EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign a Collier County Landscape
Maintenance Agreement (“Agreement”) between Collier County and Naples Livingston, LLC, for
developer funded landscape and irrigation improvements within the intersection of Livingston
Road and Radio Road public right-of-way.
OBJECTIVE: That the Board of County Commissioners (Board) approves and authorizes the Chairman
to sign the attached Collier County Landscape Maintenance Agreement permitting landscaping and
irrigation improvements within the County right-of-way and ensuring that Naples Livingston, LLC, will
maintain improvements accordingly.
CONSIDERATIONS: Collier County was approached by Naples Livingston, LLC, to install
landscaping and irrigation at the intersection of Radio Road and Livingston Road public right-of-way.
Pursuant to the attached Landscape Maintenance Agreement, the Naples Livingston, LLC agrees to
maintain the landscaping and irrigation improvements along Radio Road and Livingston Road, as
depicted in Schedule A and in accordance with the specifications in Schedule B. Rights to terminate the
Agreement are spelled out in the attached Agreement.
FISCAL IMPACT: There is no cost to Collier County associated with this proposal. The developer,
Naples Livingston, LCC, shall bare the full cost of constructing and maintaining the approved landscape
and irrigation improvements and is responsible for all recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -SAA
RECOMMENDATION: To sign a Collier County Landscape Maintenance Agreement between Collier
County and Naples Livingston, LLC, for landscaping and irrigation improvements within the intersection
of Livingston Road and Radio Road public right-of-way.
