Agenda 06/22/2021 Item #11G (Budget Amendments - Big Corkscrew Island Regional Park)06/22/2021 EXECUTIVE SUMMARY Recommendation to authorize all necessary budget amendments within Park's Capital fund (306) and Park's Impact Fee fund (346) for the Big Corkscrew Island Regional Park. OBJECTIVE: To shift funding for furniture, fixtures, equipment, on-road and off-road vehicles from Park’s Impact Fee Fund (346) to Park’s Capital Fund (306) which is supported by the General Fund and Unincorporated Area General Fund. CONSIDERATIONS: Last year, for the FY2021 budget, Parks and Recreation requested and was granted funding from impact fees for various items to outfit Big Corkscrew Island Regional Park, which is a growth-related capital project, in the amount of $3,167,100. Items included were vehicles and trucks, off road vehicles (tractors, mowers, golf carts, ATV), trailers, artificial turf equipment, soccer goals, lifeguard stands, game room equipment, computers and large office equipment and furniture, etc. On June 4, 2021, the Governor signed into law House Bill 337, which amends s. 163.31801, Florida Statutes, effective immediately (June 4). Staff monitored the progress of this legislation, throughout the Legislative Session and analyzed the potential impacts to the Collier County Impact Fee Program. Staff will be working with the County Attorney to prepare all needed Ordinance amendments to implement the new statutory requirements. The majority of changes do not cause concerns for the ongoing administration of the Impact Fee Program, as they are already incorporated into the Collier County Program or are being contemplated for future amendments. These changes include requirements for phased implementation for increases to impact fees and timing requirements for update studies. The legislation also limits increases to impact fees that are greater than 50%, however, it provides a process to conduct a “demonstrated needs study” in order to establish the extraordinary circumstances of the need, allowing for exceeding of the phase limitations, after specified public hearings are conducted. The greatest impact of the legislation is related to the definition of infrastructure that creates limitations on the expenditure of impact fees on certain types of vehicles, furniture, and equipment. The new law defines how the impact fees can be spent as follows: "Infrastructure" means a fixed capital expenditure or fixed capital outlay, excluding the cost of repairs or maintenance, associated with the construction, reconstruction, or improvement of public facilities that have a life expectancy of at least 5 year s; related land acquisition, land improvement, design, engineering, and permitting costs; and other related construction costs required to bring the public facility into service. The term also includes a fire department vehicle, an emergency medical service vehicle, a sheriff's office vehicle, a police department vehicle, a school bus as defined in s. 1006.25, and the equipment necessary to outfit the vehicle or bus for its official use. For independent special fire control districts, the term includes new facilities as defined in s. 191.009(4). In consultation with our outside legal counsel, all the items Parks would like to purchase are no longer impact fee eligible expenditures. These items are not related to construction costs nor are the vehicles public safety vehicles. Between FY20 & FY21, the Parks Impact Fee Fund (346) was given a budget of $3,167,100 to purchase vehicles and equipment; as of June 3, 2021, Parks has spent $673,627. Therefore, another funding source is needed to purchase the remaining items in the amount of $2,493,473. Parks Capital Fund 306 is supported by General Fund and Unincorporated Area General Fund transfers. Between Reserves ($700,000) and residual project budgets ($429,922) from completed projects plus a transfer from the County Wide Capital Fund 301 in the amount of $588,551, a budget amendment totaling 11.G Packet Pg. 602 06/22/2021 $1,718,473 can be processed in FY 21. The balance remaining of $775,000 will be provided in FY 22 within the Parks Capital Fund 306. FISCAL IMPACT: A budget amendment in the amount of $1,718,473 is needed for Vehicles and Equipment Project (80418), the funding will come from the following: $429,922 Excess budget from closeout projects within Parks Capital Improvement Fund (306) $700,000 Reduce Reserves within Parks Capital Improvement Fund (306) $588,551 Transfer from County-Wide Capital Project Fund (301) The source of funding for Park's Capital Fund (306) are transfers from the General Fund and Unincorporated Area General Fund. Also, another budget amendment is needed in the Parks Impact fee Fund 346, moving the unspent portion of Vehicles and Equipment Project 80418 to the Big Corkscrew Island Park Project 80039 to help fund the construction of Phase 2. LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for Board action. -JAK GROWTH MANAGEMENT IMPACT: There is no Growth Management impact due to this request.
