EXECUTIVE SUMMARY
Recommendation to approve attached Change Order Number Two to the “Collier County Jail (J1)
Kitchen Replacement and Safety Upgrades” Invitation to Bid No. 20-7696-ST, with SDP, Inc. d/b/a
SDP-Consultants Corp., to extend the Construction Agreement’s time by sixty (60) days.
OBJECTIVE: To extend an agreement with SDP, Inc. d/b/a SDP-Consultants Corp. (“SDP”), by 60
days, to ensure items not yet manufactured and/or not yet delivered due to COVID-19 pandemic related
delays, will be manufactured, shipped, and received to ensure the project will be completed.
CONSIDERATIONS: On March 24, 2020, the Board approved a Construction Agreement (the
“Agreement”) with SDP to replace the existing kitchen in the Collier County (Naples) Jail, along with
various other safety upgrades. Due to the COVID-19 pandemic, President Trump declared a National
Emergency under 49 CFR § 390.23 No. 2020-002. The Centers for Disease Control and Prevention, and
state and local Departments of Health have recommended social distancing and the avoidance of public
gatherings to limit the spread of the COVID-19 virus. In an effort to protect the public, Florida Governor
Ron DeSantis and other state Governors have issued Executive Orders in response to the pandemic. In
many instances, certain restrictions have resulted in numerous business shutdowns and disrupted work
and material production schedules, which have caused and will continue to cause delays in material
orders, and the postponement of subcontractor availability to perform work directly affecting this project.
The base scope of work under this project is already underway. The General Contractor recently notified
Facilities Management that the production and delivery of steel doors, secured ceiling grid, secured
ceiling panels, and secured ceiling access panels have been delayed due to COVID-19 related issues, such
as plant shut-downs, and a general overall difficulty in obtaining materials. This in turn affects this project
by making scheduling sub-contractors and the receipt and application of materials extremely difficult.
After several meetings with its subcontractors, SDP is confident that an extension of 60 days of the
Agreement will allow SDP to complete the Project.
FISCAL IMPACT: There is no impact on funding from this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote
for Board approval. -SRT
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan from this
action.
RECOMMENDATION: To approve the attached Change Order Number Two (2) to the “Collier
County Jail (J1) Kitchen Replacement and Safety Upgrades” Invitation to Bid No. 20-7696-ST, with
SDP, Inc. d/b/a SDP-Consultants Corp., to extend the Agreement’s time to perform by sixty (60) days and
authorize the Chairman to sign the attached Change Order.

As discussed in our phone conversation, and supported with the back-up supplied from our sub-contractors, SDP is requesting an
additional sixty (60) day time extension to our project due to the COVID-19 Pandemic. Please recall that the President of the United
Stated declared a National State of Emergency and that the CDC, as well as State and local Departments of Health have
recommended special precautions that include social distancing and limiting public gatherings. There have also been several
Executive Orders from the Governor that have restricted various businesses. All of this resulted in shut-downs, delays, closures and
overall difficulty obtaining materials. This in turn affected this project by making scheduling sub -contractors and materials
extremely difficult if not impossible. We are at a point now where we have a high level of confidence that with this extension we
should be able to complete the project within the extended timeframe.

The security steel ceilings as manufactured by Trussbilt has experienced
significant delays beyond our control that are directly related to labor and
material issues created by COVID . At this time we project to the best of our
ability that this project has been delayed by 60 days. If that time can be
improved obviously we will do our best to do so
