EXECUTIVE SUMMARY
Recommendation to approve the Second Amendment to Agreement 17-7158 "Purchase and
Delivery of Aggregates" with Grippo Pavement Maintenance Inc.
OBJECTIVE: To continue maintenance activities critical to roadways' safety with approved price
increases in order to purchase aggregates and related materials.
CONSIDERATIONS: On February 13, 2018 (Agenda Item No. 16.A.9), the Board of County
Commissioners (Board) awarded Agreement # 17-7158 to Florida Dirt Source, LLC. and Grippo
Pavement Maintenance Inc., both awarded as primary and secondary vendors. On March 27, 2018,
Florida Dirt Source, LLC. filed Chapter 11 - Bankruptcy, and on February 4, 2019, Florida Dirt Source
emailed a letter to staff terminating their contract for convenience due to courts ceasing all operations
(letter attached). Grippo Pavement Maintenance, Inc. (Grippo) became the primary vendor for all line
items under this contract.
In March 2019, Grippo contacted staff requesting price increases for the 20 tons delivered category. Staff
held a meeting at the Procurement Services Division, and Grippo was able to negotiate prices with new
suppliers. Grippo's prices remained the same for an additional term. In March 2020, Grippo's suppliers
informed them prices would be increasing. Grippo was able to prolong price increases for an additional
seven months, however, Grippo has now exhausted negotiations with suppliers and requires price
increases to continue providing materials and services.
The contract allows for price adjustments based on the percentage change from the U.S. Department of
Labor, Bureau of Labor Statistics, Producer Price Index (PPI). The percent change for the 20 tons
delivered category was calculated utilizing data from the U.S. Department of Labor, Bureau of Labor
Statistics, Producer Price Index (PPI), Aggregate PPI Commodity Data: Series ID - WPU1321, Group:
Nonmetallic Mineral Products, Item: construction sand, gravel, crushed stone (PPI percent change
documentation attached). The trucking portion was not considered in these calculations. Several line
items are within 10.6 percentage change; however, Grippo's suppliers' price increases for the five -line
items listed below are above the percent change.

Due to limited competition in this market, staff requests Board approval of price increases that exceed the
allowable percentage change data from the U.S. Department of Labor, Bureau of Labor Statistics,
Producer Price Index (PPI) until new contracts are approved. Staff intends to solicit for the purchase and
delivery of Aggregates in November 2020 and award a new agreement which will be presented to the
Board for approval as soon as practicable thereafter.
FISCAL IMPACT: The increased costs associated with this action will be absorbed within the user
divisions' operating budgets.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote
for Board approval. -SAA
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
action.
RECOMMENDATION: To approve the second amendment to Agreement 17-7158 "Purchase and
Delivery of Aggregates" with Grippo Pavement Maintenance Inc. and authorize the Chairman to execute
the Amendment.
