EXECUTIVE SUMMARY
Recommendation to approve the selection committee's ranking and authorize staff to enter into
contract negotiations with Earth Tech Environmental, LLC, concerning Request for Professional
Services ("RPS") No. 20-7768, "Collier County Comprehensive Watershed Improvement Project
Monitoring Services."
OBJECTIVE: Recommendation to approve the selection committee's ranking and authorize staff to
enter into contract negotiations with Earth Tech Environmental, LLC, concerning RPS No. 20-7768,
"Collier County Comprehensive Watershed Improvement Project Monitoring Services," so that a
proposed agreement can be brought back for the Board's consideration at a subsequent meeting.
CONSIDERATIONS: On May 14, 2020, the Procurement Services Division released notices of RPS
No. 20-7768, "Collier County Comprehensive Watershed Improvement Project Monitoring Services," to
6,398 firms, 76 interested firms viewed the solicitation information, and the County received five (5)
proposals by the June 16, 2020 deadline.
A selection committee convened on July 16, 2020, scored the proposals, and short-listed the top three
firms. On August 3, 2020, the selection committee reconvened for presentations and the committee
ranked the firms as follows:

Staff is recommending negotiations with the top ranked firm, Earth Tech Environmental, LLC.
Subject to the Board's approval, staff will begin contract negotiations in accordance with the Consultant's
Competitive Negotiation Act, Florida Statutes § 287.055, with Earth Tech Environmental LLC, so that a
proposed agreement can be brought back for the Board's consideration at a future meeting. If staff is
unable to reach an agreement with the number one ranked firm, staff will continue negotiating with the
remaining firms in ranked order.
FISCAL IMPACT: There is no fiscal impact associated with this action. Funding for the subsequent
contract is available in Growth Management Grant Fund (711), Project 33673. Source of funding is The
Restore Council Pot 3 grant which funds are passed through the Gulf Consortium.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote
for Board approval. -SRT
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this
action.
RECOMMENDATION: To approve the selection committee's ranking and authorize staff to enter into
contract negotiations with Earth Tech Environmental, LLC, concerning RPS No. 20-7768, "Collier
County Comprehensive Watershed Improvement Project Monitoring Services," and in the event that an
agreement cannot be reached with that firm, to continue negotiating with the remaining firms in ranked
order, so that a proposed agreement can be brought back for the Board's consideration at a future
meeting.

INTRODUCTION
As requested by the Capital Project Planning Division (hereinafter, the "Division or Department"), the Collier County Board of
County Commissioners Procurement Services Division (hereinafter, "County") has issued this Request for Professional Services
(hereinafter, "RPS") with the intent of obtaining proposals from interested and qualified Consultants in accordance with the terms,
conditions and specifications stated or attached. The Consultant, at a minimum, must achieve the requirements of the Specifications
or Scope of Work stated.
The results of this solicitation may be used by other County departments once awarded according to the Board of County
Commissioners Procurement Ordinance, as amended.
BACKGROUND
This monitoring is required to establish a background measurement for the RESTORE Comprehensive Watershed Improvement
Project (CWIP).
TERM OF CONTRACT
County reserves the right to modify this scope during negotiations for budgetary reasons.
The contract term, if an award(s) is/are made is intended to be for five (5) years.
Prices shall remain firm for the term of the awarded contract.
Surcharges will not be accepted in conjunction with this award, and such charges should be incorporated into the pricing structure.
DETAILED SCOPE OF WORK
This scope of monitoring services outlines the tasks to characterize with -project vegetation, water quality, and hydrologic conditions
in and around the Collier County Comprehensive Watershed Improvement Project (CCCWIP). The project will withdraw water from
Golden Gate Canal which will flow through a preliminary water treatment flow -way and discharge into the CCCWIP area south of
Interstate 75, east of Collier Boulevard and west of the southern Golden Gate Estates. The project monitoring area, about 25,761
acres, includes 22,839 acres of freshwater wetlands, mostly inside the western Picayune Strand State Forest (PSSF) and almost 3,000
acres of tidal estuarine wetlands south of US-41 within the landward fringes of Rookery Bay estuary.
The monitoring program includes continuous hydrologic monitoring, water quality sampling, and vegetation measurements. A 2019
Baseline Monitoring Event was conducted to measure baseline (pre -project) conditions prior to commencement of the project. At the
start of the 2019 Baseline Monitoring Event sixty (60) vegetation transects and sixty (60) monitoring wells were installed to capture
existing conditions within the project area. A first set of vegetation observations has been collected. Hydrologic monitoring has been
ongoing since installation and water quality sampling on a subset of twenty (20) wells has also been performed.

a) Sixty (60) shallow groundwater monitoring wells have been installed within and outside the area of potential project U
influence. Each 2" PVC monitoring well is equipped with a HOBO MX2001-04 water level data logger that records water Q
levels and barometric pressure at least twice daily. A minimum of quarterly data downloads, data storage and backup, and
equipment maintenance is anticipated. The awarded vendor shall assume responsibility for bringing to each scheduled

download event such supplies as are necessary for minor maintenance activities such as (but not limited to)

monitoring equipment, replacing lost well location markers, flagging, etc. NOTE: many of the wells are in remote locations
with standing water in the rainy season.
b) Hydrologic Monitoring Report: On a quarterly basis, water level data will be imported to spreadsheet format, compared to
local rainfall data, and summarized in graphs.
2) Water Quality Sampling
a) Samples for lab analysis of water quality will be collected on a quarterly basis from twenty (20) of the monitoring wells. If
the surface water depth is greater than 15 cm (6 inches) at any of the well locations, a surface water sample adjacent to the
well will also be collected for lab analysis. Sampling will be conducted in accordance with the Florida Department of
Environmental Protection's (FDEP) Standard Operating Procedures (SOPS) F.A.0 62-160.110, FS 2100 for surface water
sampling and FS 2200 for groundwater sampling. All water samples will be properly labeled in laboratory -provided sample
bottles, handled and shipped according to required protocols for the requested analytes, and sent to a subcontracted, Florida -
Certified and National Environmental Laboratory Accreditation Program (NELAP) certified laboratory.
b) The following water quality parameters are to be measured:

c) Quality Assurance Sampling — Include collection of two equipment blanks for each water quality sampling event.
Equipment blank sampling will include one blank for well collection equipment and one blank for surface water collection
equipment (if surface water occurs during the sampling event). Locations for collection of equipment blanks will be
randomized among the twenty sampling locations.
3) Water Quality Laboratory Analysis, Data Compilation and Reporting
a) The awarded vendor is responsible for verifying that the selected laboratory will be Florida -Certified for all the requested
analyses. Items included shall be the laboratory analysis cost for the total number of water quality samples collected annually
for well and surface water samples, calculated as the product of number of number of sites to be sampled (20), the number
of sample events each year (4), a well sample and a potential surface water sample at each site (up to 2 per site per event),
and the number of analytes (5), plus the costs for up to 2 quality assurance samples (one well sample and potentially one
surface water sample) for each of 4 events for 5 analytes. The following detection limits will be required:

4) Water Quality Quarterly Reporting

a) The awarded vendor will report laboratory results in formal laboratory report (pdf) and Electronic Data Delivery (EDD in
EXCEL spreadsheet) formats.
b) The awarded vendor will summarize the data by two project zones that identify the area where the greatest changes in water
elevation and hydroperiod will occur and the area outside that zone. Shapefiles of the two zones will be provided.
c) The data summary from each project zone will include number of samples analyzed, the number of non -detections for each
analyte and the mean and standard deviation of the values obtained for each of the requested analytes. The statistical values
will assume that non -detection results will be represented by'h the achieved detection limit.
d) A data quality summary will discuss the success of the laboratory in meeting the prescribed method detection limits, any
contamination found in the equipment blanks, and any results that bear on data quality.
5) Vegetation Monitoring
a) Sixty (60) 75-meter monitoring transects are located within homogeneous vegetation communities near each well location.
Each transect contains three (3) 10-meter x 10-meter canopy\shrub vegetation monitoring plots and six (6) groundcover
vegetation monitoring plots. Plot -based methods will quantify vegetation along each transect.
b) Vegetation quantification will occur at the same locations during each annual monitoring event. Each canopy, sub -canopy,
shrub, and groundcover species will be identified to the lowest taxonomic level possible and percent coverage will be
determined. All trees located within each plot with a dbh greater than 2.5 cm will be identified with numbered tree tags to
allow tracking of health and growth rates over time. Measurements will include dbh, percent canopy cover, and general
health.
c) Qualitative monitoring will occur at each plot location. Notes on the type of community being sampled, the general health r
of the vegetation, soil inundation, standing water levels, recruitment of new species, and the presence of nuisance/exotic 'E
species will be recorded on field data sheets. Observations and/or signs of wildlife shall also be noted. c
d) On an annual basis, panoramic photos will be taken at each plot location to document changes over time. c

e) Field datasheets developed for the project and already in use will be provided for the awarded vendor's use. W

f) An annual report will be compiled at the end of each monitoring year. The annual report shall include project descriptions, N
maps, data compilation (including GIS data), and discussions on data trends/conclusions/deviations. This report will be
submitted to the County and any agencies for review and discussion.

a) A draft annual report will be prepared and submitted to the county two weeks after completion of the quarterly sample event a
report that immediately precedes the annual sampling report. During the annual report preparation period, the contractor will ea
coordinate with the county project manager to ensure that the contents of the report meet the county's needs.

b) The county will review and comment on each report received from the awarded vendor. After receipt of comments, the 2
awarded vendor will have one calendar week to complete responses and provide a revised report to the county. The County c

7) Equipment Replacement Allotment — In the event monitoring equipment is heavily damaged or destroyed, the awarded vendor E
will replace the monitoring equipment.
Project Performance Schedule
Collier County will use the collected monitoring data assess restoration project performance and adaptively manage to optimize the N
restoration efforts. Therefore, the project includes a schedule for production of the reports to allow the county the greatest opportunity
to successfully manage the project.

county's contract. Sampling will occur on a quarterly basis thereafter.

The supplemental conditions contained in this section are intended to cooperate with, to supplement, and

Contractor means an entity that receives a contract. The services performed by the awarded Contractor
and its subcontractors shall be in compliance with all applicable grantor regulations/requirements, and
additional requirements specified in this document in the completion of the activity, project or program.
It shall be the awarded Contractor's responsibility to acquire and utilize the necessary manuals and
guidelines that apply to the work required to complete this project. In general,

Administrative, Contractual, or Legal Remedies (Ref. 41 U.S.C. 1908, 2 CFR § 200 Appendix II (A)
Unless otherwise provided in this contract, all claims, counter -claims, disputes and other matters in
question between the County and the Contractor, arising out of or relating to this contract, or the breach of
it, will be decided by arbitration, if the parties mutually agree, or in a Florida court of competent jurisdiction.
No Government Obligation to Third Parties (Applies to all subcontracts)
The County and the Contractor acknowledge and agree that, notwithstanding any concurrence by the
Federal Government in or approval of the solicitation or award of the underlying contract, absent the
express written consent by the Federal Government, the Federal Government is not a party to this contract
and shall not be subject to any obligations or liabilities to the Purchaser, Vendor, or any other party (whether
or not a party to that contract) pertaining to any matter resulting from the underlying contract. It is further
agreed that the clause shall not be modified, except to identify the subcontract who will be subject to its
provisions.
Disclaimer Provisions
The United States expressly disclaims any and all responsibility or liability to the County or third persons
for the actions of the County or third persons resulting in death, bodily injury, property damages, or any
other losses resulting in any way from the performance of this Award or any other losses resulting in any
way from the performance of this Award or any subaward, contract, or subcontract under this Award.
Prohibited and Criminal Activities
a. The Program Fraud Civil Remedies Act of 1986 (31 U.S.C. §§ 3801-3812), provides for the imposition
of civil penalties against persons who make false, fictitious, or fraudulent claims to the federal government
for money (including money representing grants, loans or other benefits).
b. False Statements, as amended (18 U.S.C. § 1001) provides that whoever makes or presents any
materially false, fictitious, or fraudulent statements to the United States shall be subject to imprisonment of
not more than five years.
c. False, Fictitious, or Fraudulent Claims, as amended (18 U.S.C. § 287) provides that whoever makes or
presents a false, fictitious, or fraudulent claim against or to the United States shall be subject to
imprisonment of not more than five years and shall be subject to a fine in the amount provided in 18 U.S.C.
§ 287.
d. False Claims Act, as amended (31 U.S.C. 18 U.S.C. § 3729 et seq.), provides that suits under this act
can be brought by the federal government, or a person on behalf of the federal government, for false claims

Council financial assistance award, except scientific articles or papers appearing in scientific, technical or
professional journals must contain the following disclaimer:

RESTORE Council. The statements, findings, conclusions, and

Affirmative Action

Revised ADA Standards for Accessible Design for Construction Awards
The U.S. Department of Justice has issued revised regulations implementing Title II of the ADA (28 C.F.R.
Part 35) and Title III of the ADA (28 C.F.R. Part 36). The revised regulations adopted new enforceable
accessibility standards called the "2010 ADA Standards for Accessible Design" (2010 Standards). The 2010
Standards are an acceptable alternative to the Uniform Federal Accessibility Standards (UFAS). Treasury
deems compliance with the 2010 Standards to be an acceptable means of complying with the Section 504
accessibility requirements for new construction and alteration projects. All new construction and alteration
projects must comply with the 2010 Standards.
Sub -Awards
(31 C.F.R. Part 34, 2 C.F.R. Part 200) the RESTORE Council's Financial Assistance Standard Terms and
Conditions, and the Consortium's Subrecipient Policy. All Contractors/Subcontractors under this Agreement
shall be subject to the same performance, financial, and reporting requirements as the County.
Unauthorized Employment (Applicable to all subcontracts.)
The employment of unauthorized aliens by any Contractor/subcontractor is considered a violation of
Section 274A(e) of the Immigration and Nationality Act. If the Contractor/subcontractor knowingly
employs unauthorized aliens, such violation shall be cause for unilateral cancellation of this
Agreement.
Copyright, Patent, and Trademark
The RESTORE Council and the Consortium reserve a royalty -free, nonexclusive, and irrevocable license
to reproduce, publish or otherwise use, and to authorize others to use, for federal and Consortium
purposes: a) The copyright in any work developed under this Award, including pursuant to any sub -award
or subcontract. b) Any right or copyright to which a Subrecipient, sub-subrecipient, or a contractor
purchases ownership with funds pursuant to this Award. C) All patent rights, copyrights and data rights must
be in accordance with 2 C.F.R.§200.315 and 37 C.F.R. Part 401, as applicable.
Records Retention
The Contractor must retain all records pertinent to this project for a period of three years, beginning on a
date as described in 2 C.F.R. § 200.333.
Drug Free Workplace Requirements
All Contractors entering into Federal funded contracts over the simplified acquisition threshold (as
defined at 41 U.S.C. § 134) must comply with the Drug Free Workplace Act of 1988 (41 U.S.C. 8102),
which requires the County and its to take certain actions to provide a drug -free workplace.

Copeland Anti Kick Back Act
The Contractor shall comply with all the requirements of the Copeland Anti -Kickback Act (18 U.S.C.
§ 874 and 40 U.S.C. § 3145, as supplemented by Department of Labor regulations at 29 CFR Part
3), which are incorporated by reference to this Agreement. County and its contractors are prohibited
from inducing by any means any person employed in the construction, completion or repair of public
work to give up any part of the compensation to which he or she is otherwise entitled.
Debarment/Suspension
Applicants or bidders for a lower tier covered transaction (except procurement contracts for goods and
services under $25,000 not requiring the consent of a Council official) are subject to 2 C.F.R. Part 180,
"OMB Guidelines to Agencies on Governmentwide Debarment and Suspension (Non procurement)." In
addition, applicants or bidders for a lower tier covered transaction for a subaward, contract, or
subcontract greater than $100,000 of Federal funds at any tier are subject to relevant statutes, including

Contractors that apply or bid for an award exceeding $100,000 must file the required certification. Each
tier certifies to the tier above that it will not and has not used Federal appropriated funds to pay any
person or organization for influencing or attempting to influence an officer or employee of any agency,
a member of Congress, officer or employee of Congress, or an employee of a member of Congress in
connection with obtaining any Federal contract, grant or any other award covered by 31 U.S.C. § 1352.
Each tier must also disclose any lobbying with non -Federal funds that takes place in connection with
obtaining any Federal award. Such disclosures are forwarded from tier to tier up to the non -Federal
award. The Contractor shall certify compliance.
Contractors must certify it will not and has not used Federal appropriated funds that have been paid or will

Contractors and subcontractors must submit form SF-LLL to the County with 15 calendar days following

501(c)(4) Entities
T he County shall ensure that its Contractors and Subcontractors comply with the requirement described
in Section 501(c)(4) of the Internal Revenue Code that prohibits any organization that engages in lobbying
activities, from receiving federal funds, including through an award, grant, and/or subgrant.
Federal Changes
The Contractor and subcontractors shall comply with all applicable Federal agency regulations, policies,
procedures and directives, including without limitation those listed directly or by reference, as they may
be amended or promulgated from time to time during the term of the contract.

Safeguarding Personal Identifiable Information
The Contractor and its subcontractors will take reasonable measures to safeguard protected
personally identifiable information and other information designated as sensitive by the awarding
agency or is considered sensitive consistent with applicable Federal, state and/or local laws regarding
privacy and obligations of confidentiality.
Energy Policy and Conservation Act (43 U.S.C. §6201)
The Contractor shall comply with mandatory standards and policies relating to energy efficiency,
stating in the state energy conservation plan issued in compliance with the Energy Policy and
Conservation Act. (Pub. L. 94-163, 89 Stat. 871) [53 FR 8078, 8087, Mar. 11, 1988, as amended at 60
FR 19639, 19645, Apr. 19, 1995].
Right to Inventions Under Federal Grants
If applicable, the County and its Contractors/subcontractors shall comply with the requirements of 37
C.F.R. part 401, "Rights to Inventions Made by Nonprofit Organizations and Small Business Firms
Under Government Grants, Contracts and Cooperative Agreements," and any implementing
regulations issued by the awarding agency.
Federal Non -Discrimination Provisions
No person in the United States shall, on the ground of race, color, national origin, handicap, age, religion,
or sex, be excluded from participation in, be denied the benefits of, or be subject to discrimination under
any program or activity receiving federal financial assistance. The Contractor is required to comply with all
non-discrimination requirements summarized in this section, and to ensure that all contracts/subcontracts
contain these nondiscrimination requirements. The Contractor shall comply with all of the following
federally mandated non-discrimination requirements, as applicable:
1. Title VI of the Civil Rights Act of 1964 (42 U.S.C. §§ 2000d etseq.) prohibits discrimination on the

Dear Members of the Selection Committee:
Earth Tech Environmental (ETE) has reviewed the referenced solicitation and is confident that our
team has the personnel, expertise, and local knowledge to exceed Collier County's environmental
consulting needs. We appreciate the opportunity to demonstrate our qualifications and project
approach to the committee.
ETE was a member of the team chosen under RPS #18-7425 that began implementation of the CWIP
in 2018. Along with Taylor Engineering, ETE coordinated with stakeholder agencies and authored the
monitoring plan that is the subject of this current RPS.
In February of 2019, ETE installed the monitoring wells, equipment, transects, and quadrats as detailed
in the monitoring plan. This included "value engineering" the locations of wells and transects to allow
for more efficient access. Often locations that made sense on paper didn't make sense in the field
because trails didn't exist.
Throughout 2019, we collected the vegetation, water level, and water quality data according to the
approved monitoring plan. To date we have compiled the massive amount of data generated by the
fieldwork into a baseline monitoring report for the CWIP. Our team is very excited by the opportunity
to continue the work we started in 2018. No firm understands the challenges of this project better
than we do — this includes equipment needs, access, high water levels, and coordination with the
Picayune Strand State Forest (PSSF) or Rookery Bay.
ETE's experience from the beginning of the CWIP implementation offers Collier County two (2) distinct
advantages:
1. Consistency: This includes consistency of the team and consistency of the data collection. We
have relationships with the stakeholders, other CWIP team members, and agency personnel that
are all familiar with the project. Our team has collected all the data thus far — there won't be any
concern of observational bias because if we are chosen to continue the monitoring activities, the
same ecologists will be taking the data.
2. Efficiency and Cost Savings: We can resume this project immediately. There is no learning curve
and we know the conditions. Access throughout the PSSF in the summer is extremely challenging.
Because of our experiences in 2019, we have already adapted our materials and methods. This
translates into savings of both time and money moving forward.

It's not an exaggeration to say that our team has shed its share of blood, sweat, and tears in the
Picayune. That being said, I think they would all agree the CWIP has been one of the most rewarding

Mr. McAuley joined Earth Tech Environmental, LLC (ETE) in 2017 and brings with him 8
years of experience working as a Hydrogeologist II and Environmental Consultant in New
York State prior to moving to Florida. Andrew graduated from Hofstra University with a
Bachelor of Science Degree in Geology. Since joining ETE he has been able to apply his
past experience from New York on a variety of projects as well as become extensively
familiar with Ecological based assessments and agency regulations.
Relevant Experience
Andrew's extensive background includes Phase I Environmental Site Assessments (ESAs),
Phase II ESAs, Phase III remedial oversight, AST/UST removal, Soil/Groundwater/Indoor
Air Quality sampling reporting, Mold/Lead/Asbestos sampling and remedial protocol
reporting. In New York Andrew has overseen various projects including Brownfields
sites, Landfill Gas Extraction System installation, Monitoring Well/Remediation System
Installation/Maintenance, and multiple Chemical/Petroleum/Bio-Hazard Waste Cleanup
projects.

Mr. Goulding joined Earth Tech Environmental LLC in 2019 and holds the position of GIS
Technician / Ecologist. His duties and responsibilities include creating a wide variety of
maps blending natural and urban environments, ranging in scale from site plans for single
family homes to FLUCCS maps for potential community properties. This goes along with
field work that includes GPS mapping using a Trimble Geo 7X to determine preserve
boundaries, mangrove channel mapping, and conducting tree inventories. His familiarity
with southwest Florida ecosystems encompasses estuarine and marine ecosystems, which

Collier County Watershed Improvement Plan
2018 - Present
In 2018, ETE was chosen by Collier County to develop and
implement the baseline data collection for the Collier County
Watershed Improvement Project (CWIP). ETE authored a
monitoring plan for the project that includes installation of 60
water level monitoring wells and 60 vegetation monitoring
transects in the Picayune Strand State Forest (PSSF) and Rookery
Bay National Estuarine Research Reserve (RBNERR). ETE
installed all 60 wells and vegetation monitoring transects in
2019. Throughout 2019 quarterly monitoring well downloads
and water quality sampling was conducted. ETE compiled
the data collected from 2019 into a Draft Baseline Monitoring
Report. This data will be fed into models that will assist in design
of various water diversion structures. ETE is currently assisting
the project engineer with acquiring a conceptual ERP permit for
the construction of the project.

Clam Bay Estuary
2015 - Present
Since 2015, ETE has been the biological monitors for the Clam
Bay Estuary. Working for the Pelican Bay Services Division (PBSD),
ETE monitors and provides management recommendations for
Clam Bay. ETE provides a variety of services including mangrove
monitoring, shorebird monitoring, seagrass monitoring, gopher
tortoise surveys, tide gauge maintenance, bird rookery monitoring,
and archeological site monitoring. For mangroves, ETE monitors
twenty-one (21) plots bi-annually with data collected down
to the individual tree level utilizing tree tags. ETE produces a
comprehensive annual report that summarizes all field data
accumulated over the course of the year. In 2019, ETE was awarded
an additional three (3) year contract for these services and has
since completed the 2019 annual monitoring report. Monitoring
for the 2020 annual monitoring report is currently underway by
ETE.

Collier County Sports Complex
2018 - Present
The Sports Center and Events Complex is Collier County facility
being constructed at 1-75 and Collier Boulevard. Half of the
complex is located on the City Gate property and the other half on
120 acres of adjacent land owned by Collier County. ETE partner,
Jeremy Sterk, has been involved with the City Gate property
since 2004. Mr. Sterk has handled all environmental consulting,
permitting, and mitigation activities for City Gate, which included
all field data collection, ERP permitting with the South Florida
Water Management District (SFWMD), Incidental Take Permitting
(ITP) with the US Fish & Wildlife Service (USFWS) for Red Cockaded
Woodpecker (RCW) & Florida Panther, gopher tortoise permitting
& relocations with the Florida Fish & Wildlife Conservation
Commission (FWC), Environmental Impact Statements (EIS) for
Plats, & SDP's with Collier County, as well as mitigation design and
implementation -including offsite land purchases, mitigation on
State land, & a 1.5 million dollar wildlife crossing. ETE is currently
pursuing all environmental entitlements on the 2nd phase (120
acres) of the Sports Center through local, State and Federal
agencies.

Wiggins Pass Dredging
2018 & 2019
ETE was the turbidity monitor for the Wiggins Pass dredging event
in 2018 and 2019. ETE assisted Collier County and the project
engineer with benthic surveys, seagrass surveys, and permitting
support for the Wiggins Pass \ Water Turkey Bay dredging event
in 2019. Additionally, ETE was the turbidity monitor for Caxambas
Pass when Wiggins Pass was completed. In the last several

PROJECT APPROACH
Earth Tech Environmental's (ETEs) proposed approach centers around consistency, cost-effectiveness,
and our extensive knowledge of this project and the Picayune Strand State Forrest (PSSF). ETE has
been involved with this project since its onset and is responsible for creating and implementing the
multi -agency approved Monitoring Plan for this project dated February 14, 2019. The purpose of
this Monitoring Plan was to adequately evaluate potential changes in vegetative communities
and water quality that may occur with the implementation of the CWIP. The comprehensive
monitoring program will work hand -in -hand with the project and allow (if necessary) adaptive
management of the flow volumes released into the Picayune. Approved monitoring locations were
selected by ETE within and outside of the core flowway based on extensive field scouting,
accessibility, property ownership research, coordination with FFS, FDEP (Rookery Bay), FWC,
Taylor Engineering, and Collier County. ETE installed the framework, conducted the monitoring,
compiled the data, and created a 2019 Draft Baseline Monitoring Report discussed in the Detailed
Scope of Work within this RPS meeting the initial time and budget requirements of the project.
ETE's project approach will be to continue the hard work that has already been started.
WILLINGNESS TO MEET TIME AND BUDGET REQUIREMENTS
ETE staff is comprised of well trained and experienced ecologists, equipped with the proper tools
and vehicles, that have established the foundation for the monitoring services of this project. During
the 2019 installation and subsequent quarterly monitoring events, ETE has gained an immense
amount of knowledge and overcame challenges that came with the initial project onset. The sixty (60)
monitoring locations are located predominantly in the PSSF, however several locations are on Rookery
Bay property (FDEP), Collier County property (Manatee Road Parcel), and within private communities
(Winding Cypress, Fiddler's Creek) abutting the PSSF. ETE has established and maintained constant
communication with these parties regarding access and protective measures for the County's
monitoring equipment. Moving forward ETE will utilize the same team and necessary equipment
that will allow for consistency of data, without bias, for the long term to achieve the goals of the
overall project. With the knowledge gained from the 2019 Baseline Monitoring ETE is focused on cost-
effectiveness and streamlining the future monitoring events to meet the County's time and budget
requirements.

Earth Tech Environmental typically has resources allocated at 80 to 90% for the upcoming 2 or 3
months. Staff priorities are based on project needs\priorities. Current staffing levels are targeted for
roughly 70% utilization at any given time, so more than adequate resources are available to continue
the CWIP. The team dedicated the the 2019 baseline monitoring event will continue to be allocated
for the duration of this scope of services.

The supplemental conditions contained in this section are intended to cooperate with, to supplement, and
to modify the general conditions and other specifications.
The County must comply, and require each of its contractors, and subcontractors employed in the
completion of the activity, project, or program to comply with all federal statutes, federal regulations,
executive orders (EOs), Office of Management and Budget (OMB) circulars, Standard Terms and
Conditions, Program -Specific Terms and Conditions, and any Special Award Conditions of this federal
financial assistance award ("Award"), as applicable, in addition to the certifications and assurances required
at the time of application.
Any inconsistency or conflict in Standard Terms and Conditions, Program -Specific Terms and Conditions,
and any Special Award Conditions of this Award will be resolved according to the following order of
precedence: federal laws, federal regulations, applicable notices published in the Federal Register, EOs,

Contractor means an entity that receives a contract. The services performed by the awarded Contractor

FEDERAL CONTRACT PROVISIONS
Administrative, Contractual, or Legal Remedies (Ref. 41 U.S.C. 1908, 2 CFR § 200 Appendix 11 (A)
Unless otherwise provided in this contract, all claims, counter -claims, disputes and other matters in
question between the County and the Contractor, arising out of or relating to this contract, or the breach of
it, will be decided by arbitration, if the parties mutually agree, or in a Florida court of competent jurisdiction.
No Government Obligation to Third Parties (Applies to all subcontracts)
The County and the Contractor acknowledge and agree that, notwithstanding any concurrence by the
Federal Government in or approval of the solicitation or award of the underlying contract, absent the
express written consent by the Federal Government, the Federal Government is not a parry to this contract
and shall not be subject to any obligations or liabilities to the Purchaser, Vendor, or any other party (whether
or not a party to that contract) pertaining to any matter resulting from the underlying contract. It is further
agreed that the clause shall not be modified, except to identify the subcontract who will be subject to its
provisions.
Disclaimer Provisions
The United States expressly disclaims any and all responsibility or liability to the County or third persons
for the actions of the County or third persons resulting in death, bodily injury, property damages, or any
other losses resulting in any way from the performance of this Award or any other losses resulting in any
way from the performance of this Award or any subaward, contract, or subcontract under this Award.
Prohibited and Criminal Activities
a. The Program Fraud Civil Remedies Act of 1986 (31 U.S.C. §§ 3801-3812), provides for the imposition
of civil penalties against persons who make false, fictitious, or fraudulent claims to the federal government
for money (including money representing grants, loans or other benefits).
b. False Statements, as amended (18 U.S.C. § 1001) provides that whoever makes or presents any
materially false, fictitious, or fraudulent statements to the United States shall be subject to imprisonment of
not more than five years.
c. False, Fictitious, or Fraudulent Claims, as amended (18 U.S.C. § 287) provides that whoever makes or
presents a false, fictitious, or fraudulent claim against or to the United States shall be subject to
imprisonment of not more than five years and shall be subject to a fine in the amount provided in 18 U.S.C.
§ 287.
d. False Claims Act, as amended (31 U.S.C. 18 U.S.C. § 3729 et seq.), provides that suits under this act
can be brought by the federal government, or a person on behalf of the federal government, for false claims
under federal assistance programs
Publications
Every publication of material based on, developed under, or otherwise produced under a RESTORE
Council financial assistance award, except scientific articles or papers appearing in scientific, technical or
professional journals must contain the following disclaimer:
"This [publication/video/etc.] was prepared by [Subrecipient] using Federal
funds under award [Federal Award Identification Number] from the
RESTORE Council. The statements, findings, conclusions, and
recommendations are those of the author(s) and do not necessarily reflect
the views of the RESTORE Council."
Affirmative Action
The County supports diversity in its procurement program and requires that all subcontracting opportunities
afforded by this Agreement embrace and encourage diversity. The County's award of subcontracts reflect
the diversity of the citizens of the State of Florida. In accordance with 2 C.F.R. § 200.321, Contractors must
take all necessary affirmative steps to assure that minority businesses, women's business enterprises, and
labor surplus area firms are used when possible. Such affirmative steps shall at a minimum include:

maximum participation by small and minority businesses and women's business enterprises;
4. Establishing delivery schedules, where the requirement permits, which encourage participation by
small and minority businesses, or women's business enterprises;
5. Utilizing services and assistance, as appropriate, of such organizations as the Small Business
Administration, the Minority Business Development Agency of the Department of the Commerce, the
Florida Department of Management Services (Office of Supplier Diversity), the Florida Department of
Transportation, Minority Business Development Center, and Local Government M/DBE programs; and
6. Requiring the prime contractor, if subcontracts are to be let, to take the affirmative steps listed above
in (1) through(5).
7. As used herein, the term "minority and women business enterprise" means a business at least fifty-
one (51) percent owned and controlled by minority group members or women. Prior to award of
any subcontract under this Agreement, Subrecipient shall document its efforts made to comply
with the requirements of this paragraph. The Subrecipient shall state.
Revised ADA Standards for Accessible Design for Construction Awards
The U.S. Department of Justice has issued revised regulations implementing Title II of the ADA (28 C.F.R.
Part 35) and Title III of the ADA (28 C.F.R. Part 36). The revised regulations adopted new enforceable
accessibility standards called the "2010 ADA Standards for Accessible Design" (2010 Standards). The 2010
Standards are an acceptable alternative to the Uniform Federal Accessibility Standards (UFAS). Treasury
deems compliance with the 2010 Standards to be an acceptable means of complying with the Section 504
accessibility requirements for new construction and alteration projects. All new construction and alteration
projects must comply with the 2010 Standards.
Sub -Awards
(31 C.F.R. Part 34, 2 C.F.R. Part 200) the RESTORE Council's Financial Assistance Standard Terms and
Conditions, and the Consortium's Subrecipient Policy. All Contractors/Subcontractors under this Agreement
shall be subject to the same performance, financial, and reporting requirements as the County.
Unauthorized Employment (Applicable to all subcontracts.)
The employment of unauthorized aliens by any Contractor/subcontractor is considered a violation of
Section 274A(e) of the Immigration and Nationality Act. If the Contractor/subcontractor knowingly
employs unauthorized aliens, such violation shall be cause for unilateral cancellation of this
Agreement.
Copyright, Patent, and Trademark
The RESTORE Council and the Consortium reserve a royalty -free, nonexclusive, and irrevocable license
to reproduce, publish or otherwise use, and to authorize others to use, for federal and Consortium
purposes: a) The copyright in any work developed under this Award, including pursuant to any sub -award
or subcontract. b) Any right or copyright to which a Subrecipient, sub-subrecipient, or a contractor
purchases ownership with funds pursuant to thisAward. C) All patent rights, copyrights and data rights must
be in accordance with 2 C.F.R.§200.315 and 37 C.F.R. Part 401, as applicable.
Records Retention
The Contractor must retain all records pertinent to this project for a period of three years, beginning on a
date as described in 2 C.F.R. § 200.333.
Drug Free Workplace Requirements
All Contractors entering into Federal funded contracts over the simplified acquisition threshold (as
defined at 41 U.S.C. § 134) must comply with the Drug Free Workplace Act of 1988 (41 U.S.C. 8102),
which requires the County and its to take certain actions to provide a drug -free workplace.

Copeland Anti Kick Back Act
The Contractor shall comply with all the requirements of the Copeland Anti -Kickback Act (18 U.S.C.
§ 874 and 40 U.S.C. § 3145, as supplemented by Department of Labor regulations at 29 CFR Part
3), which are incorporated by reference to this Agreement. County and its contractors are prohibited
from inducing by any means any person employed in the construction, completion or repair of public
work to give up any part of the compensation to which he or she is otherwise entitled.
Debarment/Suspension
Applicants or bidders for a lower tier covered transaction (except procurement contracts for goods and
services under $25,000 not requiring the consent of a Council official) are subject to 2 C.F.R. Part 180,
"OMB Guidelines to Agencies on Governmentwide Debarment and Suspension (Non procurement)." In
addition, applicants or bidders for a lower tier covered transaction for a subaward, contract, or
subcontract greater than $100,000 of Federal funds at any tier are subject to relevant statutes, including
among others, the provisions of 31 U.S.C. 1352, as well as the common rule, "New Restrictions on
Lobbying," published at 55 FR 6736 (February 26, 1 990), including definitions, and the Office of
Management and Budget "Governmentwide Guidance for New Restrictions on Lobbying," and notices
published at 54 FR 52306 (December 20, 1989), 55 FR 24540 (June 15, 1990), 57 FR 1772 (January 15,
1992), and 61 FR 1412 (January 19, 1996)
Byrd Anti -Lobbying Amendment (31 U.S.C. § 1352) (Reference 2 CFR § 200 Appendix II (J))
Contractors that apply or bid for an award exceeding $100,000 must file the required certification. Each
tier certifies to the tier above that it will not and has not used Federal appropriated funds to pay any
person or organization for influencing or attempting to influence an officer or employee of any agency,
a member of Congress, officer or employee of Congress, or an employee of a member of Congress in
connection with obtaining any Federal contract, grant or any other award covered by 31 U.S.C. § 1352.
Each tier must also disclose any lobbying with non -Federal funds that takes place in connection with
obtaining any Federal award. Such disclosures are forwarded from tier to tier up to the non -Federal
award. The Contractor shall certify compliance.
Contractors must certify it will not and has not used Federal appropriated funds that have been paid or will
be paid, by or to any person or organization for influencing or attempting to influence an officer or employee
of an agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of
Congress in connection with the awarding of any Federal contract, the making of any Federal grant, the
making of any Federal loan, the entering into of any cooperative agreement, and the extension,
continuation, renewal, amendment, or modification of any Federal contract, grant, loan, or cooperative
agreement. The certification includes any lobbying with non -Federal funds that takes place in connection
with obtaining any Federal award.
Contractors and subcontractors must submit form SF-LLL to the County with 15 calendar days following
the end of the calendar quarter in which there occurs any event that requires disclosure or that materially
affects the accuracy of the information contained in any disclosure from previously filed.
501(c)(4) Entities
The County shall ensure that its Contractors and Subcontractors comply with the requirement described
in Section 501(c)(4) of the Internal Revenue Code that prohibits any organization that engages in lobbying
activities, from receiving federal funds, including through an award, grant, and/or subgrant.
Federal Changes
The Contractor and subcontractors shall comply with all applicable Federal agency regulations, policies,
procedures and directives, including without limitation those listed directly or by reference, as they may
be amended or promulgated from time to time during the term of the contract.

Safeguarding Personal Identifiable Information
The Contractor and its subcontractors will take reasonable measures to safeguard protected
personally identifiable information and other information designated as sensitive by the awarding
agency or is considered sensitive consistent with applicable Federal, state and/or local laws regarding
privacy and obligations of confidentiality.
Energy Policy and Conservation Act (43 U.S.C. §6201)
The Contractor shall comply with mandatory standards and policies relating to energy efficiency,
stating in the state energy conservation plan issued in compliance with the Energy Policy and
Conservation Act. (Pub. L. 94-163, 89 Stat. 871) [53 FR 8078, 8087, Mar. 11, 1988, as amended at 60
FR 19639, 1 9645, Apr. 19, 1995].
Right to Inventions Under Federal Grants
If applicable, the County and its Contractors/subcontractors shall comply with the requirements of 37
C.F.R. part 401, "Rights to Inventions Made by Nonprofit Organizations and Small Business Firms
Under Government Grants, Contracts and Cooperative Agreements," and any implementing
regulations issued by the awarding agency.
Federal Non -Discrimination Provisions
No person in the United States shall, on the ground of race, color, national origin, handicap, age, religion,
or sex, be excluded from participation in, be denied the benefits of, or be subject to discrimination under
any program or activity receiving federal financial assistance. The Contractor is required to comply with all
non-discrimination requirements summarized in this section, and to ensure that all contracts/subcontracts
contain these nondiscrimination requirements. The Contractor shall comply with all of the following
federally mandated non-discrimination requirements, as applicable:
1. Title VI of the Civil Rights Act of 1964 (42 U.S.C. §§ 2000d etseq.) prohibits discrimination on the
grounds of race, color, or national origin under programs or activities receiving federal financial
assistance;
2. Title IX of the Education Amendments of 1972 (20 U.S.C. §§ 1681 etseq.) prohibits discrimination
on the basis of sex under federally assisted education programs or activities;
3. Americans with Disabilities Act of 1990 (ADA) (42 U.S.C. §§ 12101 etseq.) including the ADA
Amendments Act of 2008 (Public Law 110-325, ("ADAAK), prohibits discrimination on the basis of

4. ® Indemnification
To the maximum extent permitted by Florida law, the Contractor/Vendor shall defend,
indemnify and hold harmless Collier County, its officers and employees from any and
all liabilities, damages, losses and costs, including, but not limited to, reasonable
attorneys' fees and paralegals' fees, to the extent caused by the negligence,
recklessness, or intentionally wrongful conduct of the Contractor/ Vendor or anyone
employed or utilized by the Contractor/Vendor in the performance of this Agreement.

7. ❑ Bid bond Shall be submitted with proposal response in the form of certified funds, cashiers'
check or an irrevocable letter of credit, a cash bond posted with the County Clerk, or
proposal bond in a sum equal to 5% of the cost proposal. All checks shall be made
payable to the Collier County Board of County Commissioners on a bank or trust
company located in the State of Florida and insured by the Federal Deposit Insurance
Corporation.
8. ❑ Performance and Payment For projects in excess of $200,000, bonds shall be submitted with the executed
Bonds contract by Proposers receiving award, and written for 100% of the Contract award
amount, the cost borne by the Proposer receiving an award. The Performance and
Payment Bonds shall be underwritten by a surety authorized to do business in the
State of Florida and otherwise acceptable to Owner; provided, however, the surety
shall be rated as "A-" or better as to general policy holders rating and Class V or
higher rating as to financial size category and the amount required shall not exceed
5% of the reported policy holders' surplus, all as reported in the most current Best
Key Rating Guide, published by A.M. Best Company, Inc. of 75 Fulton Street, New
York, New York 10038.
9. ® Vendor shall ensure that all subcontractors comply with the same insurance requirements that he is required to meet. The
same Vendor shall provide County with certificates of insurance meeting the required insurance provisions.
10. ® Collier County must be named as "ADDITIONAL INSURED" on the Insurance Certificate for Commercial General
Liability where required. This insurance shall be primary and non-contributory with respect to any other insurance maintained
by, or available for the benefit of, the Additional Insured and the Vendor's policy shall be endorsed accordingly.
11. ® The Certificate Holder shall be named as Collier County Board of County Commissioners, OR, Board of County
Commissioners in Collier County, OR Collier County Government, OR Collier County. The Certificates of Insurance must state
the Contract Number, or Project Number, or specific Project description, or must read: For any and all work performed on
behalf of Collier County.

12. ® On all certificates, the Certificate Holder must read: Collier County Board of County Commissioners, 3295 Tamiami
Trail East, Naples, FL 34112
13. ® Thirty (30) Days Cancellation Notice required.
14. Collier County shall procure and maintain Builders Risk Insurance on all construction projects where it is deemed necessary.
Such coverage shall be endorsed to cover the interests of Collier County as well as the Contractor. Premiums shall be billed to
the project and the Contractor shall not include Builders Risk premiums in its project proposal or project billings. All questions
regarding Builder's Risk Insurance will be addressed by the Collier County Risk Management Division.
