Agenda 06/22/2021 Item #16A12 (Agreement - Barron Canal Maintenance)06/22/2021 EXECUTIVE SUMMARY Recommendation to approve an Agreement for the acquisition of a boat ramp, access and maintenance easement (Parcel 102AME) to facilitate Collier County’s maintenance of the Barron Canal. OBJECTIVE: To acquire a perpetual boat ramp, access and maintenance easement (Parcel 102AME) over private property adjacent to the Barron Canal, for the construction of two boat ramps, fencing, and ancillary improvements to facilitate the County’s scheduled maintenance of the Barron Canal. CONSIDERATIONS: Collier County currently maintains the Barron Canal (also known as the Barron Collier Canal, the SR 29 Canal, and the Everglades-Immokalee Canal), located along SR 29. For better access to the Canal for purposes of performing scheduled maintenance, the County’s Road Maintenance Division has identified adjacent private property upon which the County desires to construct two boat ramps, fencing, and ancillary improvements, and for which an easement from the property owner will be required. The property owner, Sunniland Family Limited Partnership, has agreed to donate Parcel 102AME to the County and has executed the proposed Agreement. FISCAL IMPACT: Funds for miscellaneous closing and recording fees not to exceed $100 will be required. Funds are available in Storm Water Fund (103), Stormwater Maintenance Cost Center (172929). The Road Maintenance Division will be providing regular cycled maintenance to the proposed easement area, including mowing, litter control, fence and ramp upkeep at an estimated cost of $3,000 per fiscal year. These annual costs will be absorbed within the division's annual maintenance budget. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this item. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB RECOMMENDATION: . Approve the attached Agreement and authorize the Chairperson to execute same on behalf of the Board; . Accept the conveyance of Parcel 102AME, and authorize the County Manager or his designee to record the conveyance instrument in the public records of Collier County, Florida; . Authorize the payment of all costs and expenses that Collier County is required to pay under the terms of the Agreement to close the transaction; . Authorize the County Manager or his designee to take the necessary measures to ensure the County’s performance in accordance with the terms and conditions of the Agreement; and . Authorize any and all budget amendments that may be required to carry out the collective will of the Board.
