EXECUTIVE SUMMARY
Recommendation to approve the Chairman to sign six (6) Countywide Impact Fee Releases of Lien
for full payment of $95,918.13 (including $14,711.57 interest) and one (1) State Housing Initiatives
Partnership Impact Fee Deferral lien release ($12,389.98), pursuant to Agreement for Deferral of
100% of Collier County Impact Fees Program for Owner-occupied Affordable Housing Dwellings.
OBJECTIVE: To support the affordability of housing in Collier County through the County’s Impact
Fee Deferral and State Housing Initiatives Partnership (SHIP) Impact Fee Deferral programs.
CONSIDERATIONS: Pursuant to Article IV of Chapter 74 the Collier County Code of Ordinances, the
County may defer the payment of the impact fees for any new owner-occupied unit which qualifies as
affordable housing.
Section 74-401(a) (3) of the Code authorizes the County Manager to enter into an impact fee deferral
agreement with the developer, homeowner, or applicant. The deferred impact fees shall be a lien on the
property and the agreement shall be accepted by the County in lieu of prompt payment of the impact fee
that would otherwise be due and payable but for the agreement.
The SHIP Program pays for the impact fees in full to the County on behalf of the applicant and de fers the
SHIP payment to the applicant until the property is sold, refinanced, or no longer their primary residence.
The dwelling unit is to be utilized for affordable housing for a 15-year affordability period.
Resolution No. 18-58 provides that in the event of the death of the borrowers, all debt will be forgiven for
all affordable housing programs administered by Collier County Community and Human Services
Division (CHS). The Certificate of Death for the deceased has been provided to CHS.
The following table provides details regarding the associated liens that have been repaid in full and those
that have been forgiven. As such, release of lien is required.

FISCAL IMPACT: A total of $95,918.13 was paid to Collier County and deposited in the various
Growth Management Impact Fee Accounts. The total amount represents $81,206.56 in Impact Fees paid
and $14,711.57 in accumulated interest income. File 09-058-IF (deceased) lien is forgiven; therefore, no
Fiscal impact is associated with its release. Recording fees of $10 per Release of Lien have been paid by
the parties.
File 03-159-IF was funded by the State Housing Initiatives Partnership (SHIP). This lien has met the
affordability requirement; therefore, no Fiscal impact is associated with its release. The $10 recording fee
will be paid from fund (791), project 33613.
LEGAL CONSIDERATIONS: This Item is approved for form and legality and required a majority vote
for Board approval. - JAB
GROWTH MANAGEMENT IMPACT: The Impact Fee Deferral Program assists the County in
meeting some of the Housing Goals and Objectives in the Growth Management plan.

of Lien for full payment of $95,918.13 (including $14,711.57 interest) and one (1) State Housing
