Resolution 2007-115 RESOLUTION NO. 07-~ A RESOLUTION OF THE BOARD OF ZONING APPEALS OF COLLIER COUNTY, FLORIDA, RELATING TO PETITION NUMBER SV-2006-AR-l035l, GRANTING THREE VARIANCES FROM SECTION 5.06.04.C.15 OF THE LAND DEVELOPMENT CODE, CONCERNING AN OFF-PREMISES DIRECTIONAL SIGN FOR THE UNITY OF NAPLES CHURCH, LOCATED AT 7100 DAVIS BLVD., SECTION 8, TOWNSHIP 50S, RANGE 26E, COLLIER COUNTY, FLORIDA. WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public; and WHEREAS, the County pursuant thereto has adopted a Land Development Code (LDC) (Ordinance No. 04-41, as amended) which establishes regulations for the zoning of particular geographic divisions of the County, among which is the granting of variances; and WHEREAS, the Petitioner is requesting three variances with respect to an off-premises directional sign. They are: (1) relief from LDC g5.06.04.C.15.a, which states that off-premises directional signs are only permitted in non-residentially zoned or agricultural districts; (2) relief from LDC g5.06.04.C.15.b.i, which requires each off-premises directional sign to be no more than twelve (12) square feet in area; and (3) relief from LDC g5.06.04.C.15.b.v, which requires an off-premises directional sign to be within 1,000 feet of the intersection of the arterial roadway serving the building, structure, or use; and WHEREAS, the Board of Zoning Appeals has held a public hearing with due notice made, and has considered the advisability of granting these variances; and WHEREAS, the Board has found as a matter of fact that satisfactory provision and arrangement have been made concerning all applicable matters required by the Land Development Code; and WHEREAS, all interested parties have been given opportunity to be heard by this Board in public meeting assembled and the Board having considered all matters presented. District, which sign may be located as set forth in Exhibit "B," which is more than 1,000 feet from the intersection of the arterial roadway serving the building, structure, or use. BE IT FURTHER RESOLVED that this Resolution relating to Petition Number SV- 2006-AR-10351 be recorded in the minutes of this Board.
