Some counties have the VAB counsel rule on the good cause while some have you go to a legal hearing and prove good
cause to a Special Magistrate.
How does Collier handle?

Actually, my firm is very particular and I need to provide them with the details — like the name of of the
VAB legal counsel that will be reviewing?. Also, who is the special magistrate that hears the legal
petitions? Who is the regular special magistrate? Sorry, I don't mean to be needy but I have to let
them know so they can make a decision. Thanks.

Good afternoon, All.
I am forwarding the information below to you, along with an explanation.
Wendy, from Nathan Mandler's office, called my office today at 4:26pm - stating her
call was urgent (see below). I know who they are, and I do not talk to taxpayer reps (or
anyone else regarding VAB matters, other than my clients and the special magistrates,
and even then, it is almost always in writing or on the record).
I called her back to simply tell her that, and she advised that she was told to call my
office by someone in VAB Administration in Collier County. When I pressed her on that,
(my exact words: REALLY?!? Someone in VAB Administration told you to call me?? They
would have told me about this, and I've heard NOTHING.") she backtracked and said
that she was provided with my name from someone in the VAB office and they looked
me up.
I then told her that the proper course of action would be for her to email VAB
Administration with her concerns, and if you find that it needs my attention, you will
forward it to me.
She then explained that it was a good cause issue, and they wanted a preliminary
review of the issue before they filed a late petition on 140+ parcels. I told her that was
unethical, that no one has that type of access to a VAB attorney, that no one should
have that type of access to a VAB attorney, and if they want something late filed to be
considered, they need to file it, pay the filing fee, and go through the proper channels. I
advised her that the VAB cannot pay me to advise a petitioner on whether or not they
should file a petition. I told them that they hold themselves out to the public as
taxpayer representatives, that they should know the law, and that a good cause review
can only be performed once the petition is filed along with a good cause explanation
and any supporting documentation.
She then told me that she talks to other VAB attorneys all the time about this type of
issue, about which I expressed serious doubt. She then used the VAB attorney in
Miami-Dade as an example, and when I dropped that attorney's name and questioned
that claim (because I know the Miami-Dade VAB attorney and we speak from time to
time), she backtracked on that as well.
I need to make sure I expose this attempt at ex-parte communication with my office,
the unethical behavior displayed by the taxpayer representative, and how I handled the
situation. The call lasted a total of six minutes.
