Agenda 12/08/2020 Item #16A47 (Developer Agreement for future Government Center Complex/Tree Farm PUD)12/08/2020 EXECUTIVE SUMMARY Recommendation to approve the Developer Agreement with WPPI Naples TF LLC and TBC Tree Farm I, LLC that will allow for the design, right-of-way and construction of intersection improvements on Collier Boulevard Extension at the future Government Center Complex/Tree Farm Planned Unit Development entrance and cost sharing and reimbursement plan. OBJECTIVE: For the Developer to design, provide right-of-way and easements and construction activities to support intersection improvements on Collier Boulevard Extension. CONSIDERATIONS: In December 2018, TBC Tree Farm 1, LLC submitted a subdivision plat for a parcel within the Tree Farm PUD, referenced as PL20180003592. The access is anticipated to be on Collier Boulevard Extension. In May 2020, Collier County submitted a site development plan amendment, referenced as PL2020000953 for the Heritage Bay Government Center, which anticipated access to be on Collier Boulevard Extension. Staff has worked with both entities to coordinate site ac cess and provide a roundabout that will facilitate an existing significant U-turn movement from properties within the Heritage Bay PUD. The project has been configured to allow the County to convert the roundabout to a four-lane road, should Collier Blvd. later be extended. The Developer of the Tree Farm PUD has agreed to construct the agreed upon improvements and be reimbursed for a portion of the improvements. The County would be responsible for 61.6% of the project costs and would reimburse at the latter of either December 1, 2021 or six months following construction completion. FISCAL IMPACT: The County will be responsible for 61.6% of the construction low bid amount, capped at $243,884 and 61.6% of any unanticipated costs, agreed upon by both par ties and approved through a Change Order, capped at $40,000. The Developer will be reimbursed from gas taxes which will be budgeted within the agreed-upon timeframe. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. -JAK GROWTH MANAGEMENT IMPACT: This item meets current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities.
