Agenda 07/14/2020 Item #16F 4 (Budget Amendments for Agencies within the Courts System)07/14/2020 EXECUTIVE SUMMARY Recommendation to authorize budget amendments totaling $286,500 that will provide funding for various agencies within the Courts System to cover Article V revenue shortfall for the balance of FY 2020. OBJECTIVE: Obtain Board authorization for budget amendments that provide cash from the General Fund (001) reserves to assist in covering the shortfall of Article V revenues the Courts are experiencing during the current fiscal year. CONSIDERATIONS: Section 939.185, Florida Statutes, allows each county to adopt a county ordinance assessing additional court costs not to exceed $65 under Article V of the Florida Constitution. Collier County adopted Ordinance No. 04-42 on June 22, 2004. This ordinance established the programs and their respective percentages they are to receive from these revenues. The revenues have declined over the year with the budgets being limited as well. There has been a decline in revenue for Court Administration Fund (681) which supports Article V with a transfer into the appropriate Article V Funds. The decline in revenue is a result of crime being down in Collier County which results in fewer criminal cases being filed. Our diversion programs along with our problem -solving courts (Mental Health, Drug court and Veterans court) are diverting cases from the criminal courts and probation. This is a good thing for the community. Covid-19 has also added to the decline in revenue. Current year projected revenues are anticipated to be $286,500 short of projected expenses, with those variances split among the following agencies: Agency Fund # Projected Shortage Teen Court 171 $ 5,000 Law Library 640 $ 5,000 Legal Aid Society 652 $ 5,000 Court Innovations (Public Guardianship) 192 $ 5,000 Parole & Probation 681 $266,500 Total $286,500 FISCAL IMPACT: Funds are available from existing General Fund (001) appropriations. Each of the above Funds will reduce their budgeted revenues and establish a transfer from the General Fund. The overall fund balance of each of these funds will not change. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this request. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. -JAK RECOMMENDATION: That the Board of County Commissioners authorize budget amendments to provide funding from the General Fund (001) reserves to cover revenue shortfalls as identified by the chart in this Executive Summary.
