EXECUTIVE SUMMARY
Recommendation to adopt a resolution amending Resolution 2008-329 for Stewardship Sending
Area 15 (“CLH & CDC SSA 15”) within the Rural Lands Stewardship Area Overlay District
(RLSA) by way of a first amendment to the amended and restate d Escrow Agreement for CLH &
CDC SSA 15; and approving the first amendment to the amended and restated Escrow Agreement
for CLH & CDC SSA 15. The subject property is located in Sections 25, 26 and 35, Township 47
South, Range 28 East and Sections 1, 2, 12, 13, 14, 23, 24, 25, 26, 35 and 36, Township 48 South,
Range 28 East, Collier County. (This is a Companion Item to 9A, 11A, 11B, 11D, and 11E)
OBJECTIVE: To approve the first amendment to the amended and restated Escrow Agreement for the
fifteenth Stewardship Sending Area (CLH & CDC SSA 15) in the Rural Lands Stewardship Area Zoning
Overlay District (RLSA).
CONSIDERATIONS: The Rural Lands Stewardship Area (RLSA) Overlay District was adopted by
Collier County as a program designed to preserve natural res ources, protect agricultural lands, and direct
growth to suitable locations. The mechanism to achieve this is through the designation of Stewardship
Sending Areas (SSAs) in exchange for Stewardship Credits (Credits) that can be used to entitle
development.
On November 18, 2008, the Board of County Commissioners (Board) approved the fifteenth Stewardship
Sending Area (SSA) known as CLH & CDC SSA 15 and awarded 7,261.8 Stewardship Credits.
On January 28, 2020, the Board approved a resolution (Resolution 2020-025) to amend CLH & CDC
SSA 15, which redesignated 5,253.4 acres as CLH & CDC SSA 15; amended and restated the
Stewardship Sending Credit Agreement, Stewardship Easement Agreement, and Escrow Agreement; and
established the number of credits (31,367.0) generated from said SSA.
This application is to amend the previously amended and restated Escrow Agreement for CLH & CDC
SSA 15 to entitle the Rivergrass Village, Longwater Village, and Bellmar Village Stewardship Receiving
Areas (SRAs). CLH & CDC SSA 15 was approved to entitle the Rivergrass Village SRA per Resolution
2020-025. Following the Collier County Planning Commission (CCPC) hearing for the Longwater
Village SRA, the applicant requested to utilize Credits from CLH & CDC SSA 15 instead of using cr edits
from CLH SSA 14 and CLH & CDC SSA 17 to entitle the Longwater Village SRA. The applicant had
proposed using Credits from CLH & CDC SSA 15 to entitle Bellmar Village SRA during the CCPC
hearing for the village. CLH & CDC SSA 15 has enough credits avai lable to entitle the Rivergrass,
Longwater and Bellmar Village SRAs.
FISCAL IMPACT: There are no fiscal impacts associated with this application.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and it requires a majority
vote for Board approval. (HFAC)
GROWTH MANAGEMENT IMPACT: The Rural Lands Stewardship Area Overlay in the Future
Land Use Element (FLUE) established the process and requirements for establishing SSAs, which lands
qualify for SSA designation and the use limitations for lands once designated as SSAs. The Rural Lands
Stewardship Area Overlay is implemented through the Rural Lands Stewardship Area Zoning Overlay
District. The zoning overlay contains the same requirements and limitations as the FLUE Overlay.
Therefore, staff’s analysis indicates this resolution to amend the amended and restated Escrow Agreement
is compliant with the RLSA Zoning Overlay and is also consistent with the FLUE.

restated Escrow Agreement for Stewardship Sending Area 15 (CLH & CDC SSA 15) by way of the first
Amendment to entitle the Rivergrass Village, Longwater Village and Bellmar Village SRAs.
