(Commissioner McDaniel’s request) Time Certain Items: Item 9A & 9B and companion items to be heard at 10:00am - Longwater and Belmar items with companion items   6/8/2021 8:33 AM 06/08/2021 EXECUTIVE SUMMARY Recommendation to direct the County Manager to retain an outside consultant to review the Rural Lands Stewardship Area (RLSA) Overlay Growth Management Plan, as amended, to estimate the total Stewardship Credits available in the Overlay. OBJECTIVE: To better estimate the total Stewardship Credits available in the Overlay. CONSIDERATIONS: In January 2018, the Board directed RLSA restudy was initiated by County staff, and an ad hoc advisory committee, the Growth Management Oversight Committee (GMOC) was appointed to assist in directing public engagement. Staff has completed drafting proposed Growth Management Plan amendments resulting from the RLSA restudy and public outreach. One of the substantive proposed changes to the RLSA recomme nded by County staff is to impose a cap of 404,000 Stewardship Credits on no more than 45,000 acres in the RLSA Overlay as follows: Policy 1.22 The total number of Stewardship Credit shall be capped at 404,000 to entitle no more than 45,000 acres of Stewardship Receiving Areas. Generating Steward Credits does not presume approval of Stewardship Receiving Areas. Also, per Policy 3.11, Stewardship Credits for designation and completion of restoration are increased from a total maximum of 8 credits per acre to 10 credits per acre. It is staff’s opinion that to achieve 45,000 acres of SRAs will consume the remainder of the developable land within the RLSA. At the CCPC, the total number of Stewardship Credits available through the RLSA program was disputed by certain members of the public, including the Conservancy. The question becomes how much developable land, if any, will remain within the overlay assuming the approval of 45,000 acres of Stewardship Receiving Areas. Having significant developable land remaining within the RLSA overlay following this “build out’ of 45,000 acres of SRAs would partially defeat the purpose of the program. FISCAL IMPACT: Unknown at this time; the Board can put a cap on the cost to retain a consultant. GROWTH MANAGEMENT PLAN IMPACT: None at this time. If approved, the study would take place following Board action on the proposed RLSA amendments. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality and requires majority vote for approval. -JAK RECOMMENDATIONS: That the Board of County Commissioners directs the County Manager to retain an outside consultant to review the Rural Lands Stewardship Area (RLSA) Overlay Growth Management Plan, as amended, to estimate the total Stewardship Credits available in the Overlay.
