Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to approve a Resolution of the Board of Zoning Appeals relating to VA-PL20190002360 for a variance from Land Development Code Section 5.03.06 to reduce the minimum side yard riparian setbacks to zero, for the benefit of Lot 8, Block G, Little Hickory Shores, Unit 3 Replat subdivision, also known as 267 3rd Street W. in Section 5, Township 48 South, Range 25 East, Collier County, Florida. OBJECTIVE: To have the Board of County Commissioners (Board) review staff’s findings and recommendations along with the recommendations of the Collier County Planning Commission (CCPC) regarding the above referenced petition, render a decision regarding this variance petition and ensure the project is in harmony with all the applicable codes and regulations in order to ensure that the community's interests are maintained. CONSIDERATIONS: The subject property is described as Lot 8, Block G, Little Hickory Shores Unit 3 Replat, also described as 267 3rd Street West, in Section 5, Township 48 South, Range 25 East, Collier County, Florida, consisting of 0.03± acres. Said property is l ocated within a Residential Single-Family-4 (RSF-4) Zoning District. The subject property is one of 23 lots on the north side of 3rd Street West that, having been platted with insufficient lot area to accommodate a principal structure, received Provisional Use approval (PU87-7C) by means of Resolution No. 87-260 which was approved by the Board of Zoning Appeals on October 27, 1987, to allow non-commercial boat launch facilities. The petitioner desires to construct a new dock facility comprising a single dock with two boat slips, each with a boat lift as depicted and approved by the Collier County Planning Commission by means of a companion Boat Dock Extension petition, BDE-PL20190001962; approval of the boat dock extension was conditioned upon the approval of the subject variance request, as the plans were produced using a zero side yard and/or side riparian line. The subject lot has less than 60 -linear feet of water frontage; therefore, as per Section 5.03.06.E.6 of the LDC, the required side and/or side r iparian setbacks are each 7.5 feet. Absent a variance; the applicant is unable to proceed with constructing a dock facility similar to those enjoyed by neighboring boat dock lots. Staff was able to determine that many neighboring dock facilities were subject to a previous variance request, V-99-26, that was brought forward on the behalf of the property owners of Lots 4, 5, 9 -12, 14, and 17-20; said variance petition was approved without conditions by means of Resolution 2000-51, adopted by the Board of Zoning Appeals on February 8, 2000, and reduced the required side yard setback of the listed properties from 7.5-feet to zero. Presumably, had the petitioner of the subject variance owned the subject property as the aforementioned variance was being moved forward, they could have joined in the zoning action; as they did not, they are here before the BZA at this time to obtain a variance on their own accord. Staff has reviewed the subject variance request and finds that the review criteria contained within LDC Section 9.04.03.A though H have been satisfied. Additionally, staff is of the belief that the subject lot has similar characteristics to those for which a zero-yard setback has previously been approved. As of this date, no opposition to the subject variance request has been received by staff. FISCAL IMPACT: The subject variance by and of itself will have no fiscal impact on Collier County. No fees or taxes were included in the criteria used by staff and the Planning Commission to analyze this petition. 17.G Packet Pg. 3511 07/14/2020 GROWTH MANAGEMENT IMPACT: The subject property is in the Urban Mixed Use District, Urban Residential Subdistrict, and is seaward of the Coastal High Hazard Area Boundary, on the County’s Future Land Use Map (FLUM) of the Future Land Use Element (FLUE) of the GMP. The GMP does not address individual Variance requests but deals with the larger issue of the actual use. The existing single-family use is consistent with the FLUM of the GMP. The requested variance does not have any impact on this property's consistency with the County's GMP. COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION: The CCPC heard petition VA-PL20190002360 on June 11, 2020, and by a vote of 6-0 recommended to forward this petition to the Board of Zoning Appeals with a recommendation of approval with no stipulations. There was no public opposition to the petition. As such, this petition will be placed on Summary Agenda. LEGAL CONSIDERATIONS: Petitioner is requesting a Variance from Land Development Code Section 5.03.06 to reduce the minimum side yard riparian setbacks to zero. The granting of such a Variance is permitted under LDC §9.04.00. The attached staff report and recommendations of the Planning Commission are advisory only and are not binding on you. All testimony given must be under oath. The Petitioner has the burden to prove that the proposed Variance is consistent with all the criteria set forth below, and you may question Petitioner, or staff, to satisfy yourself that the necessary criteria have been satisfied. LDC Section 10.09.00 F. requires that “Upon consideration of the Planning Commission’s report, findings and recommendations, and upon consideration of the standards and guidelines set forth [below], the Board of Zoning Appeals shall approve, by resolution, or deny a petition for a variance.” Should you consider denying the Variance, to assure that that your decision is not later found to be arbitrary, discriminatory or unreasonable, the denial must be based upon competent, substantial evidence that the proposal does not meet one or more of the listed criteria below. In granting any Variance, the Board of Zoning Appeals may prescribe the following: 1. Appropriate conditions and safeguards in conformity with the zoning code or other applicable county ordinances. Violation of such conditions and safeguards, when made a part of the terms under which the Variance is granted, shall be deemed a violation of the zoning code. 2. A reasonable time limit within which the action for which the Variance required shall be begun or completed or both. Criteria for Variances 1. There are special conditions and circumstances existing which are peculiar to the location, size, and characteristics of the land, structure, or building involved. 2. There are special conditions and circumstances which do not result from the action of the applicant, such as pre-existing conditions relative to the property which is the subject of the Variance request. 3. A literal interpretation of the provisions of the LDC work unnecessary and undue hardship on the applicant or create practical difficulties on the applicant. 4. The Variance, if granted, will be the minimum Variance that will make possible the reasonable use of the land, building, or structure and which promote standards of health, safety, or welfare. 5. Granting the Variance requested will not confer on the petitioner any special privilege that is denied by these zoning regulations to other lands, buildings, or structures in the same zoning district. 6. Granting the Variance will be in harmony with the intent and purpose of the LDC, and not be injurious to the neighborhood, or otherwise detrimental to the public welfare. 17.G Packet Pg. 3512 07/14/2020 7. There are natural conditions or physically induced conditions that ameliorate the goals and objectives of the regulation, such as natural preserves, lakes, golf course, etc. 8. Granting the Variance will be consistent with the GMP. This item has been approved as to form and legality, and requires a majority vote for Board approval.- SAA RECOMMENDATION: Staff concurs with the recommendation of the CCPC, which is reflected in the attached Resolution and recommends that the Board approve the applicant’s request for a variance from Section 5.03.06 to reduce the minimum side yard riparian setbacks to zero, as shown on the Proposed Site Plan attached to the Resolution as Exhibit “A,” in the RSF-4 zoning district. It will be constructed parallel to the neighboring docking facilities which have both received BDE and variances for side yard setbacks from Collier County. The dock will be 5-feet wide and will be approximately 3-feet above the mean high water and will have two boatlifts for two vessels up to 38-feet LOA. This variance petition seeks to reduce the riparian line setbacks to 0-feet as most of the other adjacent properties have already been granted through Resolution # 2000-51. The subject property and is zoned RSF-4 but is considered a boat dock lot which is allowed two boatlifts per the Collier County LDC. The limited amount of shoreline is the driving factor for this variance request as there is not enough area to construct a docking facility with two boatlifts without encroaching on the required riparian line setback. As proposed no setbacks are being provided which is consistent with the other docking facilities along the subject shoreline. 2. For projects authorized under LDC Section 9.04.02, provide a detailed description of site alterations, including any dredging and filling. The proposed structure will traverse through and require the removal of 415 square feet of mangroves. The project will otherwise not alter the site in any way. 3. Pursuant to LDC section 9.04.00, staff shall be guided in their recommendation to the Hearing Examiner, and the Hearing Examiner shall be guided in the determination to approve or deny a variance petition by the criteria (a-h) listed below. Please address the following criteria: a) Are there special conditions and circumstances existing which are peculiar to the location, size and characteristics of the land, structure, or building involved. Limited amount of shoreline which results in a narrow riparian area and constricting neighboring docking facilities significantly limit the direction and orientation of any potential docking facility in this location. As stated above, the property’s natural shoreline and length of shoreline requires additional protrusion due to the narrow riparian lines which results in docks along this subject shoreline to require a variance from riparian setbacks in order to comply with Collier County’s LDC. c) Will a literal interpretation of the provisions of this zoning code work unnecessary and undue hardship on the applicant or create practical difficulties on the applicant. Yes. The denial of this petition request would prevent any use of the applicant’s shoreline for the purpose of mooring and storing two vessels which is allowed for every RSF-4 residential property. d) Will the variance, if granted, be the minimum variance that will make possible the reasonable use of the land, building or structure and which promote standards of health, safety or welfare. Yes. The proposed docking facility has been reduced to the minimum size and still provide safe access. Also, the proposed docking facility is consistent with the numerous other docking facilities along this shoreline that have been previously granted BDE’s and setback variances. e) Will granting the variance requested confer on the petitioner any special privilege that is denied by these zoning regulations to other lands, buildings, or structures in the same zoning district. No. Several of the neighboring lots already contain similar docking facilities that also required a BDE and setback variances. f) Will granting the variance be in harmony with the intent and purpose of this zoning code, and not be injurious to the neighborhood, or otherwise detrimental to the public welfare. The variance is for a docking facility that will not affect the functionality of any surrounding lots but allow this property to be consistent with the others along the same subject shoreline. g) Are there natural conditions or physically induced conditions that ameliorate the goals and objectives of the regulation such as natural preserves, lakes, golf course, etc. The variance will allow the construction of a private docking facility, which will increase the recreational value of the property and the Little Hickory Shores area. h) Will granting the variance be consistent with the Growth Management Plan? Yes.
