portable cord. Storage box lid shall be key- lockable, supported with gas spring struts. Provide with LED light interlocked with the lid. Box shall allow field connection of the portable cable while the lid is closed.Provide with appropriate drainage system. H. Mobile trailer shall be painted black using baked powdered lacquer or enamel finish. 2.16 PORTABLE CORD A. Furnish with 200-amp UL Type W,G-GC or SOOW multiconductor portable cord,50-foot usable length,stored in the aluminum storage box.The supply end of the cord shall be connected to the 200-amp main circuit breaker. The load end of the cord shall be equipped with a 200-amp Crouse-Hinds APR20428 mating connector or equal. All key locks on the engine generator set,including any pad locks furnished,shall be keyed to CH751. Provide duplicate keyset. PART 3 --EXECUTION 3.1 FACTORY TESTING A. The complete engine-driven generator system shall be tested at the factory before shipment to the Site. Tests shall be conducted using a balanced,three-phase, dry-type,resistive load bank. B. Record complete test data for frequency, amperes, volts, power factor, exhaust temperature, coolant temperature, oil pressure,and battery charger level and submit for review. C. Conduct shop test run of at least four consecutive 15-minute intervals for the engine-generator set under the following load conditions and in the order listed: 15 minutes at full load 15 minutes at 3/4 load 15 minutes at 1/2 load 15 minutes at 1/4 load 3.2 STARTUP TESTING A. Startup testing shall be conducted in the presence of the OWNER. SUPPLIER shall furnish all fluids,lubricants and equipment required to perform the tests. Diesel fuel will be furnished by the OWNER. Upon completion of testing, demonstrate capability and compliance of system with requirements. Where possible, correct malfunctioning units on site,then retest to demonstrate compliance at no cost to OWNER. Otherwise,remove and replace with new units,and run complete field tests as specified at no cost to OWNER. B. Check fuel,lubricating oil,and coolant for conformity to manufacturer's recommendations under environmental conditions present. C. Test, prior to cranking engine for proper operation, accessories that normally function while the set is in a standby mode including jacket water heater and battery charger. D. Check, during start-up test mode, for exhaust leaks, cooling air flow, movement during starting and stopping, excessive vibration during running, line-to-line voltage,line-to-neutral voltage,and phase rotation. Test automatic start-up and automatic shutdown, initiated via remote contact closure from automatic transfer switch. F. Test safety interlocks under NFPA 110 criteria. G. After installation inspection and fine adjustments have been completed, a field test run of four consecutive hours shall be performed with the engine-generator loaded at 100 percent using a balanced, three-phase, dry- type, resistive load bank. Record complete test data for frequency, amperes, volts, power factor, exhaust temperature,coolant temperature,oil pressure,and battery charger level. H. Perform transient response test by applying rated load in a single step and then removing rated load in a single step. Output voltage and frequency shall be observed using a recording oscilloscope. Voltage and frequency dip,voltage and frequency overshoot,and recovery time to steady state after rated load application and rejection shall be recorded to verify conformance with the specified performance requirements. I. Perform functional test demonstrating the generator's ability to start and run site loads in the same sequence listed in the Generator Load Step Table,using the supplied mating connector. J. Upon completion of startup and after acceptance by the OWNER, the OWNER shall fill the fuel tank to capacity. 3.3 PERSONNEL TRAINING A. For the first delivery of each engine generator size furnished,provide on-site operation and maintenance training for all equipment included in this section. Training session shall be videotaped, and a copy of the recording shall be furnished to the OWNER. (2) By necessary implication and regulation, the prohibitions also do not apply to: a. Covered telecommunications equipment or services that: I. Are not used as a substantial or essential component of any system; and ii. Are not used as critical technology of any system. b. (1) In the event the contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the contractor is notified of such by a subcontractor at any tier or by any other source, the contractor shall report the information in paragraph (d)(2) of this clause to the recipient or subrecipient, unless elsewhere in this contract are established procedures for reporting the information. For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company(or any subsidiary or affiliate of such entities);c.Telecommunications or video surveillance services provided by such entities or using such equipment; or d.Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country. Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources. Roaming means cellular communications services(e.g.,voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high. Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service. Telecommunications equipment or services means telecommunications or video surveillance equipment or services, such as, but not limited to, mobile phones, land lines, internet, video surveillance, and cloud servers.
