EXECUTIVE SUMMARY
Recommendation to approve a zero-dollar Change Order No. 1 to Agreement No. 19-7615, Big
Corkscrew Island Regional Park, adding 123 days to the South Contract portion of the Park
Project.
OBJECTIVE: To approve a zero-dollar Change Order No. 1 to Agreement No. 19-7615, Big Corkscrew
Island Regional Park (the “Park”), adding 123 days to the South Contract portion of the Park Project.
CONSIDERATIONS: On October 8, 2019, the Board approved Agreement No. 19-7615 (the
“Agreement”) to construct Big Corkscrew Island Regional Park, which will include such amenities as an
aquatic center, community center, athletic fields, concession buildings, an event lawn, playground,
basketball courts, tennis and pickleball courts, and walking paths. Thereafter, on November 10, 2019, the
Facilities Management Division issued a Notice to Proceed (“NTP”) to Astra Construction Services, LLC
to begin work under the Agreement. The Agreement provides for an overall project completion period of
608 days with Substantial Completion being reached in 563 days and Final Completion achieved within
forty-five days thereafter. The reference to a 608 overall project duration is also referenced in the “Bid
Scope of Work Outline,” which is an exhibit attached to the Agreement. The work under the Agreement
consists of two (2) separate construction periods that relate to the north portion of the Park’s construction
(the “North Contract”) and the south portion of the Park’s construction (the “South Contract”). Those
separate construction projects encompassed under the Agreement have a separate and distinct total
number of days to complete the respective work on those portions of the Park.
The NTP commencement date for the North Contract construction is November 12, 2019, with a
substantial completion date of November 27, 2020 (381 calendar days), and a final completion date of
January 11, 2021, a total of 426 calendar days.
The NTP commencement date for the South Contract construction is November 12, 2019, with a
substantial completion date of January 25, 2021 (440 calendar days), and a final completion date of
March 11, 2021, a total of 485 calendar days.
Both of those NTP’s are consistent with the time periods found in Section 5, the Contract Time and
Liquidated Damages provision set forth on page two of the Agreement.
This Change Order arises as a result of the need to extend the number of days to complete the South
Contract construction, which was necessitated by the need to begin work earlier in the southern portion of
the Park to promote and support the work that was ongoing in the North Contract construction portion.
The attached Change Order revises the NTP to expressly reflect that the South Contract shall have a
Substantial Completion of 563 days from the issuance of the NTP (May 28, 2021) and a Final Completion
date forty-five (45) days thereafter concluding 608 days from NTP (July 12, 2021).
FISCAL IMPACT: No Fiscal impact.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote
for Board approval. -SRT
GROWTH MANAGEMENT PLAN IMPACT: There is no impact to the Growth Management Plan
related to this action.
RECOMMENDATION: To approve zero-dollar Change Order No. 1, adding 123 days to the NTP for

Regional Park, and authorize the Chairman to sign the attached Change Order.

Dear Mr. Lindsay:
This letter serves as Collier County's official NOTICE TO PROCEED (NTP) to your
Company to Commence with the above referenced project on Tuesday, November 12,
2019. This NTP is issued pursuant to Contract #19-7615. The purchase order number
is shown above, and a copy of the P.O. is enclosed.
This NTP is limited to the scope of work for the Big Corkscrew Island Regional Park with
a lump sum price of Forty-Five Million, Sixty-Five Thousand, Four Hundred Fifty-Four
Dollars ($45,065,454.00).
To facilitate the payment process, please include the following information on each
invoice: The beginning and ending billing dates; the purchase order/work order n umber
written above, as well as the Collier County project number. Also, please describe clearly
which items in the agreed invoice line items are being billed to, and do not invoice more
than is remaining in a particular line item. Lastly, please mark the final invoice as “FINAL”.
The Commencement date for the services associated herewith shall be considered to be
Tuesday, November 12, 2019. No work is authorized after the final completion date
herein unless the time of the contract/work order is extended on or before the final
completion date. Invoices for unauthorized work will not be paid.

The project is divided into two Contract completion schedules. The Commencement date
for the North Contract construction shall be considered to be the NTP date of 11/12/2019.
The substantial completion date shall be considered to be 11/27/2020 (381 calenda r
days) from and after the North Contract Commencement date with an additional 45
calendar days to final completion. Final completion of all work for the North Contract shall
be considered to be 1/11/2021, a total of Four Hundred Twenty-six calendar days.
The Commencement date for the South Contract construction shall be considered to be
the NTP date of 11/12/2019. The substantial completion date shall be considered to be
1/25/2021 (440 calendar days) from and after the South Contract Commencement date
with an additional 45 calendar days to final completion. Final completion of all work for
the South Contract shall be considered to be 3/11/2021, a total of Four Hundred Eighty-
five calendar days.
