EXECUTIVE SUMMARY
Recommendation to approve and execute a Transportation Post Project Maintenance Agreement
between the Florida Department of Transportation and Collier County for maintenance of the
realigned canal and authorize the Chairman to sign the Resolution and execute the agreement.
(This is a companion to Agenda ID 16A2)
OBJECTIVE: To approve and execute a Transportation Post Project Maintenance Agreement between
the Florida Department of Transportation (FDOT) and Collier County for the maintenance of the
realigned canal (B-2) at the Golden Gate Parkway Interchange.
CONSIDERATIONS: During construction of the Interstate I-75 Interchange at Golden Gate Parkway
by the State of Florida Department of Transportation (FDOT) several years ago, a segment of the I-75
Canal was realigned outside of the then-existing platted drainage easements. As depicted in the attached
aerial map, this has left the County with no right to maintain the realigned segment of the canal.
Following staff’s request, FDOT is willing to convey the land needed for maintenance of parts of the
realigned canal to the County, subject to the reservation of a limited access right -of-way line and
easement rights for ingress, egress, maintenance, light, air and view over portions ther eof. This Post
Project Maintenance Agreement provides for the County's operation and maintenance of the realigned
canal .
Collier County has a Cooperative Agreement with the Big Cypress Basin/South Florida Water Management
District for the operation and maintenance of the majority of the primary canal system. Through this
Agreement, Collier County will assign the maintenance of this segment of canal to the Big Cypress Basin
for its operation and maintenance, with the understanding that the FDOT will hold Collier County
responsible for the terms of this Agreement.
FISCAL IMPACT: There is no fiscal impact associated with this action. The routine maintenance of the
Canal within the I-75 right of way at Golden Gate Parkway is within the Big Cypress Basin budget.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
action.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires majority vote -
JAB. For Board Action- JAB
RECOMMENDATION: To approve and execute a Transportation Post Project Maintenance
Agreement between the Florida Department of Transportation (FDOT) and Collier County and authorize
the Chairman to sign the Resolution and execute the agreement.
