Agenda 01/12/2021 Item #16A33 (Repealing Resolution 2020-219)01/12/2021 EXECUTIVE SUMMARY Recommendation to repeal and replace Resolution 2020-219 by adopting a Resolution to hold a public hearing to consider vacating Gulf Shore Court, the 20-foot alley in Block “D” and a portion of Center Street, all part of the plat of Vanderbilt Beach Center, Plat Book 3, Page 16 of the Public Records of Collier County, Florida, as part of the application for the One Naples project. The vacation will be heard as a companion item to the One Naples application. The subject Right -of- Ways are located in the northeast quadrant of the intersection of Gulf Shore Drive and Vanderbilt Beach Road in Section 32, Township 48 South, Range 25 East, Collier County, Florida. (PL20200000368) _____________________________________________________________________________________ OBJECTIVE: Pursuant to Sections 336.09 and 336.10, Florida Statutes, and Resolution No. 2013-166, the Board of County Commissioners (Board) must authorize a public hearing to consider the vacation of the County and the public interest in any public road right-of-way. CONSIDERATIONS: The Development Review Division has received a request from Christopher R. Mitchell of J. R. Evans Engineering, P.A., as agent for the applicant, Vanderbilt Naples Holdings, LLC. This request is to vacate Gulf Shore Court, the 20-foot alley in Block “D” and a portion of Center Street, all part of the plat of Vanderbilt Beach Center, Plat Book 3, Page 16 of the Public Records of Collier County, Florida. The vacation is necessary for the One Naples project, and is contingent on the approval of the application. Accordingly, this vacation will be heard as a companion item to both the application to rezone the property from C-3 Commercial Intermediate Zoning District to Mixed-Use Planned Unit Development (PL20190000697), and the Growth Management Plan Amendment for One Naples (PL20190000696). In order to schedule a public hearing on the requested vacation of Right -of-Ways, the Board must adopt a Resolution setting the public hearing in accordance with Sections 336.09 and 336.10, Florida Statutes. On December 8, 2020, the BCC adopted Resolution 2020-19, setting the hearing date for the One Naples companion applications to January 12, 2021. However, on December 15, 2020 the BCC held a Special Meeting to discuss the time, place and location for holding a public hearing for the One Naples project and companion items and determined that the public hearing will be held at 9AM on March 1, 2021 at the Board of County Commission Chambers, located at 3299 Tamiami Trail East, 3rd Floor, Naples, Florida. The attached resolution repeals and replaces Resolution 2020-219 and reflects the new date for the One Naples hearing. The hearing will be advertised in a local paper of general circulation pursuant to Section 336.10, Florida Statutes and Resolution No. 2013-166, and the adjoining property owners will be given notice as well. FISCAL IMPACT: The application fee of $2,000 covers staff review, and processing. The applicant is also responsible for advertising fees. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action.
