EXECUTIVE SUMMARY
Recommendation to approve and execute a Transportation Post Project Maintenance Agreement
between the Florida Department of Transportation (F.D.O.T.) and Collier County for the
maintenance of the realigned Cocohatchee Canal and authorize the Chairman to sign the
Resolution and execute the agreement.
OBJECTIVE: To approve and execute a Transportation Post Project Maintenance Agreement between
the F.D.O.T. and Collier County for the maintenance of the realigned Cocohatchee Canal.
CONSIDERATIONS: As part of the original Interstate 75 (I-75) construction, F.D.O.T. realigned the
Cocohatchee Canal under Financial Project # 200746-1-52-01 away from the Immokalee Road
Interchange to provide a more cost-effective crossing and obtained a perpetual easement “for the purpose
of clearing, excavating, constructing and maintaining outfall and drainage ditches and drain” per Official
Record Book 365, Page 414. In accordance with Title 23, U.S. Code, Section 116 and Federal Highway
Administration regulations issued pursuant thereto, there must be an agreement from the local agency to
maintain the canal within F.D.O.T.’s right-of-way.
Collier County will be responsible, at its costs, for the maintenance of the Cocohatchee Canal within the
limits, including all above ground maintenance together with routine mowing, dredging and debris
removal in accordance with South Florida Water Management District canal maintenance standards.
Collier County will assign this maintenance to the South Florida Water Management District, with the
understanding that F.D.O.T. will hold Collier County responsible for the terms of this Agreement. If
assigned, the Collier County shall provide a copy of said assignment to F.D.O.T.
FISCAL IMPACT: The is no fiscal impact associated with this action. The routine maintenance of the
Cocohatchee Canal is within the South Florida Water Management budget.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for Board approval. -JAK
RECOMMENDATION: To approve and execute a Transportation Post Project Maintenance
Agreement between the Florida Department of Transportation (F.D.O.T.) and Collier County and
authorize the Chairman to sign the Resolution and execute the agreement.
