Agenda 09/08/2020 Item #16F3 (2nd Amendment to #16-6571)09/08/2020 EXECUTIVE SUMMARY Recommendation to approve the attached Second Amendment to Agreement No. 16-6571 with Tindale Oliver & Associates Inc., pertaining to the provision of professional Impact Fee Study services. OBJECTIVE: To approve a Second Amendment to Agreement No. 16-6571 (the “Agreement”), providing for an increase to the individual Purchase Order threshold to the maximum sum allowable by law under the CCNA and agreed upon in writing by the parties. CONSIDERATIONS: The Board awarded Request for Proposal No. 16-6571, “Impact Fee Study,” and entered in Agreement No. 16 -6571 with Tindale Oliver & Associates, Inc. (“Tindale”) to provide Impact Fee consulting services on September 13, 2016 (Agenda Item 16.F.2). On July 14, 2020 (Agenda Item 16.F.2), the Board approved the First Amendment to the Agreement, which provides for an additional one-year renewal term, or until a new contract can be solicited and awarded by the Board, whichever is sooner, and a $200,000 increase to the maximum amount that can be expended under the Agreement through the renewal term. The Agreement, as amended, is currently scheduled to terminate on September 12, 2021. Currently, the maximum allowable single purchase order amount is $200,000, which was the maximum sum allowable by law at the time the Board approved the Agreement in 2016. Effective July 1, 2020, the maximum allowable fee for professional services for each individual study under the CCNA increased from $200,000 to $500,000. The attached proposed Second Amendment t o Agreement No. 16-6571 will amend the Agreement to comport with the current maximum allowable fee limits for individual study activities. FISCAL IMPACT: The cost of impact fee update studies and indexing are funded by the applicable Impact Fee Trust Funds. General impact fee consulting costs are budgeted through the Impact Fee Administration, Fund 107. Funding is available for the purchase orders that may be issued in the remaining Fiscal Year 2020 and will be similarly budgeted for projects in Fiscal Year 2021. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. -SRT RECOMMENDATION: To approve the attached Second Amendment to Agreement No. 16 -6571, providing for an increase to the individual Purchase Order threshold from $200,000 to the maximum sum allowable by law under the Consultant’s Competitive Negotiation Act, Section 287.055, as amended, and as agreed upon in writing by the parties, and to authorize the Chairman to sign the attached Amendment.
