PURCHASE AND DELIVERY OF AGGREGATES
THIS SECOND AMENDMENT, made and entered into on this e day
of' ber , 2020 by and between Grippo Pavement Maintenance Inc., (the "Contractor")
and Collier County, a political subdivision of the State of Florida, (the "County"):
WHEREAS, on February 13, 2018 (Agenda Item 16.A.9), the County entered into an
Agreement with Contractor for the purchase and delivery of aggregates and other related materials to
use on "as-needed" basis for various projects throughout the County with an expected annual spend of
$1,000,000; and
WHEREAS, on February 21, 2019, the County administratively approved the First
Amendment to Agreement # 17-7158 to correct Scriveners error to Section 22. Payments Withheld,
replacing the word"Contractor"with"County"; and
WHEREAS, the parties desire to amend the Agreement modify Exhibit B- Fee Schedule
allowing for price adjustments to line item unit prices per the U.S. Department of Labor, Bureau of
Labor Statistics (BLS), Producer Price Index (PPI) and allow five line items (46,47,49,50, and, 54) to
exceed the allowable BLS/PPI percentage change as approved by the Board.
WHEREAS, the Contractor will be Primary Contractor on all line item units listed on
Exhibit B- Fee Schedule.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein
contained, it is agreed by the parties as follows:
