provide for a more c.\pcuitious processing of suhdl\'isioll plats; <lno
WHEREAS. the Board of County COlllmissioncrs desircs to approve subdivision plats
pursuant to Section 177,071. F/o/'ula Sltu/{/('.f; and
\VHEREAS. as part of the <Ippro\"al pro(css. the COLlllt)' and till.: dc\'clopcr enler into a
construction maintenance Jgrcemcnl with J bond l)r .1 kiter of credit or escrowed funds to ensure
that certain required Improvements arc construc!l'd within cJell subdi\'isJoll; and
WHEREAS. standard rOnTIS for thc construction ITIJJIHCl1l111eC <lgrCi:J11Cl1ts. the letter of credit
and bond arc attached in the Appcndices 10 the Lanu Dcvelopment Code; unu
WHEREAS, the Board of County Commissioncrs dcsires to administratively process the
construction maintenance agreement. lhc bond and letter of creult by ddegating the aUlhority to
reduce the amount of the required perfomlancc sc~urit}' and by Jclegating the authority to execute
agreements relating to performance security for subdivision Hllpro\'l:I11Cnls.

follows:
a. ,-: The Planning Services Director or his desisnc~ is delegated the authority to
reduce the amount of the perfomulncc security required in construction maintenance
aj,'Teemenls after approval of the subdivision pial by the Board if a portion of thercqnired
improvements arc completed and appro....cd by County, Staff ancr an inspection ,of the
infrastructure by the Count}'. The pcrConnance security shall equal 100% oC the cni:J,i~ecr's
estimate of costs to complele the renwining required improvements and 10% of the
engineer's original estimate of costs to complete all oCthe required improvements.
b. The ehainnan of the Iloard of Count)' Commissioners is hereby delegated the
authority to sign construction maintenance agreemenls on behalf of the Board aficr the plat is
approved by the Iloard of Coullly Commissioners and after approval by th~ Planning
Services Director, or his designee, and the County Attorney's Onile,
3. No plats shall be recorded without execution of a construction maintcn31'ce
agreement and receipt of an acceptable perfomlant'e guaranlee. The fully executed construction
maintenance agreement shaJ/ be filed with the Clerk 10 the Board,
4. .': This Resolution shall take effect immediately upon adoption.
