EXECUTIVE SUMMARY
Recommendation to approve a First Amendment to Agreement No. 18-7343-WV for Court
Reporting with U.S. Legal Support, Inc., to adjust the fee schedule for rates during the remaining
two one-year renewal terms of the Agreement.
OBJECTIVE: To obtain approval of a First Amendment to Agreement No. 18-7343-WV for Court
Reporting with U.S. Legal Support, Inc, to ensure the availability of court reporting services including
recording and transcription of depositions, meeting minutes, testimony for court hearings, and other
similar services.
CONSIDERATIONS: The County, including the County Attorney’s Office, uses court reporting
services for multiple purposes including to transcribe depositions, trials, arbitrations, and administrative
proceedings. Court reporting services are also used for advisory committee meeting minutes including
the Collier County Planning Commission. Court reporting services sometimes also include videotaping
services and similar technology based transcription services.
U.S. Legal Support, Inc., is currently under contract with the County under Agreement No.# 18-7343-WV
(the “Agreement”), and has provided satisfactory court reporting services to the County for several years,
including the first three years of the Agreement. The Agreement provides for an initial three-year term,
with two one-year renewal terms. The initial term ran through May 8, 2021 but as permitted under the
Agreement the parties exercised the first one-year renewal term.
At the time of renewal, U.S. Legal Support, Inc., requested that the Agreement be amended to update the
rates in its three-year old fee schedule. Staff negotiated the proposed rates included in the attached First
Amendment and recommends approval of the updated rates to apply during the remaining two one-year
renewal terms.
The County entered into the Agreement with U.S. Legal Support, Inc., through a Board approved
exemption from the competitive process for legal services provided in Section 8, subsection 7 of Collier
County Procurement Ordinance No. 2013-69, as amended. Notwithstanding an exhaustive attempt to
reach out to a large number of qualified vendors at that time, U.S. Legal was the only vendor to submit a
proposal. Before the exhaustion of the remaining renewal terms, staff will once again explore
competitively soliciting for these services from a large group of qualified vendors.
Historically, the County has experienced an approximate average expenditure under the Agreement in the
amount of $44,000, which was represented in the Exemption from the Competitive Process when
originally Board approved. Due to the fluctuation of need and the potential for increased expenditures,
staff is requesting that the annual expenditure under the Board approved Exemption be increased up to
$75,000. Payment for services under the Agreement will come from each department’s budget when
utilized.
FISCAL IMPACT: No immediate financial impact results from the approval of this Executive
Summary. Funds for these services shall come from each individual using department’s budget as
services are required.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority
