Agenda 01/26/2021 Item #16A 9 (ROW drainage & Utility Easement for Whippoorwill Lane & Marbella Lakes Dr connection)01/26/2021 EXECUTIVE SUMMARY Recommendation to approve an agreement for the purchase of a road right-of-way, drainage, and utility easement (Parcel 113RDUE) and a temporary construction easement (Parcel 113TCE) required for construction of roadway and related improvements for the Whippoorwill Lane and Marbella Lakes Drive Connection (Project No. 60219). Estimated Fiscal Impact: $9,850. OBJECTIVE: To acquire the right-of-way needed for construction of roadway and related improvements to Whippoorwill Lane and Marbella Lakes Drive (the Project). CONSIDERATIONS: Collier County is seeking to purchase a road right-of-way, drainage, and utility easement (Parcel 113RDUE) and a temporary construction easement (Parcel 113TCE) from Mariposa at Gusto Bella Vita Condominium Association, Inc. (the owner), needed for construction of the Project. Parcel 113RDUE is an irregularly shaped parcel, 2,292.5 square feet in extent, located on the southeast corner of Whippoorwill Lane and Nighthawk Drive. The County is also seeking to acquire a temporary construction easement from the owner. Parcel 113TCE is square in shape, 900 square feet in extent, also located on the southeast corner of Whippoorwill Land and Nighthawk Drive. The attached Valuation Memorandum, dated August 24, 2020, prepared by the Growth Management Department’s Review Appraiser, Harry Henderson, SRA, estimates the aggregate value of these parcels at $9,700. The attached agreement is the result of amicable negotiations between the owner and County staff and provides for a full compensation payment at the County’s appraised value. Staff accordingly recommends that the Board of County Commissioners (the Board) approve the agreement. FISCAL IMPACT: Funds in the amount of $9,850 will be required, being the aggregate c ompensation amount of $9,700 and miscellaneous closing and recording fees not to exceed $150. The primary funding source for the acquisition of right-of-way is impact fees. Should impact fees not be sufficient within a particular project, the secondary funding source will be gas taxes. No maintenance costs are anticipated until such time as the Project is constructed. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan and the Collier County Growth Management Plan. RECOMMENDATION: . Approve the attached agreement and authorize the Chairman to execute same on behalf of the Board; . Accept the conveyance of Parcels 113RDUE and 113TCE and authorize the County Manager, or his designee, to record the conveyance instruments in the public records of Collier County, Florida; . Authorize the payment of all costs and expenses that Collier County is required to pay under the terms of the purchase agreement to close the transaction; . Authorize the County Manager or his designee to take the necessary measures to ensure the County’s performance in accordance with the terms and conditions of the purchase agreement; and . Authorize any, and all, budget amendments that may be required to carry out the collective will of the Board.
