Agenda 02/23/2021 Item #16K5 (Setting Place/Time to Open PBSD Ballot Count)02/23/2021 EXECUTIVE SUMMARY Request Board to set the place and time for the Clerk, with the assistance of the County Attorney’s office, to open and count the mail ballots of the nominees to fill the vacancies on the Pelican Bay Services Division Board. OBJECTIVE: To set the place and time to count the mail ballots for applicants seeking membership on the Pelican Bay Services Division Board. CONSIDERATIONS: This 11 member Board was established by Ordinance 2002-27 as amended. The Division provides landscaping services, including all public road maintenance and park areas, street lighting services, aquatic management services, beach cleaning, and the Clam Bay Restoration Project. It is the Division’s responsibility to provide the framework of long-term community planning so that residents can enjoy the benefits of Pelican Bay while ensuring both the social and financial well -being of the Pelican Bay Community. A list of the current membership is included in the backup. The terms for Jacob Damouni (commercial/business), Scott Streckenbein (resident), Thomas F. Cravens (resident), Joseph Chicurel (resident), and Peter Griffith (resident), will expire on March 31, 2021. Balloting by mail is currently taking place to fill the pending residential vacancies, in acc ordance with the procedures outlined in Code of Laws Section 122-1662. Code of Laws Section 122-1662(d)(3) states, “The mail ballots shall be cast directly with the Clerk. At the place and time stated in the notice of the balloting published by the Board of County Commissioners, the Clerk, with the assistance of the County Attorney’s Office, shall open and count the ballots, which have been returned to the Clerk as of the date and time stated in such notice of balloting, in a manner which the Clerk deems advisable and not inconsistent with the provisions of this Ordinance. Any member of the public shall be entitled to attend and observe. The determination of the Clerk and the County Attorney of validity of any ballot shall be final. The board will exercise decision and control of the day to day operational affairs of the Unit to the maximum extent allowed by law, unless and except when there is some overriding governmental reason to do otherwise. Membership shall be 9 representatives of the residential interests within the Unit and 2 representatives of the commercial & business interests within the Unit. Terms are 4 years. WHEREAS, Collier County Ordinance No. 2002-27, created the Pelican Bay Municipal Service Taxing and Benefit Unit, superseding and repealing prior Pelican Bay Municipal Service Taxing and Benefit Unit Ordinances; and WHEREAS, Ordinance No. 2002-27, as subsequently amended, provides for the creation of the Pelican Bay Services Division Board, specifies the composition of said Advisory Board and sets forth the process for nomination and appointment of its members; and WHEREAS, pursuant to Ordinance No. 2002-27, as amended, all current vacancies on this Advisory Committee were publicly announced and advertised and all timely applications for appointment considered as nominees for appointment; and WHEREAS, by Resolution No. 2021-15, the Board of County Commissioners confirmed March 5, 2021, as the balloting date for the recommendation of members to the Pelican Bay Services Division Board by the record title owners of property within the Pelican Bay Municipal Service Taxing and Benefit Unit; and WHEREAS, the Board of County Commissioners desires to set the place and time for the counting of the mail ballots to fill the vacancies. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the mail ballots for the nominees to fill vacancies on the Pelican Bay Services Division Board shall be counted by the Clerk of Courts with the assistance of the Office of the County Attorney on Wednesday, March 10, 2021, at 10:00 a.m. in the Clerk of Courts Conference Room, Courthouse Annex 2nd floor.
