Resolution 2007-218 RESOLUTION NO. 07- 218 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, DELEGATING SIGNATORY AUTHORITY TO THE COUNTY MANAGER, OR DESIGNEE, FOR THE PURPOSE OF ACCEPTING TRANSFERS OF DEVELOPMENT RIGHTS (TDRS) BY WAY OF LIMITATION OF DEVELOPMENT RIGHTS AGREEMENTS. WHEREAS, the Rural Fringe Mixed Use District, an Agricultural/Rural Designation of the Future Land Use Element of the Growth Management Plan, was created in part to direct incompatible uses away from wetlands and upland habitat in order to protect water quality and quantity, to maintain the natural water regime and to protect listed species of fish, plants and wildlife in their habitats; and WHEREAS, the Rural Fringe Mixed Use District provisions in the Growth Management Plan call for "the establishment of a simple, expeditious process whereby private property owners may, by right, 'sell' residential dwelling units from lands designated as Sending Lands" under a program to be "administratively reviewed and approved, requiring no further public hearing or Board approval if consistent with the provisions for administrative approval;" and WHEREAS, the creation of Transfer of Development Rights (TDR) credits requires acceptance and the execution of a Limitation of Development Rights Agreement by Collier County pursuant to the Land Development Code (LDC) Subsection 2.03.07 D.4f.ii (a); and WHEREAS, the signature by the County Manager, or his designee, would further a simple, expeditious process in connection with the acceptance of TDR Limitation of Development Rights Agreements as part of the TDR program. NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: Authority is hereby explicitly delegated to the County Manager, or his designee, to sign on behalf of Collier County any Limitation of Development Rights Agreement associated with the TDR program that has been approved in compliance with the procedures established by and under authority of the Land Development Code, Sections 2.03.07 and 2.03.08.
