EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners, acting as the Community
Redevelopment Agency Board (CRA), approve a four-month extension of the project completion
date set forth in the Commercial Building Improvement Grant (CBIG) Agreement between the
CRA and Kurgis 1996 Irrevocable Trust for the property located at 6023 Bayshore Drive, Naples,
Florida 34112 located within the Bayshore Gateway Triangle Community Redevelopment Area.
OBJECTIVE: To receive approval for a four-month extension for the Commercial Building
Improvement Grant Agreement between the Community Redevelopment Agency (CRA) and Kurgis 1996
Irrevocable Trust due to certain permitting delays and allow the project to be completed and grant funds
to be disbursed.
CONSIDERATIONS: Kurgis 1996 Irrevocable Trust executed a CBIG agreement with the CRAB on
January 14, 2020 to improve the exterior of the commercial property located at 6023 Bayshore Drive
based on the lowest bid of $13,709.00 resulting in a total grant aw ard of $6,854.50. Paragraph 4 of the
Agreement requires the improvement to be completed by January 14, 2021.
During the permitting process, the applicant discovered additional modifications to the building plans
were needed due to Building Code requirements. The applicant has completed the modifications and the
permit application was submitted on March 30, 2020; a building permit was issued on August 27, 2020.
On September 27, 2020, the applicant requested a time extension to complete the work and all
inspections.
The Grant Program requires grantees to complete work within one year of approval but allows time
extensions in cases where projects cannot be completed within the grant year. To qualify for a time
extension, grantees must demonstrate good faith to complete the project by applying for permits and
commence construction in a timely manner.
Specifically, the CBIG Program allows time extensions of the project completion date if the application
for permits were submitted to Collier County within four months after execution of the grant agreement
and construction of the improvements commenced within six months after execution of the grant
agreement. Given that the construction of the grant improvements did not commence for eight months
following execution of the grant agreement, CRA staff also sought a recommendation to waive this time
requirement from the CRA Advisory Board. CRA staff recommended this waiver as the applicants
displayed diligence in correcting permitting issues by communicating with CRA and Building
Department staff of the issues that arose and sought out guidance and support throughout the permitting
process.
GROWTH MANAGEMENT IMPACT: None.
ADVISORY BOARD RECOMMENDATION:
The Bayshore/Gateway Triangle CRA Local Advisory Board reviewed the extension request and
recommended extending the Agreement from January 14, 2021, to May 14, 2021. This recommendation
was approved with a vote of 7-0 on the November 3, 2020 regular meeting.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
for Board action. - JAB
FISCAL IMPACT: No additional fiscal impact. Funding in the amount of $6,854.50 was budgeted at the

time of the grant approval and is available in Bayshore CRA Capital Fund 787.
