EXECUTIVE SUMMARY
Recommendation to direct the County Attorney to advertise and bring back for adoption at a later
meeting, an Ordinance creating the Palm River Sidewalk Municipal Service Taxing Unit (MSTU)
to install sidewalks in the Palm River Estates community.
OBJECTIVE: To create a funding source to install new sidewalks for the benefit of the property owners
and residents of Palm River Estates and contiguous neighborhoods.
CONSIDERATIONS: Palm River Estates is a well-established subdivision within North Naples with
many families and residents who walk and bike for both recreation and as a means to access schools and
other activities. Although there are some sidewalks in the community, the network is not complete and
has been a safety concern with pedestrians required to walk on the street and share the roads with cars and
commercial vehicles.
In 2017 the feasibility of installing sidewalks was evaluated and set aside due to the high cost of piping
swales and the extensive ROW grading required to address stormwater. In July 2020, the Public Utilities
Department (PUD) received authorization from the Board of County Commissioners (Board) to pursue
extensive potable water, wastewater, irrigation quality water, and stormwater infrastructure replacement
project throughout Palm River Estates and adjacent communities. As part of that project, the scope of
services includes replacing existing sidewalks as well as the design of a continuous sidewalk to complete
a looped sidewalk within the neighborhood. The design will reserve the space within the right-of-way for
sidewalks such that minimal adjustments to existing utilities would be required when funding becomes
available and the sidewalks are constructed. The commencement of the PUD project created an ideal
opportunity to install new sidewalks at a significantly reduced cost if constructed in collaboration with the
PUD utility project.
On December 1, 2020, a virtual Town Hall meeting was held to receive public input from the Palm River
community. The response was a positive consensus to utilize the Municipal Service Taxing Unit (MSTU)
process as a funding option to complete the sidewalks. Subsequently, on December 8, 2020, a
representative for the Palm River Estates and contiguous neighborhoods approached the Board requesting
they consider establishing an MSTU to fund the construction of sidewalks in the community as part of the
PUD project. The Board gave the County Manager direction to move forward with preparing all the
necessary paperwork required to establish the MSTU to fund sidewalk installation.
The proposed Ordinance creates the Palm River Sidewalk MSTU which will levy and assess a tax not to
exceed one-half (½) mil against taxable property values within the MSTU district. The MSTU district is
depicted and defined in Exhibit “A” of the Ordinance.
If this item is approved, the proposed Ordinance will be advertised and brought back for adoption on the
next available agenda for final adoption.
FISCAL IMPACT: The advertising costs are expected to be no more than $650 and funded by 111-
162507 and reimbursed by the MSTU upon the creation of a budget.
The project is expected to be executed in a phased manner so as to coordinate with the Public Utilities
Department replacement project. For planning purposes, the project cost is estimated at $1,200,000 to
$1,500,000 over five (5) years. A tax levy of one-half (½) mil (0.50 per $1,000 of taxable value) is
expected to generate approximately $250,000 annually. FY 23 would be the first year of the Palm River
Sidewalk MSTU tax levy. Project scope/actual project cost as well as future MSTU taxable value will

determine the number of years the tax levy will be in place to pay for the project.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this
item.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK

installation of sidewalks.
