Agenda 12/08/2020 Item #16A31 (Purchase Agreements: Whippoorwill Lane & Marbella Lakes Dr. Connection)12/08/2020 EXECUTIVE SUMMARY Recommendation to approve an agreement for the purchase of two road right-of-way, drainage, and utility easements (Parcels 104RDUE and 107RDUE) and a temporary construction easement (Parcel 107TCE) required for construction of roadway and related improvements for the Whippoorwill Lane and Marbella Lakes Drive Connection (Project No. 60219). OBJECTIVE: To acquire the right-of-way needed for the construction of roadway and related improvements to Whippoorwill Lane and Marbella Lakes Drive (the Project). CONSIDERATIONS: Collier County is seeking to purchase two road right-of-way, drainage, and utility easements (Parcels 104RDUE and 107RDUE) and a temporary construction easement (Parcel 107TCE) from Stratford Place Master Association, Inc. (the Owner), needed for construction of the Project. The attached Valuation Memorandum, dated September 8, 2020, prepared by the Growth Management Department’s Review Appraiser, Harry Henderson, SRA, estimates the total value of these parcels to be $26,700. Parcel 104RDUE is a triangularly shaped parcel consisting of 1,800 square feet located on the east side of Whippoorwill Lane across from Marbella Lakes Drive and is valued at $6,000. Parcel 107RDUE is an irregular-shaped parcel consisting of 5,215 square feet located over the Stratford Place access road and is valued at $18,000. Parcel 107TCE is a rectangular parcel consisting of 7,817.4 square feet located adjacent to and east of Parcel 107RDUE and has a two-year term. The value of Parcel 107TCE, calculated for the two-year term, is $2,700. The attached agreement for $26,700 is the result of amicable negotiations between the Owner and County staff and provides full compensation for the three parcels at the County’s appraised value. Staff recommends that the Board of County Commissioners (the Board) approve the agreement. FISCAL IMPACT: Funds in the amount of $26,900 will be required, being the aggregate compensation amount of $26,700 and miscellaneous closing and recording fees not to exceed $200. The primary funding source for the acquisition of right-of-way is impact fees. Should impact fees not be sufficient within a particular project, the secondary funding source will be gas taxes. No maintenance costs are anticipated until such time as the Project is constructed. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan and the Collier County Growth Management Plan. RECOMMENDATION: . Approve the attached agreement and authorize the Chairman to execute the same on behalf of the Board; . Accept the conveyance of Parcels 104RDUE, 107RDUE, and 107TCE and authorize the County Manager, or his designee, to record the conveyance instrument in the public records of Collier County, Florida; . Authorize the payment of all costs and expenses that Collier County is required to pay under the terms of the purchase agreement to close the transaction; . Authorize the County Manager or his designee to take the necessary measures to ensure the County’s performance in accordance with the terms and conditions of the purchase agreement; and 16.A.31 Packet Pg. 1793 12/08/2020 .
