Agenda 09/08/2020 Item #16A16 (Randall Blvd Project)09/08/2020 EXECUTIVE SUMMARY Recommendation to approve an agreement for the purchase of land (Parcel POND3EB) required for construction of the Randall Boulevard Project (Project 60065) in the estimated amount of $126,320. OBJECTIVE: To purchase a parcel of land (Parcel POND3EB) required for the construction of the Randall Boulevard Project (Project 60065). CONSIDERATIONS: Collier County is seeking to purchase Parcel POND3EB (the Property), consisting of an estimated 3.03 acres of vacant land owned by Cecil and Shirley Brown. This irregular flag-shaped parcel is situated on the south side of Randall Boulevard adjacent to the Golden Gate Main Canal. It is needed for the construction of a pond site as part of the Project improvements. The County is at present, not actively acquiring land or right-of-way for the Project. However, Mr. Brown has had off and on negotiations with staff over several years regarding the purchase of these lands for County use. His asking price has varied over the years (depending on market conditions) to as high as $200,000. Recent negotiations have settled on a purchase price of $125,000, which is in-line (within 3%) of its current market value as estimated by in-house appraisal staff (see valuation memo attached). Moreover, the chance to purchase these lands at a reasonable price locks-in a valuable component parcel needed for the future Randall Blvd road widening project. Rapid development in the area very much reduced the number of vacant sites suited for pond site use. Staff recommends that the Board of County Commissioners (Board) approve this opportunity purchase. FISCAL IMPACT: Funds in the amount of $126,320 will be required, the purchase price of $125,000 plus title commitment, title insurance, recording, and miscellaneous closing fees estimated not to exceed $1,320. Funds are currently available for title work in Project 60065. The remainder of the funding, required to close the transaction is included in the Fiscal Year 2021 proposed budget. The primary funding source for the acquisition of right-of-way is impact fees. Should impact fees not be available, the secondary funding source will be gas taxes. No maintenance costs are anticipated until such time as the Project is constructed. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Transportation Plan and the Collier County Growth Management Plan. RECOMMENDATION: . Approve the attached purchase agreement and authorize the Chairman to execute the same on behalf of the Board; . Accept the conveyance of Parcel POND3EB and authorize the County Manager, or his designee, to record the conveyance instrument in the public records of Collier County, Florida; . Authorize the payment of all costs and expenses that Collier County is required to pay under the terms of the purchase agreement to close the transaction; . Authorize the County Manager or his designee to take the necessary measures to ensure the County’s performance in accordance with the terms and conditions of the purchase agreement; and . Authorize any, and all, budget amendments that may be required to carry out the collective will of the Board.
