EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign a Developer Agreement with
Housing Development Corporation of SW Florida, Inc., d/b/a/ HELP in the amount of $160,000 for
the acquisition of two (2) permanently affordable housing units.
OBJECTIVE: To continue to promote affordable housing strategies for moderate and gap income
persons through the use of the Local Affordable Housing Trust Fund.
CONSIDERATIONS: On April 24, 2018, the Board of County Commissioners (Board) adopted
Resolution No. 2018-82 declaring a valid public purpose for establishing a new Local Housing Trust
Fund (LHTF) and providing general guidelines for its use of monies.
On January 3, 2020, the Community and Human Services Division (CHS) advertised a gra nt application
cycle with applications due on February 10th, 2020 soliciting applications for the use of Local Affordable
Housing Trust Fund funding. On March 5, 2020 applications were reviewed, scored, ranked, and
recommended for funding by the Review and Ranking Committee. HELP submitted the sole application
eligible for LHTF funding. On May 4, 2020, the Affordable Housing Advisory Committee (AHAC)
reviewed the list of recommended awards.
This agreement will allocate funding to acquire two (2) permanently affordable rental housing units. The
units will be placed in the newly created Collier County Community Land Trust for long term
affordability, through a 99-year land lease. These units will be rented or held available for rent on a
continuous basis to persons or families who at the commencement of occupancy shall have a verifiable
annual income that does not exceed 140% of the Area Median Income. Units will carry rent and
occupancy restrictions for a minimum of thirty (30) years, until September 30, 2051. Household income
will be re-certified yearly upon lease renewal.
The Developer Agreement with HELP requires that the units will meet or exceed all applicable local
codes, standards, and zoning ordinances at the time of project completion and throughout the duration of
the affordability period.
FISCAL IMPACT: Funds for this agreement are budgeted within the Affordable Housing Fund (116),
Projects 50137.
LEGAL CONSIDERATIONS: This Item has been approved for form and legality and requires a
majority vote for Board approval. - JAB
GROWTH MANAGEMENT IMPACT: Acquisition of two (2) permanently affordable rental housing
units will further Goals, Policies, and Objectives of the Housing Element of the Collier County
Comprehensive Growth Management Plan.
RECOMMENDATION: To approve and authorize the Chairman to sign a Developer Agreement with
Housing Development Corporation of SW Florida, Inc., d/b/a/ HELP in the amount of $160,000 for the
acquisition of two (2) permanently affordable housing units.
