F.4 EXECUTIVE SUMMARY Recommendation to approve clarifications to the Collier Community Assistance Program to assist sole proprietors under the Small Business/Not for Profit Loan Repayment program. OBJECTIVE: To provide clarification for the Collier Community Assistance Program. CONSIDERATIONS: At their February 9, 2021 meeting, the Board authorized an additional $21.7 million community assistance program through December 31, 2021 that included programs designed to continue community support and expand the use of other relief programs. The Board approved funding allocations for six different programs:. (1) Individual Assistance (2) Small Business / Not for Profit Loan Repayment (3) Personal Protective Equipment (PPE) (4) Senior and Social Service Support (5) Food Security Emergency Assistance (6) Community Outreach During processing of Small Business / Not for Profit Loan Repayment applications, staff recognized that clarifications related to sole proprietorships were needed in order to ensure timely review by staff and payment by the Clerk of Courts Office. These community assistance programs do not fall under any federal or state grantor agency requirements allowing the Board the authority to make these recommended changes. Small Business/ Not for Profit Loan Repayment A sole proprietor operating under the owner's legal name is not required to register his/her name with the Florida Division of Corporations. If any other name is used then registration is required. It is most common to see a sole proprietor operating under a fictitious name and in that case registration is required. Approval of this item will exempt a sole proprietor operating under the owner's legal name from the local program requirement to hold an active SunBiz registration with the Florida Division of Corporations for the purposes of processing their application since it is not required by law. This information has been confirmed with the Florida Division of Corporations. FISCAL IMPACT: There is no new fiscal impact associated with the clarification included in this item. GROWTH MANAGEMENT IMPACT: There is no growth management impact.
